WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the
pm1y of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the
East Marion, Town of Southold~ County of SUffolk add State of New York, known and
designated as Plot No. 40 on a certain Map entitled "map of Marion Manor" situate
at East Marion, Town of Southold, Suffolk County, New York, surveyed 11/25/52 by
Otto W. Van Tuyl & Son, licensed land surveryors, Greenport,New York, owned and
developed by Peter Blank & Son, East Williston, New York, filed in the Office of the
CLerk of the County of Suffolk on 3/19/53 as Map #2038;said premises being more
particularly bounded and described as follows;
BEGINNING at point on the SouthWesterly side of Gillette Drive east where same is
interesected by the most southerly end of a curve connecting the southeasterly side
of Midland Place with the southwesterly side of Gillette Drive East;
RUNNING THENCE along the southwesterly side of Gillette Drive East, south 26 degrees
36 minutes 30 seconds East, 120.68 feet;
THENCE south 64 degrees 51 minutes 10 seconds 79.73 feet;
THENCE north 25 degrees '52 minutes 40 seconds west, 145.01 feet to the southeasterly
side of Midland Place;
THENCE along the southeasterly side of Midland Place north 64 degrees 51 minutes 10
seconds east, 53.55 feet;
THENCE northeasterly, easterly and southeasterly along the arc of a curve bearing to
the right having an arc of 38.63 feet which connects the southeasterly side of Midland
Place with the southwesterly side of Gillette Drive East to the point or place of
BEGINNING.
Being and intended to be the same premises conveyed to the party of the first part by
deed dated 8/6/01 and record on 8/17/01 in Liber 12316, Page 411.
TOGETHER with all right, title and interest, if any, of the party of the first part of, in anato any streets and roads abutting the
above~described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party ofthe
second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above written.
