AU. that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
Iyin&'~at Mattituck, Town of Southold, County of Suffolk.and State of
New York, known and designated as Lot No. 38 on a certain map entitled, "Map
of Farmveu Associates," and filed in the Office of the Clerk of Suffolk on
September 1, 1989, as Map No. 8808, together with mandatory membership in the
Farmveu at Mattituck Homeowners Association, Inc. (hereinafter called the
Association) .
'lDGETHER with an easement of ingress and egress by vehicle or on foot in and to
any streets or roads as shown on the filed map: RESERVING to the party of the
first part, its successors or assigns the fee of all land lying in the bed of
any and all such streets and roads; and FURTHER RESERVING the right to convey the
fee title to said streets and roads together with natural drainage areas shown
on the filed map to the Town of Southold or any other municipal authority,
without the consent of any lot owner, mortgagee or any other party, at which
time the easement of ingress or egress shall be automatically extinguished.
AND 'lDGETHER with the benefits and SUBJECT to the burdens, covenants, restriction:
by-laws, rules, regulations and easements, all as set forth in the Amendment to
Declaration (setting forth Covenants, Restrictions, Easements, Charges and
Liens) made by the party of the first part, dated June 7, 1993, and recorded
in the Office of the Clerk of the County of Suffolk on the 8th day of July, 1993,
in Liber 11635 of the Coveyances at Page 684 and other covenants, restrictions,
easements and rights-of-way of record.
BEING AND INl'ENDED TO BE the same premises conveyed to the party of the first par
by deed dated June 5, 1997, and recorded in the Office of the Suffolk County
Clerk on June 19, 1997, in Liber 11836 at Page 653.
TOGETHER with all right, title and interest, if any, of the party 01 the lirst part in and to any streets and
roads abuttlDg the above, descnbed premIses to the center lines thereol; TOGETHER with the appurtenances
and all the estat~ and flg,hts of the party of the lirst part in and to said premises; TO HAVE AND TO
HOLD the prenllses herelD granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the part~ of the .first part covenants that th~ party of the lirst part has not done or suffered anything
whereby the said prermses have ~een enc~mbered In any way whatever, except as aforesaid.
AND the. part~. of the,lirst part, '~ comphance w!th Section 13 of the. Lien Law, covenants that the party of
the .first part \\ 111 receive the con,sJderatlOn for thiS conveyance and Will hold the right to receive such consid-
eratIOn as a trust fund to be apphed first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
