parcel of land, together with the buildings and improvements erected thereon, situate, lying and

BEGINNING at a point in the northeast comer of subject premises where the Shore I.ine of
Marion Lane intersects the westerly side of Bay Avenue; which point is distant 2,100 feet more
or less southerly from the intersection of the southerly side of Main Road with the westerly side
of Bay Avenue; running thence from said point of beginning along Bay Avenue South 35 degrees
35 minutes 00 seconds East 300 feet more or less to a monument and land of Mandaro formerly
of Woodcock; thence partially along said land and partially along land of Scarmato formerly of
Baltz South 72 degrees 24 minutes 50 seconds West 98.68 feet to a point; thence still along land
of Scarmato South 46 degrees 50 minutes West 30.30 feet to a monument and land of Wenk;
thence along said land the following six courses and distances:
(I) North 67 degrees 20 minutes West 61.41 feet:
(2) North 54 degrees 49 minutes West 50.00 feet;
(3) North 57 degrees 37 minutes West 68.13 feet;

more or less to the westerly side of Bay Avenue and thc point or place of BEGINNING.
TOGETHER with all rights, title and interest, if any, of the party of the first part in and
to any streets and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to thc said premises,
TO HAVE AND TO HOLD the premises herein granted unto thc party of the second
part, their beirs, successors and assigns forever.
The party of thc first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
The party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance as a trust fund to be
applied first for the purpose of paying the cost of the improvement and will apply the same first
to thc payment of the cost of the improvement before using any part of the total of thc sanic for
any otber purpose.
Thc word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires
