Mullen, Jr. Member G. Ritchie Latham, Jr. Member Richard Ward Town Planner Valerie Scopaz Executive Administrator Victor Lessard Secretary Diane M. Schultze Absent: Kenneth Edwards - leaving for Germany on vacation. ~:30 p.m. Public hearing on the question of approval of the final maps for the major subdivision of Edward and Charles Nalbantian, to be known as "Oregon Heights" located at Mattituck. 6 lots on 12 acres, SCTM2~i~ 1000-99-3-12; 1000-100-1-21.1; 1000-99-3-21. Mr. Orlowski: Good EvenSng, I would,tike to call this meeting to order. The firsttord~r of business is a public hearing on the question ~f approval of the final maps for the major subdivision of Edward and Charles Nalbantian to be known as "Oregon Heights" located at Mattituck. Everything is in order in the file. WS have p~Qof of publication inthe Suffolk Times~ signed by Christina Contento and notorized by Mary Deegnan. We have proof of publication in the Lon~ Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes. As I said, everything at this time is in order. Mr. William A~.Sulahian: I would like the record to reflect that I appeared for the p~titioners or applicants. My name is William A. Sulahian. I am an attorney and appear for the petitioners. Scopaz, ~one. Being no further questins, I will declare this hearing closed and th~nk you for coming. Mr. Sulahian~ Mr. Chairman, ma~ I just clarify one point. I don~t know if the record reflects it but I understand Mr Edward Nalbantian has been incontact with the BQard or with the secretary, Miss Schultze, about the bond, performance bond, which ~st~he subject matter of your letter of September 11, 1987 and has made arraugements initieu of the bond to post an actual letter of credit. Has worked that our with Mr. Rober An~ig of the North Fork Bank and that should be in place at the appropriate time. Mr. Orl~wski: That is fine. We will take a letter of credit any day. That or cash.in a bankbook~ Mr. Sulahian: Thank you gentlemen,. (see below for further discussion) ON a motion made by Mr. Latham, seconded by Mr. Mullen, it ~was RESOLVED that theeSouthold~Town Planning BQard set Monday, October 19, 1987 at the Southold Town Hall,Main Road, Southold, at 7:30 p.m. as the time and p~&ce for the next regular Planning Baard meeting. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen,~seconded by Mr. Ward, it was RESOLVED that the Southold T~n Planning Baard accept the minutes of the reguiar meeting of Septemer 14, 1987. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Nalbantian~ - Mr. Ward brought up further ~iscussin on this subdivision which was the matter of a public hearing. He questioned the items requi~d by the Highway Superintendent; specifically if ~urbs and drainage had been requested. It wa~ noted that the Highway Superintendent requested drainage which had been indicated on the bond estimate. It was also stated that t~i~ subdivision should be referred to th~ Fire Commissioners if has not already been for location of a fire well.if needed in t~is area. Vervenoitis/P~evritis - SCTM ~ 1000-54-3-21.1. The Bsard reviewed this proposal at Horton's Lane and Old North Rd., Southold Planning Board Page 3 9/28/87 ~ernenoitis, cont. It was noted that hhe previous sketch plan approval had expired while the~applicant was pursuing Article 6 ~pproval with the County HealthDDepartment. In review of the file, the first sketch approval was issued int1983 and re-affirmed again in 1986. Mr. Ward suggested that this proposal be clustered with the houses off the corner. It was felt that since the proposal was before the Board previously and the lots were large, 4 lots~on 12 acres, that they would agree to the present proposedc[layout with~a Stipulation that the driveways ~or the lots be situated away from the intersection of Old North Road and Horton's Lane, and~the appropriate land be taken at that corner for highway purposes to facilitate better alignment. On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold T~wn Planning Board approve the sketch m~p for~the minor subdivision of Vervenoitis, Plevritis, and Yianourakis located~at Southold, SCTM ~000-54-3-21, survey dated as amended Marchgl9, 1987; for 4 tots on 12 acres; subject~to: 1. The driveway~.~on Lot ~4 shall be situated as far f~om the intersection of Old North Road and Horton's Lane as possible for traffic safety. 2. That ak~arge radius curve at the intersection of Old North Ro~d and Horton's Lane be provided for d~di~ation %o the Town for Highway Purposes to facilitate better alignment of the interseCtion. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward ON a motion made by Mr. Ward, seconded ~y Mr. Mullen,it was RESOLVED that the Southold Town Planni~g~Board authorize the Chairman to endo~es-~th~csurveys for the minor subdivison known as Cranberry Acres, SCTM 9 1000-89-4-1,2,3,4; survey dated as amended December 31, 1985. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Harbor Light, Section 4 - SCTM ~ 1000-79-4-17.1 - 17.9. The Board reviewed this subdiviSion and letter of credit which is due to expire onOOctober~31, 1987. It was noted that due to the fact ~hat some of the work required ~n the bond estimate was not complied with some corrective work as per the Engineering Consultants would be neeessary. Ms. Scopaz stated that it should be brought to the attention of Mr. Reese, the developer that the letter o~ credit is to include Planning Board Page 4 9/28/87 this correcti~e%~.