Keil 38A Fifty Acre Road St. James, NY 11780 Re: Amended Site Plan for N and J Management, LLC Located at 4735 Westphalia Road in Mattituck SCTM#1000-113-13-1.2 Zoning District: Residential Low-Density (R-80) Dear Mr. Keil: The following resolutions were adopted at a Special Meeting of the Southold Town Planning Board on July 28, 2008: WHEREAS, the applicant, Norman Keil, proposes a 52,920 sq. ft. greenhouse addition on an 18.75 acre parcel in the R-80 Zone; and WHEREAS, N and J Management Co. is the owner of the property known as SCTM# 1000-113-13-1.2 and the property is located 831' e/o County Road 48 on the s/s/o Westphalia Road, known as 4735 Westphalia Road, in Mattituck; and WHEREAS, on April 29, 2008, an amended site plan application was submitted for approval; and WHEREAS, on June 19, 2008, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to agencies having jurisdiction for their comments and the following agencies responded: Town Engineer, Chief Building Inspector, Natural Resource Conservation Service, LWRP Coordinator and the Mattituck Fire District; and WHEREAS, the comments from those agencies referenced above were received and accepted by the Planning Board, discussed with the applicant, and incorporated into the site plan to the satisfaction of the Planning Board; and WHEREAS, on July 17, 2008, the Southold Town Chief Building Inspector reviewed and certified the amended site plan as a permitted use in the A-C Zoning District; and N & J Management Page Two July 29, 2008 WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C. of Southold Town Code, has the discretion to waive any or all of the requirements in §280-133 for those applications involving uses strictly related to agriculture; and WHEREAS, the Southold Town Planning Board, pursuant to §280-131 H. of Southold Town Code, has the discretion to waive the public hearing requirement for those applications involving uses strictly related to agriculture. The Planning Board has found that the public hearing for this application may be waived for the following reasons: this site is an already active greenhouse operation, the location and topography of the new greenhouse is such that it will not be readily visible from any public roads or the residential neighbors and there is a natural vegetated buffer screening the proposed greenhouse from the neighboring houses to the West, which are all located above the grade of the proposed greenhouse; and WHEREAS, the Planning Board has found that requiring the entire set of site plan application requirements for this site is not necessary to further the objectives set forth in Town Code §280-129 to maintain public health, safety, and welfare for the following reasons: the application is for an agricultural use and the site is an already approved active greenhouse operation; and WHEREAS, all applicable requirements of the Site Plan Regulations Article XXIV, §280 - Site Plan Approval of the Town of Southold have been met; be it therefore RESOLVED, that on July 21, 2008, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEAR) (6 NYCRR, Part 617.5 (c) (3), has determined that the proposed action is a Type II Action, and not subject to review under SEAR; and be it further RESOLVED, that the Planning Board hereby waives the parking requirements, public hearing requirement, and site plan application requirements, except for the following items: §280-133 A. (1) and (2), B. (1)(a), (b), (d), (3)(a),(b),(c-partial), (4) (a),(b- partial),(c-partial)(e-partial),(g-partial) and (i); and be it further RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under the policies of the Town of Southold Local Waterfront Revitalization Program and determined that the action is consistent; and be it further RESOLVED that the Southold Town Planning Board grants approval to the amended site plan entitled "N and J Management, LLC", prepared by Norman J. There aze currently 16 gutter connected greenhouses with 2 inch PVC down spout pipes outletting into underground dry wells at both ends of the greenhouses. I have no way of determining the capacity of the drywells other than the information provided by Mr. Joe Markowski the representative of the property He claims that there are 8- 8ft. x 12 fr drywells with 2 fr domes installed at each end of the greenhouses. They are proposing to duplicate the existing greenhouse range for the proposed expansion and install the same runoff management system. This is the appropriate way to handle the runoff by collecting clean runoff from the roof areas and piping it directly into the ground before it has a chance to come in contact with the growing area where it has the potential to pick up harmful contaminants such as nitrates from fertilizer and pesticides. The concern is whether the proposed number