THIS CORRECTION DEED IS BEING AND INTENDED TO CORRECT THAT
CERTAIN DEED DATED JULY 27. 2004 WHICH WAS RECORDED IN THE
~FFOLK COUNTY CLERK'S OFFICE ON SEPTEMBER 15. 2004 IN LlBER 12343.
PAGE 554 WHEREAS IT LISTED THE INCORRECT NAME OF ONE OF THE
{LRANTEES. CHRISTINE RIZZO. WHEN THE GRANTEE'S CORRECT NAME
SHOULD HAVE READ. CHRISTINE BAVARO.
TOGETHER with all right, title and interest, if any, of the Party of the First Part in
and to any streets and roads abutting the above described premises to the center lines
thereof. TOGETHER with the appurtenances and all the estate and rights of the Party of
the First Part in and to said premises. TO HAVE AND TO HOLD the premises herein
granted unto the Party ofthe Sel:ond Part, the heirs or successors and assigns ofthe Party
of the Second Part forever.
AND the Party of the First Part covenants that the Party of the First Part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
AND the Party of the First Part, in compliance with Section 13 of the Lien Law,
co~enants that the Party of the First Part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost ofthe improvement before using any part of the total of the same for
any other purpose. The word "party" shall be construed as if it read "parties" whenever
the sense of this indenture so requires.
IN WITNESS WHEREOF, the Party ofthe First Part has duly executed this Deed
the day and year first above written.

ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying, and being at Lupton's Point in Mattituck, Town of
So~thold, County of Suffolk, and State of New York, more particularly bounded and
described as follows:
BEGINNING at a concrete monument in the northerly side of a private road, which
private road runs easterly from Marratooka Road (Lane) to Deep Hole Creek, said
point being where the division line between lands now or formerly of William Eslte and the
premises about to be described, intersect the northerly side of said private road;
RUNNING THENCE along said division line, north 1 degree 45 minutes east 95 feet, more
or less, to the Southerly side of Deep Hole Creek (also known as Gardiners Creek or Willes
Creek); THENCE in an easterly direction along the southerly side of Deep Hole Creek, 161
feet, more or less, to the point where the northerly prolongation of the easterly line of land
now or formerly of Robert S. Barker, intersects the southerly side of Deep Hole Creek;
THENCE Southerly along said prolongation, south 1 degree, 45 minutes West 96 feet, more
or less, to a concrete monument on the northerly side of the aforesaid private road;
THENCE along the northerly side of said private 'road, north 88 degrees 15 minutes west
159.81 feet, to the point or place of BEGINNING. ,
TOGETHER with a right of way over the 20 foot wide Private Road, to and from
the rear of the premises hereby conveyed to 'Marl.atookaLane, and to and from Deep Hole
Creek at the end ofsaid 20 foo~ private'road where it adjoins Deep Hole Creek and the
easterly end of Lupton's Point.
