Present were: Bennett Orlowski, Jr., Chairman William F. Mullen, Jr., Member Richard G. Ward, Member G. Ritchie Latham, Jr., Member Executive Administrator Victor Lessard Town Planner David Emilita Planner James Bryer Secretary Diane M. Schultze Absent: Kenneth Edwards, Member 7:30 p.m. Public Hearing on the question of approval of the minor subdivision of Vine View Estates, located at County Route 48, Southold for 4 lots on 18 acres. Mr. Orlowski: We have proof of publication in the Long Island Traveler Watchman signed by Pat Wood and nctcrized by Barbara Forbes. We have proof of publcation in the Suffolk Times signed by Mary Kelly and notorized by Mary Deegnan. I will dispense with the reading of the metes and bounds, if anyone has a problem withthat, please let me know. At this time everything in the file is in order. And, I will ask if there are any objections? Hearing none. Are there any endorsements of this subdivision? Mr. Henry E. Raynor, Jr.; If it pleases the Board, Mr. Chairman, I would like to speak in favor of'this. I believe that the requirements of the Suffolk County as well as this Board have been met. The Board is well aware that all of the lots are over 4 acres and we will be filing the appropriate covenants not to re-subdivide the property,- I think this was started before the Board in August 1985 and I would request approval of this minor subdivision. On a motion made byMr. Mullen, seconded byMr.Latham, it was RESOLVED that the Southold Town Planning Board set Monday, August 25, 1986 at the Southold Town Hall as the time and place for the next regular Planning Board meeting. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Ward, seconded byMr. Mullen, it was RESOLVED that the Southotd Town Planning Board approve the preliminary map for the major subdivision of Frieda Crowle¥ to be knowns as "Crowley Estates" located at North Bayview Road and Jacobs Lane, Southcld for 6 lots on 14.34 acres, survey dated October, 1984. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOVLED that the Southold Town Planning Board approve the preliminary map for Deborah ~dson for 6 lots on 12.553 acres located at Depot Lane, Cutchogue, survey dated as amended December 12,1985, tax map no. 1000-102-2-6. Vote of the Board: Ayes: Orlowski, Mutlen, Latham, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that whereas a formal application for the approval of a subdivision plat entitled "Edward D. Dart" located at Southold was submitted to the Planning Board on May 22, 1984 and the filing fee of $100 was paid on May 23, 1984, and, WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on Monday, July 14, 1986 at 8:00 p.m., and Planning Board Page 3 8/4/86 On a motion made by Mr. Ward, seconded by Mr. Mullen, it was WHEREAS, the~requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW,therefore, be it RESOLVED that the application of Edward D. Dart for approval of said subdivision plat prepared by Rod Van Tuyl dated as last amended March 27, 1986 be approved and the Chairman be authorized to endorse approval o said subdivision plat, subject to the following conditions within six months from the date of this resolution: 1. NO lot shall be subdivided or its lots lines changed in any manner at any future date unless authorized by the Town of Southold Planning Board. 2. Since this subdivision has resulted in the subdivision of the original tract into five lots the map of the subdivision shall be filed in the office of the County Clerk. 3. The. existing building shall either be removed or relocated and made conforming to the zoning requirements of the Town of Southold~. 4. The access to th property (curbs cuts) and the 25 foot access easement shall be created as proposed subject to the approval of the Suffolk County Department of Public Works. 5. No driveway or entrance road on Railroad-Youngs Avenue s~hll be located within fifty (50) feet of the northerly end of the short radius curve connecting the northerly side of the right-of-way of Middle Road with the westerly side of the right-of-way of Railroad -Young's Avenue. 6. All stormwater runoff resulting from the development and improvement of this subdivisin or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out on to the right-of-waY to Middle Road. 7. Conditions 1,4,5, and 6 sahll be filed as covenants and restrictions in the office of the' County Clerk on or prior to the granting of approval of this subdivision. 8. The covenants and restrictions previously submitted to the Planning Board and approved by the Town Attorney sall be file din the offic eof the County Clerk. These covenants and resrictions were regarding the disposition of the building on the premises. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Wa.rd Planning Board Page~4 8/4/86 Mr. James Grey was present to discuss a presubmission conference for the site plan of Pudge Corp. located at Horton~s Lane, Southold for construction of storage buildings. Mr. William F. Mullen, Jr. abstained from any dicussion since he has business connections with Mr. Grey. Mr. Ward questi-oned if the building area was ground or first and second floors. Mr. Grey stated that the second floor would be used for storage. Mr. Ward questioned if the buildings would have a gabled roof. It was noted that the property is in a C1 zone. Mr. Ward stated that he had not had an opportunity to review the calculations for this proposal. Mr. Ward felt that it was an intense use of the site with building and parking. Mr. Grey noted that the first stage of this industrial complex was under construction on Horton's Lane, now. Mr.Emilita stated that he felt that there