of drywells has the capacity to handle the volume of runoff required by the town. I would strongly suggest that the Town Engineer check the calculations presented to ensure that the proposed drywells will be adequate. I also noticed that there are 9 existing greenhouses on the east side of the property that do not have any way of controlling the runoff coming off the houses. The runoff is concentrating along the east access road and is causing gulling to occur along the southeast corner of the greenhouse range. The runoff is being directed into the woods where a make shift recharge basin has been excavated to trap the accumulated runoff. It does not appear that any of the runoff is leaving the property at this time. This is a major concern since there is a natural drainage way along the south end of the property that eventually outlets into Mattituck Creek. I would strongly suggest that the runoff management issues be addressed on The U S. Since there are no gutters on these houses and the alleyways between houses are so narrow, about the only viable solution would be to intercept the runoff along the south end of the greenhouse range. A vertical drain (drip trench) could be installed by excavating a trench down to clean sand. The width and depth of the trench would be based upon the volume of runoff being generated and the amount of storage needed to contain the runoff while it infiltrates into the soil. The trench must have berms or curbs to contain the clean water If additional storage area is needed the trench could be extended along the east and west sides of the greenhouse range to pickup that runoff. The trench can be filled with crushed stone so that it does not become a traffic hazard however the trench should only be filled to a height that will not have a negative effect on the needed storage capacity I am enclosing the Natural Resources Conservation Service (MRCS) Practice Standard for Roof Runoff Structure which provides general design criteria recommended by NRCS as well as the Practice Guideline which provides details on design procedure for roof gutters and drip trenches. In situations where damage to the downspouts is likely, PVC Schedule 40 pipe, or pipe of a similar or greater strength has been used as the downspout material. Review these options with the landowner. 8. Determine the type of outlet to be designed for the downspout, i.e., an underground outlet, surface ditch, waterway, diversion, water trough, collection tank or direct discharge to the existing ground surface. Refer to applicable Practice Guidelines for design procedures. 9. Consider other design components that would improve or maintain the proper functioning of the roof gutter system, i.e., downspout protection, snow/ice guards, etc. Case B: Drip Trench: 1. Drip trenches collect water under the drip line of the roof(s), and safely convey the dischazge through surface or subsurface flow. These trenches must have berms or curbs to contain the clean water, and be fenced to exclude livestock access. 2. Determine the inflow rate for the drip trench based on the type of drainfill material to be used. Refer to the NYS Drainage Guide, page 54, Soil Texture/Inflow Rate (cfs/1000 lineaz feet). 3. Consider the Vansport of excess runoff, when the drainfill may be in a frozen or saturated condition. Install the earthen berm or curb along the outside/lower edge of the drainfill material to insure that runoff is directed to the drainage system. 4. Plan the start of construction such that the completion time will permit optimal establishment of vegetative cover, if required. 4. Inspect downspouts to see that they are protected from livestock and equipment operations. • The location and dimensions of the drip trench or surface channel, berm curb. • Surface inlet(s) size and material, orifice size(s), and conduit materials and sizes; and other appurtenances, as required; and, • Adherence to the design grade, drain fill material, bedding/blinding, and depth/cover; and, • Elevation for the top of surface inlet(s), orifice plate(s), and maximum head. During the final construction check, assure that the: • Installed outlet(s) (as applicable) are stable and free of spoil and debris; and, • Trench is adequately backfilled to allow for settlement; and, • Animal guard(s) are properly installed and secured; and, • Fencing to exclude livestock from collection trench/channel is installed, and, • Construction spoil and debris aze properly disposed of, and, • Completed earthwork is suitable for seeding establishment and final seeding requirements have been installed in accordance with the seeding plan. SCOPE This work shall consist of furnishing materials, fabricating, installing, and constructing the gutter and downspout system. This work may include but is not limited to preparing the roofline and fascia, installing the hangers and roof gutters, installing the brackets and downspouts, and other related appurtenances. These items shall be installed as shown on the drawings and as specified herein. Prior to commencing construction, public utilities shall be notified in accordance with N.Y.S. Industrial Code 753. 