Dear Mr. Nemschick:
At your written request for a Certificate of Occupancy review of site plan requirements,
dated March 14th and last revived March 19th, Planning Department staff performed a site
visit on March 17th.
In reference to the above, the Planning Board held a work session on March 17th and
March 24th to discuss the letter, including the as-built site plan drawing page A-2.01
prepared by Nemschick Silverman Architects P.C. dated November 28, 2006 and revised
October 22,2007, the approved site plan prepared and certified by Raymond W.
Nemschick, Architect dated October 31, 2006 known as A-2.01 and the building elevation
plans labeled A-4.01, A-4.02, A-4.03 and A-4.04 dated October 31, 2006 and the resolution
dated November 14,2006 regarding the above referenced site plan application. In
reference to the above, the Planning Board has accepted the 'As-Built' plan A-2.01 dated
November 28,2006 and revised October 22,2007. This is to inform you that the site plan
requirements have been conditionally satisfied and include the following items:
· The Planning Board acknowledges and approves the removal of the concrete walkway, the
change in driveway entrance, and the change to the ground transformer, as shown on the
as-built site plan.
· As described in the letter from Ray Nemschick dated March 14, the top coating and final
demarcation of the parking area will be completed by April 15, 2008.

· As described in the letter from Ray Nemschick dated March 14, the final grading and
hydroseeding will be completed by April 30, 2008.
· As described in the letter from Ray Nemschick dated March 14, the site will have all
reconnect of existing lighting completed by April 30, 2008. All outdoor lighting shall be
shielded so that the light source is not visible from adjacent properties and roadways.
Lighting fixtures shall focus and direct the light in such a manner as to contain the light and
glare within property boundaries. The lighting must meet town code requirements.
· The applicant also agrees to install all landscaping as shown on the plan. As per the
landscape survivability guarantee, the applicant agrees to replace any of the landscape,
which dies within three years of planting.
Any changes to the as-built site plan beyond those described above must receive approval
from the Planning Board.

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is
implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's property is nonconforming with an area of
31,666 square feet, located in the R-40 Low-Density Residential Zone District, with a building
established as a library since about 1985.
BASIS OF APPLICATION: Building Inspector's July 14, 2006 Notice of Disapproval citing
Sections 100-242A (based on ZBA Interpretation No. 5039 in the Walz Application) and 100-244
(280-124) concerning a proposed addition and alterations to an existing library building, for the
reason that there will be an increase in the degree of nonconformance. The code requires a
minimum of 50 ft. rear yard for nonconforming lots measuring between 20,000 and 39,999 square
feet in total, and a minimum front yard setback of 40 feet (instead of 40 feet for the rear yard
noted on the Notice of Disapproval).
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at
which time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following
facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to make alterations and roof
addition as described in the diagrams prepared 5/5/2006, updated 6/6/2006, by Raymond W.
Nemschick, R.A. The majority of construction will not exceed the existing building envelope,
dormers will be added over the first floor, and alterations to the existing basement without major
excavation for the new support. The existing rear yard setback is and will remain at 19 feet
(exclusive of stairways), and the code requires a minimum of 50 feet. The existing front yard
setback facing the Main Road is 38 feet to the front entrance, and the code requirement is 40
feet. This setback will also remain unchanged.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:

1 . Grant of the variances will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The new dormers and alterations to the library
building will allow for utilization of the lower floor of the library, after building a new foundation
under portions of the building (slightly raising the building for installation of the foundation walls).
The new construction will not create a new nonconformance and will be minor with respect to the
code required setbacks of the building that has existed in this location for many years.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The building has remained in this
nonconforming location for many years, with the most recent expansion in 1 996. The proposed
renovations and dormer additions to this historic landmark will also require a determination by the
Town's Landmark Preservation Commission.
3. The relief granted is not substantial.
4. The difficulty has been self-created based upon the size and nonconforming setbacks of the
existing building.
5. No evidence has been submitted to suggest that a variance in this hamlet community will have
an adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of dormer additions and building renovations, while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
balancing test under New York Town Law 267-8, motion was offered by Member Goehringer,
seconded by Chairwoman Oliva, and duly carried, to
GRANT the variances as applied for, as shown on the construction and site diagrams
prepared 5/5/2006, updated 6/6/2006, by Raymond W. Nemschick, R.A., subject to
applicant obtaining a Certificate of Appropriateness from the Town Landmarks
Preservation Commission.
Any deviation from the variance given such as extensions, or demolitions which are not shown on
the applicant's diagrams or survey site maps, are not authorized under this application when
involving nonconformities under the zoning code.
This action does not authorize or condone any current or future use, setback or other feature of
the subject properly that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Oliva (Chairwoman), Goehringer, Dinizio, and Simon.
(Member Weisman was absent during this lution.) This Resolution was duly adopted (4-0).

