The Southold Town Board, at their regular meeting held on May
6, 1986, adopted a resolution granting you permission to use a portion
of Oregon Road, Mattituck, from May 8 through May 11, 1986, for the
purpose of filming "The Hitchhikers", a short film, provided there is
no unreasonable interruption of traffic on the highway, and provided
you secure and maintain the proper insurance to hold the Town of
Southold harmless (certificate of insurance is on file).

PERMIT FOR PUBLIC DISPLAY OF FIREWORKS
I, JUDITH T. TERRY, Town Clerk of the Town of Southold,
Suffolk County, New York, being an officer duly designated by
the Town Board of the Town of Southold for this purpose, do hereby,
GRANT TO Duncan E Katz Associates
A PERMIT FOR THE PUBLIC DISPLAY OF FIREWORKS by said organization
in accordance with the provisions of Section 405.00 of the Penal I
Law of the State of New York, on Friday, May 10, 198fi, at approximately
6.00 P M (raindate - May 11 1986) Oreqon Road Mattittack, New York
at the time and place set forth in the application therefor. ON

'CONDITION THAT the bond (indemnity insurance) required shall
'continue in full force and effect in favor of the Town of Southold,'
Nand PROVIDED that the actual point at which the fireworks are to j
Ibe fired shall be at least two hundred feet from the nearest build
`ing, public highway or railroad or other means of travel, and at ~
!'least fifty feet from the nearest above ground telephone or tele-
graph line, tree or other overhead obstruction, that the audience
at such display shall be restrained behind lines at least one
hundred and fifty feet from the point at which the fireworks are
discharged and only persons in active charge of the display shall
'be allowed inside these lines, that all fireworks that fire a
projectile shall be so set up that the projectile will go into the
air as nearby as possible in a vertical direction, unless such
'fireworks are to be fired from the shore of a lake or other large
:body of water, then they may be directed in such manner that the
:.falling residue from the deflagration will fall into such lake or
body of water, that any fireworks that remain unfired after the
(display is concluded shall be immediately disposed of in a way
,safe for the particular type of fireworks remaining, that no fire-~I
works display shall be held during any wind storm in which the
:wind reaches a velocity of more than thirty miles per hour, that
all the persons in actual charge of .firing the fireworks shall be
.over the age of eighteen years, competent and physically fit for
'the task, that there shall be at least two such operators constant-
ly on duty during the discharge and that at least two sodaacid or
other approved type fire extinguishers of at least two and one- ',
half gallons capacity each shall be kept at such widely separated
points as possible within the actual area of the display.

Jeffrey Switzer filed this application for "Fireworks Permit"
He will check back within a couple of hours to be certain that
application is in order. Their insurance company will sending
the amended certificate of insurance by Federal Express Mail.
I spoke to them earlier this morning and advised of correction
and amendment to same.

I am in receipt of your letter of April 30, 1986 relative to the
use of a portion of Oregon Road, Mattituck, for filming "The Hitch-
hikers". Permission to use Oregon Road is solely within the discretion
of the Southold Town Board, and your request will be submitted to
them at their May 6, 1986 meeting for consideration. However, the
Town Board's permission does not include the use of firecrackers.
The law specifies that the discharge of fireworks is only permitted
by the issuance of a license by the Town Clerk. In the absence of
such a license you may not discharge firecrackers. I am, therefore,
enclosing an application for such a license, instructions with regard to
same, and a copy of the New York State Penal Law relative to the
Licensing and Other Provisions Relating to Fireworks. Once you have
satisfied all of the requirements I will be happy to issue you a license.

To the members of the Town Board,
This is an official request for permission to shoot a film
entitled "The Hitchhikers" on Oregon Road in Mattituck. The
shoot would take place during the four day period between
May 8th and 11th, and would require minimal assistance from
the town.
The story involves two hitchhikers on either side of the road,
who, during the period of the film, become friends. It is a
short film (approx. 11 min.) which is being completely fin-
anced by myself and has no commercial ties whatsoever. Since
the section of Oregon Road which we have choosen is very quiet,
we don't believe that traffic will be a problem. Any traffic
that does come by, we will be able to allow through after only
moments of waiting, and that happening only when we are roll-
ing camera. Any regulation and/or recomendations that the
board may have on this matter we would be more than willing to
comply with.
The only other matter that needs to be brought to your attent-
ion is that during the course of the story, one of the char-
actors ignites some small fireworks. Specifically, these would
be small "salute" type firecrackers and nothing larger than a
roman candle. Again, we will be happy to comply with any rules
you may have concerning these matters.
A certificate of insurance naming the Town of Southold as an
additional insured is being sent directly to you from our insur-
ance-agent, Sterling and Sterling Insurance, of Great Neck N.Y.
If it has not arrived by Friday or-there are any problems, please
contact my production manager, and he will take care of it.

Penal Law § 1594-a(I-b), (3), (q), (5), (g) (10).
§ 405.00 Permits for public displays of fireworks
1. Definition of "permit authority." The term "permit au•
thority," as used in this section, means and includes the agency
authorized to grant and issue the permits provided in this sec-
tion, which agency in the territory within a state park shall be
the state agency having custody and control thereof, in the ter-
ritory within a county park shall be the county park commis-
sion, or such other agency having jurisdiction, control and/or
operation of the parks or parkways within which any fireworks
are to be displayed, in a city shall be the duly constituted licens-
ing agency thereof and, in the absence of such agency, shall be
an officer designated for the purpose by the legislative body
thereof, in a village shall be an officer designated for the pur-
pose by the board of trustees thereof and in the territory of a
town outside of villages shall be an officer designated for the
purpose by the town board thereof.
2. Permits for public displays. Notwithstanding the provi-
sions of section 270.00, the permit authority of a state park,
county park, city, village or town may upon application in writ-
ing, grant a permit for the public display of fireworks by munic-
ipalities, fair associations, amusement parks or organizations of
individuals. The application for such permit shall set forth:
(a) The name of the body sponsoring the display and the
names of the persons actually to be in charge of the firing
of the display.
(b) The date and time of day at which the display is to
be held.

FIREWORKS INSTRUCTIONS
1. Name of body sponsoring display.
2. The date and time of day at which the display is to be held.
3. The exact location planned for the display.
4. The age, experience and physical characteristics of the persons who
are to do the actual discharging of the fireworks. '
5, The number and kind of fireworks to be discharged.
6. The manner and place of storage of such fireworks prior to the display.
7. A diagram of the grounds on which the display is to be held, showing
the point at which the fireworks are to be discharyed, the location of
all buildings, highways and other lines of communication, the lines
behind which the audience will be restrained and location of all nearby
trees, telegraph or telephone lines or other overhead obstructions.
8. Such other information as the permit authority may deem necessary to
protect persons and property.
9. An indemnity insurance policy with liability coverage and indemnity
protection of $1,000,000.00 per person for bodily injury, $1,000,000.00
per accident, $1,000,000.00 property damage.
10. The Town of Southold must have policy in its possession before permit
is issued. The named insured must read: TOWN OF SOUTHOLD.
11. Application for a permit must be made at least five days in advance of
the date of the display.