2. MATERIALS Roof gutters and downspouts shall be aluminum with baked enamel finish, galvanized steel, or other approved material. If roof gutters and downspouts are aluminum, they shall have a nominal thickness of 0.027 inches for gutters and 0.020 inches for downspouts, and if galvanized steel, a minimum thickness of 28 gauge. Dissimilar metals shall not be in contact with each other. All gutters will have end caps. 3. INSTALLATION Gutters shall be placed below the roof slope line so ice and snow can slide clear. The top outer edge of the gutter shall be 1/2 inch below the projection of the roof slope line on roofs with steeper than 12H:5V pitch, and 3/4 inch below on roofs with 12H:5V pitches or flatter. Supports Rafter ends and fascia boards shall be sound. Gutters shall have continuous backing support with a vertical face. Awedge-shaped stringer may be used for support. Hangers shall be located a maximum of 24 inches apart and nailed to the fascia board or roof sheathing at rafter locations. Downspouts shall be securely fastened at the top and bottom with brackets that are of similar material as the downspouts and shall have intermediate supports that are a maximum of 10 feet apart. Temporary Greenhouse This document provides guidance regazding regulating the construction and use of a "temporary greenhouse: ' Article 18 of the Executive law, know as the New York State Uniform Fire Prevention and Building Code Act, is the enabling legislation for the Uniform Fire Prevention and Building Code (Uniform Code), which became effective January 1, 1984. Section 372 provides the following definitions for "building" and "temporary greenhouse" definitions: "Building means a combination of any materials, whether portable or fixed, having a roof, to form a structure affording shelter for persons, animals, or property. The word "building" shall be construed when used herein as though followed by the words "or part or parts thereof' unless the context cleazly requires a different meaning. The teen "building" shall also mean "factory manufactured home" and "mobile home." The term "building" shall not include a "temporary greenhouse." "Temporary greenhouse means specialized agricultural equipment having a framework covered with demountable polyurethane materials or materials of polyurethane nature and lacking a permanent and continuous foundation, which is specifically designed, constructed, and used for the culture and propagation of horticultural commodities. A "temporary greenhouse" may include, but is not limited to, the use of heating devices, water and electrical utilities, and supporting poles embedded in non-continuous concrete. In no instance will a temporary greenhouse be used for the retail sale of any farm or non-farm products." Therefore, the Uniform Code does not regulate the construction of a temporary greenhouse. A temporary greenhouse does not have to be located on a farm, nor in an agricultural district defined by the New York State Agriculture and Mazkets Law. A temporary greenhouse may be for personal use or for commercial use, however, it cannot be open to the general public for the sale of products. The definition of temporary greenhouse provides that it is specialized agricultural equipment having a framework covered with demountable polyurethane materials or materials of polyurethane nature and lacking a permanent and continuous foundation. Piaster, R.A., Director D ion of Code Enforcement and Administration I _ 4 . r ',8 _ r__ i Guidelines for Review of Local Laws Affecting Temporary Greenhouses "Temporary greenhouses" are typically used on farm operations to propagate and grow nursery stock, flowers and vegetables. AML §301(2)(d) defines "horticultural specialties" to include nursery stock, ornamental shrubs, ornamental trees and flowers. Although temporary greenhouses are usually found on nursery operations and farms that produce vegetables, they are also used in the animal industry to raise young stock. It is common practice for greenhouse operations to purchase seeds, seedlings, bareroot stock, plugs and immature plants from agricultural suppliers and then germinate, propagate, and harden-off the plants on the farm. Once the plants are mature, they are sold in the wholesale and/or retail market. Furthermore, the growing of plants in pots on the farm is also a common practice used by nursery and horticultural operations. In 1992, the Executive Law was