Rich, residing at 3415 Wells Avenue, Southold, New York 11971, and James H. Rich, III, residing at 555 Reydon Drive, Southold, New York 11971, as Trustees, as to a 6.8%% interest in the premises~ and THE RICH F~2~ZLY TRUST #II, under agreement dated September 5, 2007, James H. Rich, residing at 262 Prospect Avenue, Middletown, Rhode Island 02842, as Trustees, as to a 6.8%% interest in the premises; party of the second part, WITN~SSETHf that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release quitclaim unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, all of the party of the first part's interest in ALL that certain plot, piece or. parcel of land, with buildings and improvements thereon erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State of New York, being known and designated at Lot #7 on a certain map known as "Plan of Lots owned by George H. Wells, situate at Southold, Suffolk County, New York, dated November 10, 1927, Otto W. Van Tuyl, Professional Engineer and Land Surveyor, Greenport, N.Y." which said map was filed in the Suffolk County Clerk's Office on November 28, 1927 as Map No. 859. TOGETHER with all the right, title and interest of the parties of the first part, if any, in and to the beach, waters and lands under water of Jockey Creek in front of and adjacent to said premises. TOGETHER with all the right, title and interest of the parties of the first pa~t, if any, in land to Wells Avenue, in front of and adjacent to said premises. SUBJECT to the following restrictions: 1. . Said premises shall not be used except for r~sldential purposes; that the party of the second part w~ll not erect, carry on, maintain, suffer or permit on t~e said plot, or any part thereof, any brewery, ~stillery, or other place for the manufacture or sale of intoxicating liquors, nor for the sale of gasoline, nor any dangerous, offensive or noxious trade, business or occupation, nor any nuisance whatever, nor any trading or manufacturing business, trade, or occupation, nor shall any fowl be kept on said premises, kept on said premises. 2. No residence shall be erected nor shall any swine be upon said premises or any part thereof which shall cost less than $8,000, nor shall any other building be erected or maintained thereon, excepting a private garage, boat or bath house, and necessary outbuildings which shall be inoffensively located and sightly. 3. No residence shall be erected on said premises within ten feet of any of the roads or roadways adjacent thereto, nor within 10 feet of any side or rear line of any plot or plots into which said premises may be sub- divided, nor within 10 feet of the embankment fronting Jockey Creek. 4. Said premises, together with the buildings, shall be kept in a wholesome, healthful and sanitary condition by the party of the second part. 5. The foregoing special restrictions are hereby declared to be and shall be covenants to and running with the land. 6. The foregoing restrictions may be altered or modified at any time by the parties of the first part or their successors; and the parties of the first part hereby reserve the right to alter or modify any restrictions now or hereafter imposed upon any other lots on said map without being required to make similar alterations or modifications in regard to the premises herein. SUBJECT to any state of facts an accurate survey may show; providing the same does not render the title unmarketable. SUBJECT to any state of facts an inspection of the premises may disclose. BEING AND INTENDED TO BE a portion of the same premises conveyed to the Grantor by Deed dated April 22, 1953 and recorded in the Suffolk County Clerk's Office on May 1, 1953 in Liber 3508 page 318, the Grantor being the same person described as the Grantee in said Deed. .. - Together w~th all r~ght, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above-described premises to the center lines thereof; Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; To have and to hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
