THIS INDENTURE, made the
BETWEEN

JANE C. GERHARD, residing at 6 Country Club Drive, Cutchogue, NY 11935, and
BARBARA J. DAVIS, residing at 14 Ridge Court, Saratoga Springs, NY 12866
parties of the first part, and
JANE C. GERHARD, residing at 6 Country Club Drive, Cutchogue, NY 11935, and
BARBARA J. DAVIS, residing at 14 Ridge Court, Saratoga Springs, NY 12866
parties of the second part,
WITNESSETH, that the party of the first part, in consideration of --- Ten and 00/100 ($10.00)---dollars
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Cutchogue, in the Town of Southold, County of Suffolk and State of New York, more
particularly bounded and described as follows:
BEGINNING at a concrete monument on the southerly side of Country Club Drive, said concrete
monument being located at the intersection of the southerly side of Country Club Drive and the westerly
boundary of Lot 6 on the map entitled "Map of Country Club Estates" filed in the Suffolk County Clerk's Office
on October 17,1978 as Map #6736;
RUNNING THENCE South 79 degrees 55' 10" East 203.16 feet along the southerly side of Country
Club Drive to a concrete monument;
RUNNING THENCE along the arc of a curve having a radius of 25.00 feet a distance of 37.24 feet to
the South to a concrete monument located on the westerly side of Linden Avenue (Moores Lane);
RUNNING THENCE South 5 degrees 25' 50" West along the westerly side of Linden Avenue (Moores
Lane) 224.67 feet to a point;
RUNNING THENCE North 84 degrees 34' 10" West 259.70 feet to a point located on westerly side of
the former Lot 5 on the aforementioned Map of Country Club Estates;
RUNNING THENCE North 12 degrees 45' 50" East 268.25 feet to a concrete monument located at the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
10/20/93 recorded in the Office of the Suffolk County Clerk on 11/4/93 in Liber 11650 at page 796, known and
identified as Lot 6 on the "Map of Country Club Estates", together with the northerlv half of Lot 5 on the "Map
of Country I.,;IUO l:states", subdivided pursuant to the Resolution of the Planning Board of the Town of Southold
dated January 8, 2001.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
