BARGAIN AND SALE DEED
THIS INDENTURE, made September 6, 2001, among EDWARD L.
KAVANAGH, JR., AND MARY M. KAVANAGH, having an address at 280 Bayville Road,
Lattingtown, New York 11560 (hereinafter referred to as "Grantor"), and INLAND HOMES, INC.,
having an address at 315 Westphalia Road, Mattituck, New York 11952 (hereinafter referred to as
"Grantee ").
WITNESSETH, that Grantor, in consideration of TEN AND 00/100 ($10.00)
DOLLARS and other valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, does hereby grant and release unto Grantee and the heirs, executors, administrators,
legal representatives, successors and assigns of Grantee forever,
ALL that certain plot, piece or parcel ofland, with the buildings and improvements
thereon erected, situate, lying and being in the Town of Southold, County of Suffolk
and the State of New York, at Fleet's Neck, near Cutchogue, being more particularly
described in Schedule" A" attached hereto and made a part hereof,
PREMISES herein known as and located at Vacant Land, Pequash Avenue,
Cutchogue, New York,
TOGETHER with all right, title and interest, if any, of Grantor in and to any streets
and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of Grantor in arid
to said premises,
BEING and intended to be the same premises conveyed to the Grantor by deed dated
May 12, 1998, and recorded in the Suffolk County Clerk's Office on July 20, 199'1,
in Liber 11977, Page 112,
TO HAVE AND TO HOLD the premises herein granted unto Grantee and the heirs,
executors, administrators, legal representatives, successors and assigns of Grantee forever.
Grantor is the owner of said premises. Said premises is not located in an agricultural
district.
Grantor covenants that Grantor has not done or suffered anything whereby said
premises have been encumbered in any way whatever, except as set forth herein.
Grantor, in compliance with Section 13 of the Lien Law, covenants that Grantor will
receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement before using
any part of the total ofthe same for any other purpose.

LEGAL DESCRIPTION
ALL that certain plot, piece or parcel of land, situate, lying and being in the
Town of South old, County of Suffolk and State of New York, at Fleet's Neck,
near Cutchogue, bounded and described as follows:
BEGINNING at a monument on the westerly line of Fleet's Neck Road 100.0 feet
southerly along said westerly line from Midwood Road, and from said point of
beginning;
RUNNING THENCE along said westerly line of Fleet's Neck Road, South 32
degrees 18 minutes 00 seconds East 100.0 feet to a monument and land of
Wysong;
THENCE along said land of Wysong, South 57 degrees 42 minutes 00 seconds
West 175.0 feet to a monument;
THENCE North 32 degrees 18 minutes 00 seconds West 90.0 feet to a
monument and land of the party of the second part;
THENCE North 54 degrees 25 minutes 50 seconds East 175.29 feet to the point
or place of BEGINNING.
