as thirty-three (33) feet in width, said monument being about six hundred and forty (640) feet northerly
from the northerly line of "West Road" or Bay Avenue, measuml along the westerly line of the thirty-three
(33) foot wide road known as West Creek Avenuc on the westerly side of Fleet's Neck; FIU1Ding thence
south 61 degrees 46 minutes 30 seconds west three hlU1dred and fifty and nine-five hundredths (350.95) feet
passing through a CODCiete monwnent near the easterly shore of Wickham's Creek; thence northwesterly
along said easterly side of said creek approximately a line which is north 55 degrees 46 minutes 10 seconds
west eighty (80) feet more or less fi'om the last described point; thence north 61 degrees 46 minutes 30
seconds east, on a line piIraIlel to and lleYCllty (70) feet northerly of the first described course fi'om the point

easterly side of Wickham's Creek, to a concrete monument; thence at a 90 degree angle to the last described

parallel to and one hlU1drcd (100) feet northerly of the first clescribed course from the point of begiMing,

westerly line ofa thirty-three (33) foot wide road known as West Creek Avenuc; thence South 41 degrees

beginning.
TOGETHER WITH right of way to the Bay and County Road.
TOGETHER with any right, tide or interest which the grantor may have in, and to the water or land under

. BEING AND INTENDED TO BE THE SAME PREMISES conveyed to the party of the first part by deed
dated June 23,1999 which deed was m:orded in the Office of the Clerk of the COtmty of Suffolk on August
31, 1999 in Liber 11986 at PlIIle 309.
TOGETHER with all right, title and interest, ifany, of the party of the first part in and to any streets and
roads abutting the above described pranises to the center lines thereof.
TOGETHER with the appurtenllllces and all the estate and rights of the party of the first part in and to said
pranises.
TO HAVE AND TO HOLD the pranises herein grBDIed unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said pranises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in complillllCC with Section 13 of the Lien Law, covenants that the party
of the first part will receive the considetation for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpollC of paying the cost of the improvement, and
will apply the same first to the payment of the cost ofthc improvement before using any pari of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
