Present were: Chairman Benentt Orlowski, Jr. Member William F. Mullen,Jr. Member G. Rithie~.Latham, Jr. Membe~ Kenneth Edwards Member Richard G. Schultze 7:30 p.m. Public hearing on the question~of approval of the minor subdivision of Stanlye and Helen Simchick located at County Route 48, and Alvah's Lane, Cutchogue, SCTM ~ 1000-101-1-19. Mr. Orlowski: Good evening. I wo~d like to call this meeting to order. The first order of business is a~public hearing on the question of approval of the minor subdivision of Stanley and Helen Sim~hick located at County Route 48 and Alvah's Lane, Cutchogue. We have proof of pubication in the Suffolk Times, signed by Gerry Pagliano and notorized by Mary Deegnan, we have proof of publication in the Long Island T~aveler Watchman signed by Pat Woods and notorized by Barbara Forbes. At this time, everything is in order for a hearing, t~.will stated that I am a relative of the applicant and I will abstain from any comment in this hearing process. I will ask if there are any objections to this minor subdivision? Hearing none. A~e there any3e~dorsements of this minor subdivision? Mr. Lark: Richard Lark, Main Road, Cutchogue, Suffolk. I represent both Mr. and Mrs. Simchick who are here tonight to answer any quesions of the Board. I think any questions that the Board had before, we have squared~away wi~h the revised map and as you can see, it has been square for the A~ticle6 process and ~ou have a map~that has been stamped. Hearing none, is there anyone out there neither pro nor con but may have information pertaining to this subdivision that may be of interest to the Board? Hearing none. Any questions from the Board, Mr. Mullen, none; Mr. Latham,none; Mr. Ward, none; Mr. Edwr~ds, none; Ms. Scopaz, none. Okay, being no further questions, I will declare this hearing closed and thank you for coming. 7:45 p.m. Public hearing on the question of approval of the minor subdivision of David ~ilmerdi~g for 4 lots on 12.79 acres at Fishers Island, SCTM ~ 1000-9~9~2and 3. Mr. Orlowski: Okay, next order of business is a public hearing on the question Off, approval of the minor subdivision of David Wilmerding for 4 lots on 12.79 acres at Fish~rs Island. W~ have proof of pubticatin in the Suffolk Times, signed by Gerry Pagliano and notorized by Mary Deegnan, we have proof of publication in the Long Island Traveler Watchman signed by Pat Woods and notorized by Barbara Forbes, we have proof of p~lication in the New London Day signed by Gall Zulinsky and notarized by Beverly Prescott. A~ this time, everything is ino~rder for a public hearing and I will aksiif~there~are any obejctions hearing none, are there any endorsementsoof this s~bdivi~ion. Mr. Lark: Richard Lark, Cutchogue, for the applicant. I believe that all the comments of the Planning Board in the planning process have been taken ¢~re o~ihe~a~ious let~ers~hat have~nsued over the last couple of months have been done and this has cleared and has cleared Article 6 approval. The only remaining item of business is to address any items that it might have for the Suffolk County Planning Commission which it mad~ on April 1, 1987~rende~dosO~e comments, 3 of them to be ~ecise. The first comment indi~ateSk~a~h~y don't indicate where the property is. And, I submit to you they have not seen it nor has any membe~ of their staff seen it because the comment makes no sense when they say it is a landlocked piece. The Board~lfully well knows, who has inspected the property, that there has been existing rights-of-way to Equestrian Avenue, which is a phblic road and it terminates off site and the rights-of~way are provided for ~ith an established road, so I don't know how to address when the Planning ~ommission calls them landlocked pieces. There are four structures on each and everyone of them now. And, they have been using them for the past 30/40 hears and before that I understand there was a hotel on the property. So, I can not address tha~ other than they don't know what theycare talking about~ I have no idea what comment 2 means, if they are talking about Stony Beach, the Board's comments have been addressed on that, that is not a buildable lot that is going to be dedicated as ~understand it to the Ferguson Museum Land Trust to stay Planning Board Page 3 8/27/87 Mr. Lark: in a forever wild basis. And, negotiations with the Wilmerding family and the officials of the land trust have taken place right now. So, if that is the piece they are talking about, what they refer to on the island as Stony Beach, then that is taken care of. It is shown on the map and the Board requested that itcbe~shown not as~-a buildable parcel which of course it is now. I have no idea What they mean by comment three, because I don't know, why Resovoir Road which terminates at the property, which it does not, Mr. Edwards can tell you that was not used as access to the property. Either they have the wrong piece of property meaning the County Planning Commission or like so many instances in the Town of Southold on Long Island proper