the State of New York, having its principal office at the
Suffolk County Center, Center Drive, Riverhead, New York 11901,
party of the first part, and

WILLIAM F. TINTLE, JR. and CARRIE TINTLE, his wife, 1
Carriage Court, East Hampton, New York 11937 party of the
second part,
WITNESSETH, that the party of the first part, pursuant to
Resolution Number 329-2001 adopted by the Suffolk County
Legislature on April 24, 2001 and, thereafter, approved by the
County Executive on May 3, 2001, in consideration of ten
dollars and other valuable consideration paid by the party of
the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the
party of the second part forever,
ALL, that certain plot, piece or parcel of land with any
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of
New York, described on the Tax Map of the Suffolk County Real
Property Tax Service Agency as District 1000, Section 040.00,
Block 02.00, Lot 017.000, and acquired by Tax Deed on March 5,
1991, from General L. Rains, the Deputy County Treasurer of
Suffolk County, New York and recorded on March 11, 1991, in
Liber 11230, CP 177, and otherwise known as and by Town of
Southold, Eastern Shores @ Greenport Map No. 4426 Sec 2 Lot 89
filed in the Ofiice of the Clerk of Suffolk County on August
10, 1965
TOGETHER with all right, title and interest, if any, of the
party of the first part of, in and to any streets and roads
abutting the above-described premises to the center lines
thereof;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises;
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns
of the party of the second part forever.
SUBJECT to all covenants, restrictions and easements of
record, if any.
AND the party of the first party, in compliance with Section
13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a
trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of
the total of the same for any other purpose.
THE WORD "PARTY" shall be construed as if it read "parties"
whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly
executed this deed the day and year first above written.