was too mu~h hard surface. Mr. Orlowski noted that in the calculations there was 2250 square feet of landscaping proposed. MR. Grey stated that according to his calculations the site plan was over on the required parking and landscaping. It was the consensus of the Board to further review this proposal prior to any recommendations or action. On a motion made byMr. Mullen, seconded by Mr. Latham, it was RESOLVED that whereas a formal application for the approval of a subdivision plat entitled "Russett Acres" located at Mattituck was submitted tothe Planning Board on Juanuary 13, 1986 and filing fee was paid on January 27, 1986, and, WHEREAS, a public hearing was held on said subdivison appl±catlon and palt at the Town Hall, Southold New York, o Monday, July 14, 1986 at 8:15 p.m., and WHEREAS, the requirements of ~he Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of Henry E. and Mary Raynor for approval Of said subdivision plat prepard by Rod Van Tuyl dated as amended July 24, 1986 be approved and the Chairman be authoried to endorse approval on said subdivison plat, subject : 1. Review and ~nsideration of comments and recommendations from the Suffolk County Planning Commission. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward The following new proposals were set for field inspections: 1. Wolf Pit Associates - 29 lots on 64 acres in the cluster concept at Mill Lane and Mill Road, Mattituck. Planning Board Page5 8/4/86 2. Joseph and Catherine Riemer - set-off of 10,625 square feet from 21,975 square feet located at Bayshore Road, Greenport. The Board noted that this appeared to be 3 ½ lots which had become merged and now the applicant was proposing two lots. There was no action on this matter by the Board of Appeals to date. 8:00 p.m. Patricia Moore from Rudy Bruer, esq. office was present to tdiscuss the site plan for Wissmann for construction of a single family residence located at Gull Pond Lane, Greenport. This site plan was the condition of a prior subdivision of this property. Mrs. Moore explained that this a unique situation, in 1975 the Board of Appeals created four lots, one of which is the subject of the application. One of the four lots is now owned by Mr. Wissmann. Mrs. Moore presented the action of the Board of Appeals which creted the four lots in 1975. Condition NO. 3 in the Board of Appeals approval indicates that site plan approval must be obtained which ms why the application was made to the Planning Board. The lots were undersized when they were created. Mrs. Moore also presented a copy of the tax maps to give the Board an idea of the location, and marked the land of Mr. Wissman and the land of adjoining neighbors, one~ of which was Mr. Spitzenberger who had obtained a building permit without having to go through the conditions of obtaining site~an approval. Mrs. Moore stated that they were not objecting to Mr. Spitzenberger's home only stating for the record since it posed a hardship for Mr. Wissman if he could not build a house on his property. Mrs. Moore stated that the conditions of the Board of Appeals were never recorded and therfore, they did not appear in the title nor did they appear an the deed. Mrs. Moore presented the original title policy and the original deed indicating th~s. Mr. Wissman was quite surprised when he applied' for a Building Permit and was told that he could not obtain one without going for additional permits. Mrs. Moore stated that they had applied to the zoning Board and received a decision on February 27, 1986, lifting the conditions of the previous decision. However, the denial was still received from the Building Department because variances on set backs were required, and a wetlands permit was received from the TrUstees. Mrs. Moore presented copies of all the approvals obtained from the Board of Appeals and the Trustees and supplied a copy of the SEQRA determination from the Board of Appeals completing this process. Mr. Lessard stated that in 1975 when the Board of Appeals subdivided the property, they requested that covenants and restrictions be filed and the applicant filed the covenants and restrictions on the lot which Mr. Wissmann has only. Mr. Orlowski stated that if the Board of Appeals had lifted the previous conditons then site plan approval was not required. Mrs. Moore stated that they did not acutally remove the conditions, however, they clarified that a residence could be constructed. Mr. Orlowski stated that if this was approved in 1975 by the Board of Appeals then it was also grandfathered in 1979 with others. Planning Board Page 6 8/4/86 Wissmann cont. Mr. Lessard stated that it is a legal lot since it was subdivided and grandfathered. Mrs. Moore also stated that a vacant land certificate of occupancy had been obtained for the parcel. On a motion made by Mr Ward, seconded byMr. Latham, it was RESOLVED that the Southold TownPlanning Board approve the site plan for Robert Wissmann for construction of a single family dwelling located at Gull Pond Lane, Greenport, survey dated as revised July 21, 1986, subject to: 1. Surveys indicating the following site plan elements: driveway septic system finsihed floor elevation bulkhead Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Winds Way Building Corp. - The follawing action was taken on the advise of Town Planner, David Emilita since a conditional negative declaration could be issued based upon the correspondence of the Department of Environmental Conservation. (DEC). On a motion made by Mr. Ward, seconded by Mr. Latham, the following action was taken: CONDITIONAL NEGATIVE DECLARATION Pursuant to ARticle 8 of the Environmental