BARGAIN AND SALE DEED WITH COVENANT AGAINST GRANTOR'S
ACTS (INDIVIDUAL OR CORPORATION)

CAUTION: THIS AGREEMENT SHOULD BE PREPARED BY AN ATTORNEY AND REVIEWED BY ATTORNEYS FOR SELLER AND
PURCHASER BEFORE SIGNING.

Life Tenant), residing at The White Dove, 1130 7th Avenne, Vero Beach, Florida 32960
party of the first part, and
RITA M. PASCUA and MURIEL PASCUA,
residing at 720 Western Highway, Blauvelt, New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other lawful
consideration, lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party ofthe second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York,
SEE SCHEDULE' A' ATTACHED HERETO AND MADE A PART HEREOF
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights ofthe party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
The word "party" shall be construed as ifit read "parties" whenever the sense of this indenture so
reqUIres.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.

SCHEDULE A
ALL that certain plot, piece or parcel of land, situate, lying and being at Mattituck, in the
Town of South old, County of Suffolk and State of New York, bounded and described as follows:
BEGINNING at a monument set on the southerly line of New Suffolk Avenue at the westerly
line of Deep Hole Drive;
RUNNING THENCE along the westerly line of Deep Hole Drive, South 02 degrees 40
minutes 40 seconds West, 126.68 feet to an iron pipe and land now or formerly of Edgett;
THENCE along said land, two courses and distances:
1. South 87 degrees 01 minutes 20 seconds West, 30.00 feet;
2. South 84 degrees 07 minutes West, 197.00 feet, more or less, to ordinary high water
mark of Deep Hole Creek;
THENCE northerly along said Deep Hole Creek and across a branch of said Creek along a tie
line bearing North 07 degrees 52 minutes 41 seconds West, 52.79 feet;
THENCE along land last described, North 16 degrees 06 minutes East, 130 feet to an iron
pipe on said southerly line of New Suffolk Avenue;
THENCE along said line of New Suffolk Avenue, South 81 degrees 54 minutes East, 205.07
feet to the point of BEGINNING.
TOGETHER with all the right, title and interest of the parties of the first part of, in and to
those portions of New Suffolk Avenue and Deep Hole Drive, adjacent to said premises to the center
line thereof.
TOGETHER with all the right, title and interest of the parties of the first part of, in and to
land below the high water mark and under the waters of Deep Hole Creek adjacent t said premises.
SUBJECT to the following covenants and restrictions:
1. That the purchasers shall not erect or permit to be erected on any lot any buildings except one
detached dwelling house for one family and one garage for private use for said dwelling and a
private boathouse.
2. That no dwelling erected thereon shall cost less than $8,000.00.
3. That no part of any building or cesspool on any lot shall be less than 25 feet from Deep Hole
Drive and New Suffolk Avenue and less than 5 feet from the side boundary line of any lot.
4. No outside toilets or stables shall be erected or permitted to be erected on any part of the
premises and no fowl or pigs shall be kept on said premises
5. The parties of the second part shall not manufacture, sell or permit to be manufactured or
sold, on said premises, any goods or merchandise of any kind and shall not carry on, or permit any
business or trade whatsoever, upon said premises, and will not carry on or permit any manner of
things which will be a nuisance, unwholesome or offensive to the neighborhood.
6. No signs of any kind shall be erected, except those erected with the permission of the parties
of the first part herein.
7. No fence or hedges shall be erected or allowed which are over 3 feet 6 inches in height.
The foregoing reservations and restrictions are to run with the land and shall be binding upon the
purchasers, their heirs, executors and assigns until January 1,1960, except, however, that the parties
of the first part reserve the right to change, alter or amend the reservations in whole or in part as they
may from time to time see fit.