or Fishers Island they know not from whence they speak. And, I respect the Board, they do have a full quorum tonight to, in accordance with the general municple law and the. Suffotk~ounty Charter that you override the resolution with.ha majority plus one and I respectfully move that you grant an approval of this minor subdivison of four lots. Ms. Scopaz: Mr. Chairman, may I respond to one of Mr. Lark's questions. Just, you asked~..earlier, you did not know the County referred to the parcel as landlocked. The generally refer to any piece, of propert~ that~d~es not have frontage on an existing dedicated public street as landlocked. Even though you may have rights of way agueemen~s over p~iva~e'~ ~ property, if it is not a dedicated street, they consider it land locked which is probably why they said that. Mr.~ Lark: Would you agree with that assessment as good planning principals that you learned in college would you think that is~-a good~way~o.~efer to~a~piece of property. Landlocked is pretty clear both in lawman's terms and legal terms which means that there is no access to a piece of property. Ms. Scopaz: My agreement with that is not in question, I am simply stating for you what it means. Mr. Lark: Okay, thank you, that cl&rify's it. Mr. Orlowski: Okay, any other endorsements of this subdivision? Hearing none. Anyone out their neither pro nor con but with information to the Board? Hearing none. Questions from the Board? Mr. Latham, none; Mr. Mullen, none; Mr. Ward. Mr. Ward: Just the possibility of the ~ther~land as being set aside to the~land trust, it may best with the filed map here to designate it as lot No. 5 so that it can be described as part of this. Mr. Lark: I talked~to'~Chandler and Palmer who does the surveys for the Island, there are no existing metes and bounds descriptions and that is due in part to the hurricanes and stuff like that it has moved around al little so that there is none and when the Board wanted to make sure it was not, we designated as Planning Board Page 4 8/24/87 Mr. Lark: not a buildable lot on this parcel. And, quite frankly the way they intend to deed it over to the, just refer to it as it is, Stony Beach which meanders around on the 5.2 acre and shown on the survey which would be attached. On.~ the map, subdivision plan. Mr.'Ward: I just find it difficult to deed something over with out metes and bounds. Mr. Lark: Oh, it is done all the time, especially with the old deeds because we know What it is bounded by. But, that is how it was done, because I Checked on that, there~'~are no existing surveys of that anywhere. So, they have plotted it basically from the aerials, the current aerials that they have, to answer~you question and I don't know if i~i~iis~a~satisfactory answer or not, but there is none. Mr. Orlowski: Mr. Edwards, comment? (none) Ms. Scopaz (I hve nothing to add). Okay, beingno further comments, I will declare this hearing closed ahd thank you for coming dOwn. On a motion made by Mr. Ward, seconded by Mr. La~ham~ , it was RESOLVED THAT THE Soutold Town Planning Board approve the minutes<~of the regular Planning Board meeting of August 10, 1987. Vote of the Board~ Ayes: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Mullen,'seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to end0~se..the minor subdivision map for Richard and Anita Wilton located at Greenport. Latham, it was RESOLVED that the Southold Town Plan~ning Board a~thorize the Chairman to endorse the site plan survey for Thompson, Irwin.~ and sandra, located at Main Road, Southotd, SCTM # 1000-63-3-8. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Latham, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the site plan survey for Southld Square ~hoDDes located at Southold, SCTM ~ 1~0.0.~55-5~~ Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards Planning Board Page.5 8/24/87 On a motion made by Mr. Mullen, seconded by Mr. Ward, it was RESOLVED that the Southold Town Planning Board authorize Chairman to endorse the final maps for the major subdivision of Reydon Court located at Southold, S~TM ~ 1000-79-5-16. Miska located at Mattituck, SCTM ~ 1000'115~8.1 Vote of the Board: Ayes~ Orlowski, Mullen, Latham, Ward, Edwards ~n a motion made ~y Mr. Ward, seconded by Mr. Multen, it was ~SOLVED that the Southold Town Planning Board authorize the Chai~an to endorse the final maps for the'site plan for The Cove, located at Southold, SCTM ~ 1000~87-5-20. Vote of the Board: A~gs: Orlowski, Mullen, Latham, Ward, Edwards On a mot~n made by Mr. Ward, seconded by Mr. Mullen, the following action was taken: WHEREAS, ON December ~, 1985, the Southold Twon Planning Board adopted the Land Us~ Plan which amended the original plan in certain aspects and whereas the Planning Board is now ~esirous of adopting the document entitled Master Plan Update Summary, with certain amendments as f~llows: 1. Beginning one,page 15, eliminate the section entitled Alternate Airport Sites ~continuing to page 16. 