amended to define temporary greenhouses as "specialized agricultural equipment." [Executive Law §372(17)'] Executive Law §372(3) states that temporary greenhouses are not buildings for purposes of the State Building Code. Therefore, temporary greenhouses that are specifically designed, constructed and used for the culture and propagation of horticultural commodities are exempt from requirements for building permits. However, temporary greenhouses are not exempt from local zoning requirements. The erection and use of temporary greenhouses as part of a farm operation, including nursery/greenhouse operations, produce farms and livestock farms, is protected under AML §305-a . Real Property Tax Law §483-c2 exempts temporary greenhouses from taxes, special ad valorem levies and special assessments. There is a "one-time° filing of a form, as prescribed by the New York State Office of Real Property Services CORPS), to receive this exemption. The form must be completed and presented to the Town Assessor. Scroll down to RP-483-C for thetwo-page form and RP-483-C-INS for the instructions. 3/10/03 The following are some of the specific matters that the Department considers when reviewing a local law that affects temporary greenhouses: A. Minimum Lot Size Establishing a minimum lot size for farm operations within a zoning district that includes land within a State certified agricultural district is problematic and may be unreasonably restrictive. The definition of "farm operation" in AML §301(11) does not include an acreage threshold. Therefore, the Department has not set a minimum acreage necessary for protection under AML §305-a and conducts reviews on a case-by-case basis. For example, anursery/greenhouse operation conducted on less than 5 or 10 acres may be protected as a "farm operation" under §305-a if the operation is a "commercial enterprise" and more than a backyard garden or hobby farm. For agricultural assessment purposes, however, AML §301(4) states that a farm must have "land used in agricultural production" to qualify (either seven or more acres and gross sales of an average of $10,000 or more in the preceding two years or have less than seven acres and average gross sales of more than $50,000 in the preceding two years). B. Maximum Lot Coverage Establishing a maximum lot coverage that may be occupied by greenhouses may be unreasonably restrictive. It may be difficult for horticultural operations to recoup their investment in the purchase of land if they are not allowed to more fully utilize a lot/acreage. Farm operations should be allowed the maximum use of available land, consistent with the need to protect the public health or safety. Generally, if setbacks between buildings are met and adequate space is available for interior roads, parking areas (where required), and safe operation of vehicles and equipment, health and safety concerns are not likely. C. Maximum Number of Greenhouses Establishing a maximum number of greenhouses that may be constructed on a farm operation may be unreasonably restrictive. Generally, a farm operation should be allowed to erect all agricutural structures and specialized agricultural equipment (temporary greenhouses), regardless of size, which are necessary to operate, consistent with the need to protect the public health or safety. D. Setbacks Minimum setbacks from front, back and side yards have not been viewed as unreasonable unless a setback distance is unusually long. The establishment of lengthy setback distances increases the cost of doing business for farmers because the infrastructure needed to support the operation is usually located within, and adjacent to, the farmstead area or existing farm structures or greenhouses. Excessive setbacks can 3/10/03 also increase the cost of, or make it impracticable to construct, new greenhouses for the farm operation. E. Screening A requirement to screen greenhouses from view has been found by the Department to be unreasonably restrictive. Farmers should not be required to bear the extra costs to provide screening unless such requirements are otherwise warranted by special local conditions or necessary to address a threat to the public health or safety. While aesthetics are an appropriate and important consideration under zoning and planning laws, the purpose of the Agricultural Districts Law is to conserve and protect agricultural lands by promoting the retention of farmland in active agricultural use. F. Greenhouses/Nursery Operations as a Permitted Use The use of greenhouses as part of a farm operation should be a principal permitted use in all local zoning districts located in a county adopted, State certified agricultural district, since the purpose of such districts is to encourage the development and improvement of agricultural land.
