Van Tuyl & Son, licensed land surveyors, owned and developed by the Estate of George H. Fleet, Cutchogue, N.Y. and filed in the office of the clerk of the County of Suffolk on November 16,1962 as Map File No. 3683, Abstract No.4156; SUBJECT TO the following covenants and restrictions: That not more than one dwelling shall be constructed on the premises for each 100 feet of road frontage; that any house or bungalow erected or maintained shall cost not less than $12,500.00 and shall be at least 35 feet back from the front boundary line orthe lot, including porch and piazza; that no outbuilding shall be erected other than the usual garage; that said garage shall be in connection with or joined to the house or bungalow, or so erected that it shall be at least 90 feet back from the front boundary line of the lot; that the premises shall be used for dwelling purposcs only and nothing which shall be a nuisance, unwholesome, or offense to the neighborhood shall be permitted on said lot; and that no fowl or pigs shall be kept on said premises. BEING ^ND INTENDED TO BE the same premises conveyed to the parties of the first part by deed dated May 19,2000 recorded in the Office of the Clerk of the County of Suffolk on June 2, 2000 in Libel' 12046 page 480. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premIses. TO HA VI<: AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and will apply the samefirst to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