2. On page 16, eliminate the section entitled East Marion Northerly Road. Now, therefore, be it RESOLVED that the Planning Board adopt said Master Plan Update<iSummary and cause the amendments to be made to its official copy. Vote of the Board: Ayes: Orlowski,Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconed by Mr. ~atham, it was RESOS~ED that th~ Southold TOwn Planning Board, following a a field inspection, recommend to the Building Department that a certificate of occupancy be issued to the site of Planning Board Page 6 8/24/87 William J. Mills and Co. located at Greenport, based on the approved site plan. Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward, Edwards On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board approve the preliminary map for the subdivision to be known -~as "Cedarfields" located at Greenport, following~a preliminary hearing, SCTM ~ 1000-40-5-1, survey dated July 14, 1987 along with supplemental site utility layout, profiles, miscellaneous details and landscaping plans subject to: SCTM ~ 1000-40-5-7. 1. Adequate response to Draft Environmental Impact Statement (DEI$~ regarding potable water. 2. Provision of adequate storm drainage and roadway in accordance with Town of Southold Highway Standards. 3. ProviSion f~r Sidewalks 4. Approval by the Town's consulting engineer. Vote of the Board: Ayes; Orlowski, Mullen, Latham, Ward, Edwards (Mr. Orlowski~S~ated that he was in favor of the proposal, but~no~ in favor of sidewalk, S, , , , , On a motion made by Mr. Latham, seconded by Mr. Edwards, it was RESOLVED that the Southold Town Planning Board grant one six month extension on the completion of the conditions of the~. final resolution on the major subdivision of Deborah Edson;~ SCTM 9 1000-102-2-6, this is the only extension to be considered. Vote of the Board; Ayes: Orlowski,Mullen, Latham, Ward, Edwards Francis F. Adams - SCTM ~ 1000-3-3-3. The Board reviewed this proposed lot line change located at Fishers Island. Mr. Ken Edwards abstained from any discussion with regard totthis~ proposal. The Chairman read correspondence recently received from the Fishers Island Deve~gpment Corp. (FIDCO) The letter stated that Mr. Ridgway, President of FIDCO had meet with Mr. O'brien, the applicant in order to understand the proposal. Mr. Ridgeway stated in his correspondence that FIDCO has no objections to Mr. O'Brien~s proposed plan upon further review sub~ect to covenants that the two lots with dwellings will be sold only as~ a unit. Mr. McVann, Esq., representing Mr. O'Brien, was present. He stated that he~ did not think Mr. O'Brien would have-any objection ~0 this proy~slon. Planning Board Page 7 8/24/87 On a motion made by Mr. Ward, seconded by Mr. Mullen,it was RESOLVED that the Southold Town Planning Board approve the lot line chanqe 6n~plan ~ade for Francis Fiske Adams, Jr. located at F~shers Island, survey dated as revised May 29, 1987, subject to: Covenants and Restrictions filed with the office of the County Clerk stating that lots~_'no. 1 and 2 will be sold as one unit, e~en upon~.the complet£on of dwelling units. Vote of the Board; Ayes: Orlowski,Mullen, Latham , Ward Abstained: Edwards Braun Oyster Company (Homan) - Site Plan for B~aun Oyster Company, SCTM ~ 1000-103-1-1,2,3,4. Mr. William F. Mullen, Jr. abstained from any action or discussion with regard to this site plan. This proposal for an addition on existing retail store ~t Cutchogue had received conditional certification from the Building Department. On a motion made by Mr. Latham, seconded by Mr. Ward, it was RESOLVED THAT THE Southold Town Planning Board approve and authorize the Chairman to endorse the site plan ~or B~aun~ Oyster Company for construction.~of an addition to an existing buildin~/fo~ retail and office space located at Cutchogue, SCTM ~ 1000-103~1-1,2,3, and 4 subject to completion of the following condition$~ 1. proposed driveway to garage would need 239k if not redesigned so as not to exit on Road. 2. Exterior lighting to be shielde~ to property. 3. Installationo ffuel tanks to meet requirements of S~ate Code. Vote of the Board; Ayes: Orlowski, 7~a~ham, Ward, Edwards Abstained: Mullen McCan~e - It~.~was the consensus of the Board to set%this four lot minor subdivision for a field ~nspection. Proposal is located at Fishers Island. The nex~ Planning Board meeting was set for Monday, September 14, 1987. Planning Board Page 8 8/24/87 On a motion made by Mr. Ward, seconded by Mr. Mullen, it was RESOLVED that the Southold Town Planning Board hereby adopts the following policy with regard to the construction~of minor subdivision roads: Ail Raods shall be constructed in.accordannce with~:the Highway Specifications for Roads and Drainage (Chapter Al08) which includes naming all roads, installation of all utilities (LILCO, telephone, and cable TV) and bond, letter of credit or passbook to guarantee ccmpletion of improvements. The Planning Board may reduce the width to 22' if in its judgement the road cannot physically be exteDded to service future subdivisions or additional lots in excess of 4.