~kk. On a motion made by Mr. Mul~en, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board recommend to the Town Board thatathe letter of credit for Harbor Lights, Section 4 be extended for a one-year period to expire on October 1, 1988. SCTM ~ 1000-~9-4-17.1 - 17.9 Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a m~tion made by Mr. Mullen, seconded by Mrr Latham, it was RESOLVED that the Southold Town Planning Board, following a field iRspection, recommendato the Building Department that a certificate of occupancy be issued for the site plan for Gary Flanner Olsen located at Cutchogue, SCTM ~ 1000-97-5-4.4, subject to a ~ne-year review. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Mullen, seconded by Mr. La~h~m, it was RESOLVED that the Southold Town Planning Board, followingaa field,inspection, recommend totthe Building Department that a Certificate of occupancy be issued forrthe site plan of Mattituck HOlding Co., looated~at Mattituck, SCTM 9 1~00-~06-6-p/o 13.3 subject to a one-year review. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward NOrth Fork County Cl~ub - Mr. Lessard questioned if the Bsard had re-inspected this site plan at Main Roa~, Cutchogue. It was noted that the Board had previously inspected this site and conditioned the recommendation©~n an additional 6~ review. Mr. Orlowski stated that he had been at the site, however, asked Mr. Lessa~d if he would advise the Board when ~he rem&ining improvements have been complied with for an additional inspection. Mr. Lessard stated that he would, witht~he Planner, Ms. Scopaz. Pudge Corp. - The Board reviewed this revised site p~&n for min~-storage buildings at Horton's Lane, Southold. Mr. William F. Mullen, Jr. abstained from any discussion since the applicant was a client of his. The Board noted that the revised plan is a~l in order. On a motion made by Mr. Latham, seconded by Mr. Ward, it was Planning Board Page 5 9/28/87 RESOLVED that the Southold ~own Planning Board approve the site plan of James Grey, known as "Pudge Corp." for construction of five (5) mini-storage buildings located at Horton's Lane, South~d, $CTM~ 1000-63-1-p/o~10, survey dated as amended September 1, 1987 subject to: 1. Bn~irevisions or modifications to the drainage as m~y be recommended by the Town ~ngine~ring Consultant. 2. A fire hydrant which may be reque~t~d~ the $o~ho~dS~be District. 3. S~reet trees to be plan~d ~here noted with a 2½" - 3" minimum ca~p~ ~ ~ as per the Town Highway SpeCifications. 4.--All conditions of Board of Appe&~s approval of Sept. 10, 1987 Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, ~t was RESOLVED that the Southold Town Planning Board grant sketch plan approval to the m~nor subdivision of Eugene and Juliana Davison located at Laurel, to beeknown as "Strawberry Fields", SCT~ 1000-121-3-5; for 4 lots on 12 acres; survey dated 1/7/86. Vote of the' Board: Ayes: Orlowski, Mullen, Latham, Ward 8n a motion made by ~r. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board set Monday, October 19, 1987 at 7:30 p.m. at the Southold T~n Hall, Main Road, Southold, NY 11971 as the time and place for a public hearing on the question of approval of the minor subdivision for Eugene and Juliana Davison located at Mattituck, SCTM 9 1000-12~-3-5. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion~made by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board g~ant a six-month extension on filing the final'subdivision mapffor the minor sDbdivision of Petrol Stations located at Cutchogue, SCTM ~ 1000-109-1-23. Said extension is pursuant to the request of the attorney for theaapplicant in order that Article 6 approval ~ay be pursued, and will expire on March 28, 1897. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward Planning Board Page 6 9/28/87 ~rthur Junege - The Board reviewed this change of zone proposal as per the request of hhe Town Board for recommendation. Thecchange of zone is from A to C located at County Route 48, Cutchogue, SCTM # 1000-96-1-19. The Town Planner recommended that the applicant be asked toccome to the next Planning Board meeting in order to explain the use proposed for the site and the reason for the request for thec~2~ge of zone. Th~ Board agreed that this would be a good procedure and suggested that this procedure be established for all proposals for change of zone prior to recommendations to the Town Board. It was the consensus that Mr. Junge will be ~ontacted to attend the next regular Planning Board meeting to explain his propesal. Raeburn/M~rphy - The Board reviewed this minor subdivision located at Cutchogue, SCTM ~ 1000-73-2-2,3. It was noted that the Town Attorney, Francis Yakaboski, had been in contact with teh attorney formMrs. Beckyy~ohnston, Mr. Michael Hall. Mr. Hall stated that he had received a signed agreement for right-of-way over land of Bokina for M~s. Johnston so that there was legal access to that lot and the parcel would not be landloeked. Based upon%this information, Mr. Yakaboski recommended that the Board proceed with endorsement of the approved m~n~r subdivision map as submitted since access would not have to be india~ed on this sur~ey to the Johnston lot. Mr. Yakaboski a~o recommended that the Board override any previous conditions which stated that access would have to be p~ovided over the Raeburn/ Murphy subdivision for access to teh Johnston lot. Onaa motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board override and rescind the previous ~lu~0n~o~app~at~~ subdi~is~d ~aRaeb~n~Mh~phy dated November 14, t9~9 which conditioned approval upon extending the right of way 150' to the adjoining property to the east. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward On a motion made by mr.