Conservation Law State Environmental Quality Review Act and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code of the TOwn of Soutohld, notice is hereby given that Southold Town Planning Baord as lead agency for the action descriped below has determined that the project will not have a significant effect on the environment. DESCRIPTION OF ACTION ~ The minor subdivision of"Winds Way Building Corp" is for four lots on 11.8 acres at New Suffolk Avenue, Cutchogue for single - family residential structures. SCTM 1000-116-1-1. CONDITONS OF DECLARATION This negative declaration is declared with the provision that the Department of Environmental Conservation's comments are addressed satisfactorily by the applicant. Planning Board page 7 8/4/86 REASONS SUPPORTING THIS DETERMINATION.: The project has been determined not to have a significant effect on the environment for the following reasons; An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The DEC has received an applictionand a Tidal Wetlands Permit is needed. The DEC has no objection to our agency assuming the lead agency status fo rhtis action. The following comments by the DEC are to be addressed by the aplicant: show building enveloeps, construction of roads, driveways, decks and structures should cover no more than 20% of upland area Of each lot. The-Suffolk County Department of Health Services has not responded in the alotted time, therefore, it is assumed that there are nocomments or objections from that agency. The Suffolk County Department of Health Services has no objection to our designation of lead agency status. There is no record of an application to this Department. The Health Department does require an application to construct prior to further review. It appears that the proposed action conforms to the minimum lot size requirement for Article 6 (Suffolk County Sanitary Code). Because there has been no correspondence from the Department of Environmental Conservation in the alotted time, it is assumed that there are no comments nor objections from that agency. This project conforms to the Southold Town Code for the Subdivision Regulations. Any further information can be obtained by contacting Diane M. It was noted that this proposal is pending before the Board of Appeals for a variance on the lot size. Mr. Bryer explained that the Planning Board can not take any action on the SEQRA until a variance is obtained from the Board of Appeals because the current proposal can not be acted on by the Planning Board unless a variance is granted. Mrs. Moore, from Rudy Bruer's-office was present. She explained that the request for a decision under SEQRA came about as a result of an application to the Health Department for Article 6. They required a SEQRA determination prior to their action. It was noted that the Planning Board could not make a determination on this proposal as proposed since the lots were not conforming. This application was tabled until a decision is reached by the Board of Appeals. On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the lot line change for John Braider located at Gull Pond Lane, Greenport to re-locate lot lines within the subdivision formerly of Leon Marcus, survey dated as mapped June 4., 1986, tax map nos. 1000-35-3-12.5 and 12.6. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Mohring Enterprises - The Board reviewed this propsal for 21 lots on 40 acres at the Corner of Cox Neck Road and County Route 48, Mattituck. Three of the proposed lots are in the B zone and th rest are in the A zone. Mr. Bryer stated that Planning Board Page 9 8/4/86 he would recommend a cluster concept for this proposal. Mr. Ward stated that in his review he would recommend a cluster subdivision keeping the area to the South as open space, except fo the business zone. The business zone should be separated and subdivided out ofthe residential zone. On a motion made byMr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board recommend that the major subdivision of Mohring Enterprises, located at Mattituck, be re-drawn as a cluster subdivision with the oepn space to the west and north of the business lots on Sound Avenue with the residential lots to the North of the open space. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the sketch map for the major subdivision of James Cohill for seven lots on 18.9 acres located at Maill Road and Grant Avenue, Mattituck, survey dated as last amended May 7, 1986, in the cluster concept, subject to: 1. Amendeing the survey to increase the acreage of proposed lot No. 7 to include that land to the west of the lot adjacent to Eugene O. Graf. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Latha~ seconded by Mr. Mullen, it was RESOLVED that the Southold Town P.lanning Board declare themselves lead agency under the STate Environmenteal Qualily Review Act for the major subdivision of James Cohill located at Mill Road and Grand AVenue, Mattituck. An initial determination of non-significance has been made. Vote of the Board: Ayes: Orlowski, Multen, Latham, Ward FRank Zimmer - The Planning Board reviewed this proposal for 4 lots on 17 acres located at Main Road, Orient. It was noted that the access road will have to be improved as per the specifications of the Inspector John W. Davis. The Board had meet with Mr. Zimmer who agreed to the improvements on the right-of-way. Mr. Ward stated that ~ny approval would be subject to Article 6 from the Suffolk County Department of Health Services with regard to the water and. sewer. It was noted that since this is a mino~ subdivision, Article 6 would have to be obtained prior to a public hearing on the questio of approval of the Planning Board Page 10 8/4/86 subdivision. On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the sketch map for Frank Zimmer for 4 lots on 17.544 acres located at Main Road, Orient, survey dated as amended June 10, 1985, subject to compliance with Inspector John W. Davis' report No. 527 with regard to improving the access road. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board declare themselves lead agency under the State Environmental Quality Review Act for the minor subdivision for Frank .Zimmer located at Orient. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Caravanos Mirros On a motion made by Mr. Mullen, seconded by Mr. Latham, it was RESOVLED that the $outhold Town Planning Board declare themselves lead agency under the State Environmental Quality Review Act for the minor subdivision of Caravanos and Mirros located at Orient for two lots on 5 acres. Suffolk County Tax Map no. 1000-15-8-24. Vote of the Board: Ayes: Grlowski~ Mullen, Latham, Ward It was also the consensus of the Board to request that the survey indicate the flood plain. It was also requeted that Article 6 approval, pursuant to the Health Department Sanitary Code, be obtained as well as approval or review by the Department of Environmental Conservation prior to any further action by the Planning Board. Mr. Mirros was present for this discussion. Robert Waddington - Metro Rental - The Board reviewed this site plan for construction of a storage building behind the existing buildin~ located at Main Road, Mattituck. Mr. Bryer stated that he had met with the applicant and the purpose bf constructing thiS was so all of the equipment which is currently in'the front of the store in the parking area can be moved to this building. Mr. Mullen stated that the Board should make a field inspection because it is a bad situation there with regard to parking. It was the consensus of the Board to hold this until a field inspection is conducted. Planning Board Page 11 8/4/86 Jehovah's Witness Church - The Board reviewed tis site plan for an addition on an existing church located at Indian Neck Lane, Peconic. The Board of Appeals had granted a special exception with the condition that the parking for the use remain on the premises at all time. Mr. Leo Russell was present. Mr. Russell stated that he had received approval from the Highway Department to cut the shoulder on Indian Neck Lane and Spring Lane to allow additional parking for five cars. Mr. Russell stated that they have an attendent to park cars and have not had any problem with this arrangement. Ms. Swatstanowicz, from the audience, stated that she had seen cars parked acrossed the street. On a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOVLED that the Southold Town Planning Board approve the site plan for the "Greenport New York Congregation of Jehova's Witnesses" lcoated at Indian Neck Lane, Peconic for construction of an addition on an. existing church, survey dated as last amendedJuly 16, 1986, subject to: 1. A one-year review. 2. Ail parking for this use should be kept on the premises (on-site) at all times. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board accept Inspector John W. Davis' report No. 525 regarding the final inspection on the access road within the minor subdivision formerly owneed by Robert and Aldona Norkus located at Southold. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board accept Inspector John W. Davis' report No. 526 regarding'the final inspection on the roads within the major subdivision of Land's End located at Orient. Vote of the Board: Ayes: 0rlowski, Latham, Ward Abstained: Mullen On a motion made by Mr. Latham, seconded by Mr.Ward, it was RESOVLED that the Southold Town Planning Board, in concurrence Planning Board Page 12 8/4/86 with Inspector John Davis and the Highway Superintendent, recommend to the Town Board that the performance bond for the major subdivision of Land's End located at Orient be released. Vote of the Board: Ayes: Orlowski, Latham, Ward Abstained: Mul~en Tartan Oil Company - The Board reviewed this revised site plan for the gas station on County Route 48, Peconic, previously granted for Allen Ovsianik. The new proposal eliminates the front entrance on Public Road to allow for more landscaping and turns the building 90© with an increased setback from 35' to 47' It was noted that the pumps will be moved from an east/west direction to a north/south direction to allow for better circulation. Mr. Deutzeman, architect, was present. The Board discussed the possiblity of eliminating one of the accesses to County Route 48. The Board was in favor of the basic layout and decided they would conduct a field inspection prior to any decision with regard to elminating the additional curb cut on the county road. The Board noted that they could not consider approval until the plan is certified, therefore, by that time, they would have a decision on the curb cuts. On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board refer the amended site plan foTartan Gil Compancy , for construction of a gas station located at North Road, County Route 48, Peconic to the Building Department for certification. Survey dated as amended 5/31/86. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr.Mullen, seconded by Mr. Latham, it was RESOLVED that the Southcld Town Planning Board set Monday, August 25, 1.986 at 7:30 p.m. at the Southold Town Hall, as the time and place for a public hearing onthe question of approval of the minor subdivision for John and Margaret Kerbs located at Southold. 4 lots on 6.084 acres, tax map no. 1000 3-2,3,4.
