They placed the house in the central part of the property when they first purchased it prior to the Zoning Ordinance. The houses in the vicinity of this property are all either 12~ foot plots or less. If M_vs. S~hiels were permitted to sell a 12% foot plot on each side of the present residence it would ~o.t destroy the present c. haracter of t~e neighborhood because the o~s would b~ the same szze of the residences in the area. Southold Town Board of Appeals -13- July 13, 1972 After investigation and inspection the Board finds that applicant requests permission to divide property with existing dwelling, Lots 6,' 7, 8, 9, 10, ll, 12 and one half of 5, Mmp of Goose Neck Estates, $outhold, New York. The Board finds that this division will be an improvement in the area; that it will provide uniformity with the surrounding residences; that both of the proposed plots would be used for one family dwellings. The Boamd agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance w~ld produce practical difficulties or unnecessary hsmdship; the hardship created is unique and would not be shared by all properties alike in the i~ediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. TEE CH~IR~N: We have had considerable trouble with manure, and an inordinate amount of difficulty all round. I would say I am not against a stable per se. !t ts something which goes beyond that. There are two sides of every story and two ends to a horse so, aside from the obvious problems of manure and flies and those people who are allergic and sensitive, primarily the reason we would be in opposition at this point is that it is oua section of highway that is lethal. Zt consists of several curve~ three- quarters of a mile east there is a very low bridge. All trucks over a certain size have te turn left and go north on Aldrich. Because of the size of the road and the size of the trucks nearly everyone of these trucks make an illegal turn. 0~r house is l0 feet off the road. We have a view of do~ole-deckers going by with boats and houses on them. We were treated to the circus which went by. The pattern is such that if you were to have the additional attraction of horses here "Look Daddy, at the horses~' it would be a very hazardous situation. There have been innumerable accidents on this road. We have witnessed two fatal accidents. We have the prospect of Laurel Elementary School 300 feet to the east of this location. As the "moth to the flame", the kid to the horse. He is going to get to that horse. In thinking the whole situation over we feel that knowing the hazar~ exists now and recognizing the potential da ~ of this road as it ~ n~, we would be morally responsible if we did not speak out this evening. Southold Town Board of Appeals -20- July 13, 1972 THE CHAIR~N~i We have a report from the Police Department relative ~o the number of accidents which have occurred in grids 25-199 and 26-200 which covers the area you refer to. They in- dicate a total number of accidents in Grid 25 of 31; 27 accidents in Grid 26; a total of 58 accidents. These are not broken down as to fatalities. There have been 58 accidents on curves in five years. MR. R. W. EUE~TER: I own property on the opposite side of the road. I am concerned the same as Dr. McNamara about this thing because I plan to retire here next yeam. Z have owned it for 20 years. Passing that other place in Aquebogue, I can recall a carnival atmosphere. JANE M!LL~: Not when ! had it. That was before I took it over. Where is the riding going to be done? THE CH~IRI~kN: (addressing Miss Mills) Would you want to elaborate on where the riding would be done? J~A3~ MILLS: (indicated on the F.~p where the trails would be). Jumping would be done behind the wooded area. MR. ED'E~ST==R: Wh~ does the Town go to the expense of having Raymond & May draw up a plan and specifically designate this area - ~ to be R~sidential and Agrzcultural. THE CHkIRM~N: This type of use is generally handled by special exception. There are fourteen or fifteen different guide line~ which the Board of Appeals is required to consider before granting. In effect, what it means is that this is a permitted use provided the Board of Appeals finds the applicant stays within the guide lines. ME. K~E~TER: May I say something else? I have an accident history showing the exact location of each accident east and west of Aldrich Lane, the number of feet east and the number of feet west. .it was drawn up by'the Department of Transportation, The State Hi~hway Department. I would like to make that part of the record. I believe the Town has a copy of this. THE CHAIR!~N: N~y we make a copy of the report? MR. EUESTER: Ye~. Does this academy have to be on the Main Road? J~NE MILLS: It does not have to be on the Main Road pro- viding I can find a piece which would be comparable in price. MR. S~L~ND: The price is $5,000 an acre. HOWARD TERRY, Building Inspector: In 1957. The new Ordinance cut it back to 200 feet. There had been operating businesses there.., a plumbing shop, a sand pit, a potato grading house. It's now an Industrial use. It used to be Heavy Business use. It gees from Aldrich Lane west. It includes McNamara~s property, the restaurant, the old store, etc. MR. EUESTER: That will take 600 feet of our land. Are we in for dust storms en our side of the road? TEE CHA.IR~N: (addressing Miss Mills) Do you have provisions for handling dust? J~ANE MILL~: You make sure you have a base that doesn't dust up and wet down the ring. MR~ EUESTER: The cars continue zooming through that turn. I can't come out of m~ driveway any' more. We are going to have a problem. MISS MILLS: I would probably put up a white post and rail fence around there. Part of the problem with that bend is that there is nothing on it. There is nothing to arrest attention. DR. Mc~F.~URA~: I believe there are about four signs. THE CHAIRMA_N: Does anyone else wish to speak against this application? MR. E. LUNSTEDT, Main Road: I live about a quarter of a mile east and agree with the previous speakers. I point out the hazard, as a father with two children, of the school being so close. On the Main Road at this location it would be an attractive nuisance. Further down the street there is a cemetery bordering on it. At this curve, west to east, people would have to cross over a double line or make a U-turn where already there is a tremendous hazard. The barn is close to the F~in Road and the entrance faces the Main Road. MR. GEORGE McCARTITf: I am a property owner and I just came here for information, i, too, am concerned about traffic hazards. We have had at least one more fatality and this was in m~ drive- way. The person hit a tree. It is very hazardous. It is death row. Everyone knows it. I don~t think there is a place in Southold T~n that has any worse conditions. Z love horses and I own a horse so I am not against horses but i do believe that 15 horses on that turn is beyond belief. ENESTER: What guarantee have we that this riding acade~ will remain a riding academ~? What happens if it is sold? It is then open for ether uses. THE CHAIRM~N: We can't project the future. That would be up to the owner. MR. EDVE~TER: It would seem that 15 horses are not going to pay for $5,000 an acre. THE Ci~IRN~: This Board is empowered to impose conditions and conditions would, have to be taken into account, tf we imposed a 15 horse limit and there were more the operation could be closed down, as we have closed one down on ORegon Road. That was done pa~tlally by a rehearing of this Beard at which time we withdrew permission. If this permission were granted it would be subject to conditions. MR. ~S~: I think the traffic situation has no bearing on this because if an owner decided to put a restaurant there, it is Business zoned, y~ w~ld have a much greater hazard if you had greater parking. If the problem is parking, you could come around &ldrich Lane (indicating sketch) and put the parking here. There is access. The objection is because ef horses. My feeling is that if it's a good operation then I think it's to the benefit of the Town and will solve all the problems everyone is concerned about as far as density and schools are concerned. It would be a nice resort area feeling. If it's not going to be a geed operation then it sh~ld be killed. THE CHAIRMAN: What you have said is pertinent.
