The Planning Board has found that the parking for this application may be relaxed for the following reasons: The additional improved office space on the lower level being contemplated in this site plan amendment has existed since 1986, and no adverse conditions related to the quantity of parking have been noted; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131H has the discretion to waive the public hearing requirement for applications involving modification to existing structures with no substantial change to the existing footprint, that the modification will not require significant changes to the existing site design features. The Planning Board has found that the public hearing for this application may be waived for the following reasons: That this is an existing site that had previously been before the Board for a related site plan application approved on February 10, 1986. The uses on site have not changed; it has been determined that the overall proposal would not have an adverse effect to surrounding properties; and WHEREAS, the Southold Town Planning Board, pursuant to §280~133 C. of the Southold Town Code, has the discretion to waive any or all of the requirements in §280- 133 for those applications involving modifications to existing structures with no substantial change to the existing footprint. The Planning Board has found that requiring the entire set of site plan application requirements for this site is not necessary to further the objectives set forth in Town Code §280-129 and maintain public health, safety, and welfare for the following reasons: the application is for an amended site plan previously approved by the Board, and the parcel has been used in the same configuration as previously reviewed and approved; therefore, be it RESOLVED, that the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) (6 NYCRR, Part 617.5 (c) (3), has determined that the proposed action is a Type II Action, and not subject to review under SEQR; and be it further RESOLVED, that the Southold Town Planning Board hereby waives the requirement for additional parking, the public hearing requirement, and site plan application requirements, except for the following items: §280-133 A. (1)(2), (3) B. (1)(a), (b), (c), (d), (g), (3)(a),(b),(c partial), (4) (a),(b),(e- partial),(f), (g-partial), (h), and (i); and be it further RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under the policies of the Town of Southold Local Waterfront Revitalization Program and determined that the action is consistent as outlined in the August 11,2008 memo prepared by the LWRP Coordinator; and be it further RESOLVED, that the Southold Town Planning Board grants approval, and authorizes the Chairperson to endorse the site plan entitled "Celic Center" prepared by Roderick Van Tuyl, P.C., Land Surveyor, dated December 9, 1987. Celic Center Page Three August 12, 2008 Please also note the following required by Town Code: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Approved site plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless an extension is granted by the Planning Board. 4. Any changes from the approved site plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the approved site plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the approved site plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. Copies of the approved site plan are enclosed for your records. One copy will also be sent to the Building Department and the Town Engineer/Highway Department. All of these improvements wer% existing at the time Mr. Lessar , the Building Inspector, made the final inspection and issued the Certificate of Occupancy. The parking calculations for the project as originally approved by the Planning Board are on the original map which we previously forwarded to you. The Building Department inspected the premises recently with the engineer. In addition, we have a Notice of Disapproval from the Building Department, which is in your file. The Building Department did not require any exterior alterations during its inspection or in the Notice of Disapproval. These improvements have been in existence since the CO was issued, and it has just come to light that the Building Department did not make a note of the changes to the premises in issuing its CO for the building. We are merely seeking to clean up the paperwork, and it was Supervisor Russell's suggestion to Mr. Celic that he proceed through the Building Department/Planning process, but he did not see it as a major problem. The Planning Department has determined that further information is necessary for the review of your site plan application to continue based on the following reasons stated below. The addition in question was approved for having only one floor (upper level). The plans submitted for review indicate a lower level being utilized for office use. Please show parking calculations for proposed and existing uses on site as part of the amended site plan. It would appear that the area being used for office space in the lower portion of the addition might not meet the requirements of the New York State Building Code. We recommend you meet with the Building Department to determine whether any exterior alterations that might affect the site plan would be required. Celic Center ~.~ 10200 Main Road, Mattituck, New York 119.,.- ~" SCTM#: 1000-143-3-1 Dear Bruno: In 1986, Mr. Celic constructed an addition to his real estate center at Mattituck, and received site plan approval from the Planning Board and a Certificate of Occupancy from the Building Department. During the course of construction, a portion of the lower level was modified to include conference rooms and work space. Mr. Lessard made the final inspection of the work, and reviewed the lower level improvements. He ordered several changes made, including exit lighting and installation ora fire extinguisher. He then approved the construction and issued the Certificate of Occupancy. It was not until recently that Mr. Celic learned that no mention of the lower level improvements was in the Building Department file, and the current Building Inspector will not recognize the improvements. Therefore, a Notice of Disapproval for site plan application was issued, and we seek an amendment/clarification of the site plan. Nothing has changed on the premises for the past 20 years, so we ask that the Board recognize the current site plan as adequate for the entire premises including the lower level. 2. 3. 4. 5. 6.
