Roses and Karen Lee Roses', as tenants by the entirety of 1455 Pike Street, Mattituck, New York 11952 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and No Cents ($IO.OO)and other valuable consideration, lawful money of the United States, paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Mattituck, Town of Southold, Suffolk County, New York, known and described at Lot NO.5 on a certain map entitled, "Mattituck Estates, Inc." filed in the Office of the Clerk of the County of Suffolk on September 3, 1965 as Map No. 4453 and more particularly bounded and described as follows: BEGINNING at a monument set in the southerly side of Main Road at the extreme easterly end of an arc of a curve connecting the easterly side of Cardinal Drive with the southerly side of Main Road; RUNNING THENCE North 88 degrees 08 minutes 20 seconds East along the southerly side of Main Road a distance of 80.00 feet; THENCE South I degree 51 minutes 40 seconds East a distance of 200,00 feet; THENCE South 88 degrees 8 minutes 20 seconds West a distance of 133.92 feet to the easterly side of Cardinal Drive; THENCE the following three (3) courses and distances along the easterly side of Cardinal Drive: I. North 6 degrees 37 minutes 10 seconds East a distance of26.58 feet 2. North I degree 51 minutes 40 seconds West, a distance of 123.71 feet 3. Along the arc of a curve bearing to the right having a radius of 50.00 feet, a distance of 78.54 feet to the point or place of BEGINNING. Premises being the same premises described in the deed recorded in Liber 11798 page 962. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to SaId premises, TO HA VE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and aSSigns of the party of the second part forever. AND the party of the first part, covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so reqmres.
