along the arc of a curve bearing to the right having a radius of 170.00 feet a distance of 142.98 feet to land
now or formerly of Klapper and Edson; RUNNING THENCE along land now or formerly of Klapper
and Edson South 47 degrees 08 minutes 10 seconds West 219.57 feet to land now or formerly of Bergani;
RUNNING THENCE along land now or formerly of Bergani Spicer, Broach and Carol North 44 degrees
12 minutes 00 seconds West 348.82 feet to land now or formerly of Abbate; RUNNING THENCE along
land now or formerly of Abbate North 47 degrees 08 minutes 10 seconds East 142.70 feet to the point or

BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 5/16/01and recorded 6/5/01 in Liber 12122 page 32.
This conveyance has been made with the unanimous consent in writing of all the shareholders of the
party of the first part and does not render the grantor insolvent , . ,,
~OGETHER with all right, title and interest, if any, of the parW of the first part ~n and to any streets and
roads abusing the above described premises to the center lines thereof: TOGETHER with the
appu~enances and all the estate and rights of the par~ of the first pa~ in and to said premises; TO

successors and assigns of the par~ of the second pa~ forever.
AND the parW of the first pa~ covenants that the pa~ of the first paa has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the pa~ of the ~st pa~, in compliance with Section 13 of the Lien Law, covenants that the pa~
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust ~nd to be applied first for the purpose of paying the cost of the improvement and
will apply the same f~st to the payment of the cost of the improvement before using any pan of the total
of the same for any other purpose.
