HomeMy WebLinkAboutPB-09/14/1987Southold, N.Y. 11971 (516) 765-1938 PLANNING BOARD MINUTES The Southold Town Planning Board held a regular meeting on Monday, September 14, 1987 at the Southcld Town Hall, Main Road, Southold, NY 11971, at 7:30 p.m. Present were: Chairman Bennett Orlowki, Jr. Member William F. Mullen, Jr. Member G. Ritchie Latham, Jr. Member Richard G. Ward Member Kenneth Edwards Town.~tanner Valerie Scopaz Executive Administrator Victor Lessard Secretary Diane M. Schultze Helen~ and Stanley Simchick - SCTM ~ 1000-101~t~19. Mr. Richard Lark, ESQ. as a~torney for the applicants was present. Mr. and Mrs. STanley Simchick, applicants, were also present. · ~e Chairman abstained from any discussion with regard to this proposal since he was related to the applicants. A public hearing was held on this minor subdivision for 4 lots on 20 acres at Alvah' Lane and County Route 48, Cutchogue. It was noted that the Suffolk County Planning Commission reviewed this proposal and denied it. Mr. Ward, acting Chairman for this review, stated that they Board was basically in favor of this proposal with covenants and restrictions that any further subdivision on the large lot would be a majo~ subdivision. Mr. Ward explained that the Board had previously discussed with the applicant relocating the lots and the~:.applicant was not willing to de so. Mr. Ward~:stated that the Board would have to override the County if they chose to accept the proposal as it was. On a motion made by Mr. Edwards, seconed by Mr. Latham, it was RESOLVED that the Southold Town Planning Board override the resolution of the Suffolk County Planning COmmission with regard to the minor subdivision of Helen and Stanley Simchick located at Cutchogue. Vote of the Board: Ayes: Mullen, Latham, Ward, Edwards Abstained: Orlowski Planning Board Page 2 9~14/87 The County Planning Commission~was overridden with a majority plus one vote of the Board. Mr. Lark questioned the resolution of the Board and the Board clarified that they overrode the County Plannning Co~ission. The Board also reviewed the memorandum of the Town Planner and were in favor of the recommendations presented in it. The felt they could grant approval to the subdivision with the recommendations as conditions to the approval. On a motion m~de by Mr. Mullen, seconded by Mr. Latham, it was RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled "STanley Simchick" located at Southold was submitted tothe Planning Board on May 20, 1986, and a filing fee was paid, and WHEREAS, a public hearing was held on said subdivisio application and plat~at the Southold Twon Hall, Southold, New York, on August 24, 1987 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision REgulations of~the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be itRESOLVED that the applicaion of Stanley~._ $imchick for approval of said subdivision plat prepared by Rod Van Tuyl of April 3, 1987, be approved and the Chairman be authorized to endorse approval on said subdivision plat, subject~tO: 1. Access driveway to Lot 3 shall be from Alvah's Lane only. The access driveway to LOt 3 shall be located at least 150' north of the point where alvah's Lane meets County Route 48. Condition shall be filed as Covenants and Restrictions on property deed. 2. Ail driveways for Lots 2,3, and 4 shall be T-shaped so as to prevewnt the need to ba~k a vehicle out of the d~iveway. Circular d~iveways with two access points to public streets shall also be prohibited, for traffic safety reasons. 3. A covenant and Restriction shall be filed with Lot ~1 prohibiting further subdivision of the property except as a major subdivision. Vote of the Board: Ayes: Mullen, La,ham, Ward, Edwards Abstained: Orlowski Mr. Lark stated that~he wished to discuss the ~eso~ution passed by the Board with his client and he would approach the Board later in the meeting should their be a problem with it. Vote of the Board: Ayes: Gr~wski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Edwards, seconded by Mr. Latham, it was RESOLVED that whereas, a formal applicationf or the approval of a subdivision plat entitled "David Wilmerding~ _located at Fishers Island, SCTM 9 1000-9-9-2,3, was submitted to the Planning Board on February 3, 1987 and filing fee was paidn, and WHEREAS, a public hearing was held on said subdivision application and plat at the Southold Town Hall, South~td, New York, on August 24, 1987 at 7:45 p.m., and WHEREAS, the requirements of the Subdivision REgulation of the town of Southold have been met by said subdivision plat and appicant, NOW, Therefore, be it RESOLVED that the application of David Wilmerdinq for approval of said subdivisionplat prepared by Chandler, Plamer, and King, dated as amended August227, 1987 be approved and the Chairman be authorized tO endorse approval on said ~ubdivision plat. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. La,ham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board set Monday, September 28, 1987 at the Southold Twon Hall, Main Road Southold at 7:30 p.m. as the time and place for the next ~egu~ar.~Planning Board meeting. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a~motion made by Mr. Mullen, seconed by Mr. Latham, it was RESOLVED that the Southcld Town Planning Board approve the minutes of the regular meeting of August 24, 1987. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward Planming Board Page ~ 9/14/87 On a motion made by Mr. Ward, seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the mino~ subdivision of Winds Way Building Corp. located at New Suffolk Avenue, Cutchogue, SCTM 9 1000-116-1-1. Said subdivision was approved by a resolutin of the Planning Board and the conditions satisfied. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motio~n made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the South~ld Town Planning Board authorize the Chairman to endorse the minor subdivision (set off) of Albin Pietrewicz located at County Route 48 and Alvah's Lane at Cutchogue, SCTM ~ 1000-84-1-26. This subdivision had been approved by a resolutin of the Board. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion m~de by Mr. Ward, seconded by Mr. Mullen, following action?Jwas taken: NEGATIVE DECLARATION Pursuant to Article 8 of the ENvironmental Conservation Law State ENvironmental Quality Review Act and 6N~CRR Part 617, Section 617.10 and Chapter 44 of the Code of the Town of Southold, notice ~s hereby given that the Southold Town Planning Board as lead agency for the action described below has determined that the project will not have a significant effect on the environment. Description of action ; The minor subdivision of Plum Gut Properties is located at Main Road, Orient for 4 lots.~on 15 acres, tax map no . 10~0-18~9.1. The~project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse ~ffec~s to the environment were likely to occur should the project be implemented as planned. Because ther has been no correspondence from the Suffolk County Department of Health Services in the<~alloted time, it is assumed that there are no comments or objections from that agency. Edwards, it was RESOLVED that the Southold T~wn Planning Board authorize the Chairman to endorse the set off for Louise O. Day, located at Indian Neck Lane, Peconic, SCTM ~ 1000-84-1-26. This subddivision has been approved by a resolutionfof the Board and the conditions of same have been satisfied. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning accept the final inspection report for the Engineering Consultants, dated August 25, 1987 with regard to the access road and approval of same for the minor subdivision of Robert and Jean Lenzner. SCTM 9 1000- 94-3-1.1 Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a~otion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board accept the final i~spection ~eport from the Engineering Consultants, dated August 25, 1987, with regard to the access road and approval of same for the minor subdivision of Richard and Sophia Greenfield, known as "Cabot's Woods". SCTM ~ 1000-73-4-2 Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded by Mr. Edwards, it was RESOLVED that the Southold Town Planning Board accept the final inspection report from the E~gineering Consultants, memorandum from Inspector Raymond Dean, dated September 14, 1987, with regard to the access ~oad and approval of same for the minor subdivision of Elizabeth Thompson, to be Planning BQard Page 6 9/14/87 known a~ "Kings Bay Partners" located at Orient, SCTM ~ 1000- 27-3-4 Vote of the Board: Ayes: orlowski,Mullen, Latham, Edwards, Ward On~a motion made by Mr. Edwards, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the site plan for Tidy Car, SCTM # 1000-55-5-2.2, for construction of an addition on an existing car service building located at County Route 48 and Young's Avenue, Southold, site plan dated as amended September 11, 1987, subject to the following conditions: 1. Handicapped parking shall be clearly marked on signs with blue striping as per NYS law. e The curb cut on County Rotue 48 shall be marked so as to prevent vehicluar access to County Ro~d~ 48 from the ~ite. 3. Subject to any changes in the drainage that may be requested as per the~Town Engineer~ e Subject to the planting of street trees as per Highway Specifications~-~to be located between 10 and 15' inside the existing curb line. It was also noted thatt~his site plan was certified by the Building Department. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. Latham, seconded byMr. Edwards, it was RESOLVED that the Southold Town Planning Board recommend to the Town Board that the performance bond for the major subdivision known as Sebastian's Cove, located at Mattituck, be released based upon the correspondence of the Engineering Consultant and the Higway Superintendent, R~ymQ~d~'~L. Jacobs. S~TM 9 1000~100-3-P/© 11 Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward Pindar Site Plan - SCTM 9 1000-85-2-15. The Board reviewed this site p~an following a field inspection for recommendation to the Building Department on an issuance of a Certificate of Occupancy. Maureen of Pindar Vineyards at Peconic was present for~3the Board's discussion. The Board outlined the items of the plan that still needed compliance% They were: Planning Board Page 7 9/I4/87 Line~ the southerly parking stalls in the parking area, adding the landscaping as called for info,he front of the building. Maureen explained that they cou~di~have a problem with~he~tandscaping ink.the front~of the building since there.~.is drainage there. The Board Stated that this needed to be done and if any modifications were contemplated they should.have been brought to the Board one, an amended site plan. The Board agreed that the certificate of occupancy should not be issued ~ntil the site complied with the approved site plan. On a motion made by ~r. Latham, seconded by Mr. Mullen, it was RESOLVED thattthe Southold Twon Planning Board, following~a field inspection, recommend to the Building Department that a certificate of occupancy be issued for the site plan o£ Pindar Vineyards; subject to the following: 1. Parking and landscaping to be installed as per the approved site plan. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr~Latham, seconded by Mr. Mullen, it was RESOLYED that the Southold Town Planning Board accept the bond estimate prepared for the major subdivision of Edward and Charles Nalbantian, to be known as "Oregon Heights~, located at Mattituck, SCTM ~ 1000-1001-12.1 and 1000-99-3-1~2 as prepared by the Engineering Consultants. Bond estimate in the amount of $25,431 including inspection fee. This estimate to be recommended to the Town Board for acceptance. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards~ Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board set Monday, September 28, 1987 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold as the time and place for a public hearing on the question%~0f.~approval of the~.~in~l maps of the~maj.or subdivison of Edwards and Charles Nalbantian to be know~ as "Oregon Heights", located at Mattituck, SCTM ~ 1000-101-1-2.1 and 1000-99-3-1.2 Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward Planning Board Page 8 9/14/87 Helene and Stanley Simchick - At this point in the meeting, Mr. Lark approached the Board to discuss the Board's conditional resolution of final approval. Mr. Simchick approach~d~he Board as well. Mr. Simchick explained that Lot ~2 was for his own home, Lot ~3 was for his daughter and Lot ~4 was for a friend. He also stated that Lot 91 may be sold as a horse farm and a condition that any further subdivision would have to be considered a major subdivision would encourage someon~to develope it into many lots. Mr. Simchick asked that the Board re-consider this condition because he felt that it was just inviting trouble. Mr. Ward explained that when any subdivison of that lot, even one addition lot, is presented to ths County Health Department, they would require that it be treated as~a3~major because they consider the proposed 4 lots as a minor and any further lot~would be added to that number. Therefore, the Planning Board was just corrdinating so that any further subdivision wiould be recognized as a major by all~parties havin~approval jurisdiction. Mr. Simchi~k stated that he understood this and agreed to the condition. On~a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that~he Southold Town Planing Board authorize the Secretary to coordinate under the State Environmental Quality Review Act for.~the ma]or subdivisions~6f AngelShores, Sections I and II, located at Southold, SCTM # 1000-88+6-1 and 1000-88-6-4,5. The Planning Board would like to assume lead agency. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Edwards, Ward On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planing Board set the following policy with rgga~d to the submission of minor and ma~or subdivisions: A sketch plan submission to the Board mn~ include the preliminary application and application filing fee prior to review by the staff or Board, due to the increase in applications,~invol~ement of engineering consultant in review and time consumed for adequate review by staff and Board.
