THE C~.* Actually, the ~ew building will be further away
from the line than the existing shed is.
THE OBAXRI~N: Is the~e anyone p~esent who wishes to speak
against this application?
(There was no response.)
After investigation and inspection the Board finds that
applicant requests pex~nission to replace existing accessory building
with an enlarged tr~ildtng and reduced side yard om property located
on .the south side of Island View Lane, Greenport, New York. The
findings of the Board a~e that applicant has an unusual hardship
because of tidal d~ains. The Board agrees with the reasoning of
the-applicant as his legal rea~ yard is subject to flooding.
The B~ard finds that strict application of the O~dinance
would, produce p~actical difficulties or unnecessary hardship; the
hardship created is unique and would not be shared by all properties
alike in the immediate vicinity of this property and in the sac_me_
use district; and the variance will not change the character of
~ae neighborhood, and will observe the spirit of the O~dinance.

want a porch, you have to go back 10 feet. If you want a porch on
the side we will have to put a limit on it.

I~R. FREYHERR= Itts 60 feet to the big tree and the garage is
7 or 8 feet beyond that. If I go back 15 feet the windows at the
extren~ back would go beyomd the garage. 15 feet wcutdbe satisfactory.
THE C~IRMAN~ I don~t think you weuld want a porch on the front.

After investigation and ~nspection the Board finds ~hat applicant
~equests permission to construct dwelling with insufficient living a~ea
and side yard on l~emises located on the westside of Third ~t~eet,
New~Affoik, New YOrk. The Board finds that ho~s in the immediate
area are on simila~ size. plots of land and a~e less than 850 sq. ft.
in size; that the new dwelling will be oceupisd by applicantte mother;
that the size of the Bedrooms planned by applicant meets requirements
of the Town. Tho Boa~d recognizes a pre-existing situation and agrees
with the reasoning of the applicant.
The Boa~d finds that strict application of the Ordinance would
produce, practical difficulties ir unnecessary ha~dship; the hardship
