1. STRICT APPLICATION OF THE ORDINANCE would produce proctical difficulties or unneces-
sory HARDSHIP because the subject premises is an oversize parcel compared to the
other parcels in the neighborhood and said parcel fronts on two streets, i. e.,
Main Bayview Road and Summit Road. Applipants purchased Lots 29 and 30 on
May 19, 1964 (Said parcels are describt\d on ~the survey ann!lxed hereto and made
a part hereof as Parcels 1 and 2.) Parcell is a vacant parcel and Parcel 2 is
a parcel with a one story frame building. Said Parcels '.1 and ~ 2. have access
off of Summit Road and a right of way. The other parcel which the applicant seeks
to have set off as a single and separate parcel is comprised of Lot 29 A and a des-
cribed piece referred to on the annexed survey as Parcel 5. Part of the described
said Parcel 5 was purchased by the applicant on August 14. 1947 and Lot 29 A was
purchased by the applicant on January of 1958. Said Parcel 5,presently has a one
and one-half story frame house and a garage with fronlage of 95 feet on Main Bayview
Road. Parcels 1 and 2 would have approximately 10,475.00 square feet and Parcel
5 would contain approximately 20, 500 square feet. The density would be increased
orily by one building lot due to the fact that parcel 2 presently has a house as does
parcel 5. It is not economically feasible nor practicable for the applicant to sell the
subject premises as one parcelwith two houses, and it would be an economic hardship
if this Variance is not granted.
2. The hardship creoted is UNIQUE ond is not shored by all properties alike in the immediate
vicinity of this property and in this use district because the subject premises is an oversize
parcel presently containing two houses and applicant simply seeks to set off each
house on its own parceias well as a vacant building parcel. Part of the subject
premises is a described parce1 and lots on a filed map.
3. The Voriance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the parcels created would be in keeping with the
parcels in the neighborhood, and the granting of the variance would not change the
character of the community due to the fact that the subject premises presently has
twO' buildings - houses.

Dear Mr. Michaelis:
The Planning Board has reviewed your inquiry as to whether
Planning Board action is required for you to transfer Lot 29A of
the map of "Bayside Terrace" to the owner of the adjacent parcel
to the south.
The Bayside Terrace subdivision is excepted from the lot
area and width requirements of the Town's Zoning Code.
Lots 29A and 29 were inadvertently merged by the Town on
April 16, 1984, and should have remained single and separate.
No Planning Board action is required. However, you should
have two new deeds and surveys filed in the County Clerk's
office to reflect the new property boundaries. The Building
Department will not issue any building permits or revised
Certificate of Occupancies until it receives copies of the filed
deeds.

After investigation and inspection, the Board finds that
the applicant requests permission to set off Lots 3 and 4 on
the Van Tuyl survey of May 13, 1977, south side Summit Road and
north side Bayview Road, Southold, New York. The findings of
the Board are that there is no way to enlarge these lots. They
were created p.tior to the present Zoning Ordinance ~ . Both lots

ship will not affect the character of the area.
The Board finds that strict application of the Ordinance
\.,ould produce practical di.fficulties or unnecessary hardship;

in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of

THEREFORE IT WAS RESOLVED, Gilbert Michaelis, Main Bayview
Road, Southold, New York, be GRANTED permission to create Lots 3
and 4 as described on the Van Tuyl survey of May 13, 1977. There
will be two separate lots with access to Lot 3 over a 25' right-
of-way from Main Bayview Road to Lot 3 adjoining the westerly
boundary of Lot 4.
