KATHLEEN FRALEIGH and JAMES H. pons, husband and wife, residing at 719 Southern
Cross Rond, Cutehogue. New York] 1935,
party ufthe second pan.
WITNESSETH, that the pany of the first pan, in eon.~ideratjon of Ten Dollars and other valuable
consideration paid by the pany of the second pan, does hereby grant and relea.'Ie unto the party of
the second part, the heirs or successors and assigns of the party of the second pan forever.
ALL that certain plot. piece or parcel of land. with the huildings and improvements thereon
erected, situate, lying and being FIL'CtS Neck, near Cutchogue. in the Town of Soulhold.
County of Suffolk and State of New York. bounded and described as follows:
BEGINNING at a point at the nonhwest corner of the premises herein being described, which
point is distant the following course and distance from a point on the southerly side of South
Cross Road, where same is intersected on the nonheast corner oC land now of formerly of
Fitzpatrick, which last mentioned point on the southerly side oC South Cross Road is 724.97
feet westerly from the corner formed by the imersection of the westerly side of Fleets Road
with the southerly side of South Cross Road:
(I) South 31 degrees 43 minutes East, 118.66 feet: and
RUNNING THENCE Crom said point of beginning the following eight courses and distances:
(I) South 31 degrees 43 minutes East. 15.34 feet to a monument:
(2) South 26 degrees 17 minutes East, 125.0 fcetto a monument;
(3) Nonh 69 degrees 47 minutes 20 seconds East, 90.95 Ceetto a monument;
(4) Nonh 69 degrees 37 minules 50 SL'COndS East, 90.0 feet to a monument;
(5) North 32 degrL'CS 02 minutes Wcst, 125.0 feel to a monument;
(6) South 70 degrees 22 minutes West, 84.0 Ceetto a monument;
(7) North 29 degrL'L'S 14 minuleS 30 seconds West, 15.21 feet to a point: and
(8) South 70 degrees 22 minutes Wcst 85.22 feel to the point or place of beginning.

TOGETHER with an easemenL of right-of-way for ingress and egress from the above-dc:scribed
premises over a strip of land having a width of IS feet when measured at right angles 10 its
sidelines, the westerly and northerly lines of which are located as follows:
BEGINNING at a point on the southerly side of South Cross Road where same is intersected
by the northeast corner of land now or formerly of Fitzpatrick. which last mentioned point on
the southerly side of South Cross Road is n4.97 feet we.~terly from the corner fonned by the
intersection of the westerly side of Fleets Neck Road with the southerly side of South Cross
Road;
RUNNING THENCE South 31 degrees 43 minutes East, 118.66 feet; and
THENCE over a IS-foot strip of land created by the prolongation of the following course on
the northerly boundary of the premises above descrilx.'d in an easterly direction. 10 wit:
South 70 degrees 22 minutes West a distance of 42 feet.
WITH rL'Slx:ct to the right-of-way herein granted for ingress and egress, it is further provided
that if the party of the second part, their heirs and assigns. desire to improve said easement and
right-of-way. said party of the second part. their heirs and assigns shall, at their own cost and
expense, properly grade. blacktop and in perpetuity properly maintain or repair said easement
and blacktop SUrfdCC along the said right-of-way easement hereinabove dL"SCribed.
SUBJECT to a reservation made by W. Harry Lister. his heirs. and assigns forever. in a deed
dated 612/1966. and reconled 6/6/1966. in the Office of the Suffolk County Clerk in Liber
5969. Page 44, for the right to pass. repass and use a three-foot wide utility easetnent now
located on the above-described property and running with the westerly and partially on the
northerly boundaries thereof.
BEING AND INTENDED TO BE the same premises conveyt.'d to the party of the first part by
deed from W. Harry I.isler, dated 6/211966. and recorded 6/6/1966. in the Office of the
Suffolk County Clerk in Liber 5969. Page 44.
TOGETHER with all right, title and interest, if any. of the pany of the first part in and to any
streets and roads abutting the above described premises to the center linL'S thereof; TOGETHER
with till.: appurtenances and all the estate and rights of the party of the first pan in and to said
premises; TO HA VE AND TO HOLD the premises herein granted unto the party of the second
part. the heirs or successors and assigns orthc pliny of the second pan forever.
AND the pany of the first part covenants that the pany of the first part has not done or suffered
anything whereby the said premises havc been encumbered in any way whatever, except as
aforesaid.
AND the pany of the first pan, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will rL'Ccive the consideration for this conveyance and will hold the right
to receive such consideration n.~ a trust fund to be applied first for the purpose: of paying the cost
of th~ improvement and will apply the 118me first to the payment or the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "pmy" shall be construed as if it read "panies" whenever the sense of this indenture so
requires.
