There were present: Messrs: Robert W. Gillispie, Jr., Chairman; Robert Bergen; Charles Grigonis, Jr. Also present: M~. Howard Terry, Building Inspector. PUBLIC HEARING: Appeal No. 1646 - 12:00 Noon (E.~.T.), upon application of Elizabeth M. Mitchell, Main Road, Orient, New Tork, for a special exception in accordance with the Zoning Ordinance, Article Iii, Section 300, ~ubsection B-14, for permission to hold a yard sale on Septem~ber 2, 1972; rain date ~eptember 3, 1972. Location of property: north side of ~min Road, Orient, New York; bounded north by Lot ~65, Orient By The Mea ~ection ii; east by ~roposed road; south by Main Road; west by Fitzsimmons. Fee paid 15.oo. The Chairman opened the hearing by reading the application for a special exception, legal notice of hearing, affidavit attesting to its publication in the official newspapers, and notice to the applicant. Gilllspie, seconded by Mr. Bergen, it was RE~OLVED Elizabeth M. MitChell, Main Road, Orient, New York, be GRANTED permission to hold a yard sale on September 2, 1972; rain date September 3, 1972, as applied for, on ~remises located on the north side of Main Road, 0rient~ New York, subject to conditions of Resolution of the ~outhold Town Board of Appeals dated June 15, 1972, as follows: I. Permission is for a one day yard sale to be held on a specific date, with a specific rain date. 5 Permission is for the sale of household and personal p~operty of the owner and his family and ~ay not include property of others unless it is for a charitable purpose. Applicant mst provide someone to supervise parking at the yard sale to prevent blocking neighbor~t d~iveways. V~ote of the Board: ~yes:- Messrs: Gillispie, Bergen, Grigonis. An informal discussion was held by the Board with ~s. Vannasek to the Keubek's purchase, it was owned by Ed King. Mrs. Vannasek said she would like to have the action o~ the Board on Appeal No. 1424 dated May 6, 1972 modified to include a gas pump on the premises. Fms. Vannasek said they would like to build a shed over the gas p~mp and keep it under l~ck and key. ~he feels that they need the pump in case of emergencies. Dubovick, D.D.S., 4 C.a~.men ~treet, Hemp~stead, for a variance in accordance with the Zoning 0r~inance, XII, 3ection 1204, ~ubsectton B, for permission to change on-con, Terming business building. Location of property: now or formerly of Petty on west side of Mechanic ~treet, , New York, bound&d north by William Smith; east by Mechanic ~treet; South by J. ScOtt; west by Methodist Church. A public hearing was held on August 24, 1972 at 8:00 P.M. (E.S.T.). After investigation and Ir~pection the Boa~d finds that applicant requests permission to change use of non-conforming business building on premises located on west side of Mechanic Street,$~thold, New York. The fi. ndings of the Board are that applicant will c~n a lot .of approximately 55 feet by 108 feet on which two Joined buildmr~s (approximately 48 feet in width) are located approximately I~ feet from. Mechanic affect. It is propose~ that the semtherly building, w~th approximately lt00 sq. ft., be used as a residence for a dentist whose offices will occupy the ~ortherl~ b~ilding which is presently in use as a blac.ksmith's shop n a residential-ag~cultural zoned a~ea. The Beard f~nds that the use of this property for a dentist,s office will be a higher use classifi0ation than the current use. The location of the present structure offers very little offstreet pa~king a~ea. The Boa~d also finds that this property is served by city water, and the southerly building could be adapted to residential use; t~-t the applicant may obtain an ease~ent ove~ property to tb~r south f ~ access to the rea~ yard which could furnish additional pa~king. The Boa~d finds that strict application of the 0~dinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be sha~ed by all properties alike in the immediate vicinity of this property' and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by ~. Grigonis, it was RE~OLVED James T. Dubovick, D.D.S., 4 Carmen Street, Hempstead, New York, be GRANTED permission to use southerly building as a residence and/or northerly building as a dental office on premises located on the west side of Mechanic Street, ~outhold, New York, subject to the following conditions: That the.northerly building be set back at least !0' from its present position in order $o create additional parking a~ea except that this setback shall not apply to the historic old forge at tbs northeast corner of the new building line. ~outhold Town Boa~d of Appeals -4- Augmst 31, 1972 1. (eontld) The new easterly wail of the northerly building shall be se constructed that the outside of the wall shall be a~ least 10t from the present front line of the building except that at the point where the wall encloses the forge, th~ forge shall control the location of the wall whose outside edge shall be no more than 2~ From the forge. 2.