27550 Main Road (Route 25), Cutchogue, is on the Town of
Southold's Register of Historic Places,and
as set forth in Chapter 170 of the Town Law (Landmarks
Preservation Code) of the Town of Southold, all proposals
for material change/alteration must be reviewed and granted
a Certificate of Appropriateness by the Southold Town
Landmarks Preservation Commission prior to the issuance
of a Building Permit, and
an application has been submitted to make alterations to an
historic building as shown on materials dated September 26,
2006, and
a public hearing held on October 30, 2006 for the purpose of
considering approval of the proposal has been concluded,
and
the Cutchogue-New Suffolk Free Library did not agree to
change the style of the entrance dormer as required by the
Commission, additional discussions were held resulting in
the Library agreeing to the recommended dormer on
Novemoer ;;ra, ana . . _n
plans submitted on November 9th showed an unapproved
raised vent along the ridge of the original church building
required additional review and discussion, and

final plans dated November 14, 2006 reflecting all approved
changes were submitted on November 17, 2006, and
it appears that the project requires no further review, and
the Commission has made the following findings offact
concerning the property and the proposal:
. Constructed in 1862 and added to in 1986, the building
retains sufficient integrity to reflect its architectural and
historical significance.
. The purpose of the proposal is to create additional
interior space and strengthen the overall structural
integrity of the building.
. The Commissioners made two site visits to the library
and has given as much guidance as possible to the
applicant in order for himlthem to have a complete
understanding as to what is needed to make the project
approvable.
. The Commissioners are guided by the principle, outlined
in paragraph 170-8 ofthe Code, that any alteration to
existing landmarks shall be compatible with its historic
design, architecture and appearance, as well as with the
surrounding district. The Commissioners gave careful,
thoughtful, and informed evaluation of the facades as
required by paragraph 170-2B3 of the Code.
. In a letter dated September 27,2006, the Commissioners
listed in detail its concerns with the proposed exterior
changes. The library's Building Committee agreed to
accept the Commission's recommendations and the
architect has revised the plans for the project to reflect
these changes.
. The major recommendation focused on the proposed
arched dormer over the library's main entrance. As
proposed, it was not compatible with the building's
character and would have had a substantial adverse
effectDn the historical and architectural significance of
the listed landmark.
. The Commissioners were shown'final plans dated
November 14, 2006 reflecting an alternate shed-roof
dormer design at its meeting on November 21, 2006
which they indicated was satisfactory.

NOW THEREFORE BE IT RESOLVED that the Southold Town Landmarks
Preservation Commission determines that the revised
drawings dated November 14, 2006 as presented do meet
the criteria for approval under Chapter 170 of the Town
Code.
BE IT FURTHER RESOLVED that the Commission approves the request for a

The following resolutions were adopted by the Southold Town Planning Board at a meeting held
on Monday, November 13, 2006:
The final public hearing was closed.
WHEREAS, this amended site plan is for the alteration of the existing structure increasing the
space in the basement level by 1,788 sq. ft. and the mezzanine level by 2,352 sq. ft. on a 32,670
sq. ft.; and
WHEREAS, Cutchogue New Suffolk Free Library, is the owner of the property located on the s/e
corner of New York State Route 25 and Case's Lane known as 27550 Main Road in Cutchogue.
SCTM #: 1000-109-6-2.2; and
WHEREAS, on June 30, 2006, the Southold Town Building Department issued a Notice of
Disapproval that the proposed construction will required a variance under Town Code Sections
100-242 A & 100-244, furthermore the proposed construction requires Southold Town Landmark
Preservation review I approval and Southold Town Planning Board site plan approval; and
WHEREAS, on August 17, 2006, the agent, Raymond W. Nemschick, Architect, submitted a
formal site plan for approval; and
WHEREAS, on September 14, 2006, the Architectural Review Committee reviewed the
associated site plan materials and approved the site plan as submitted and the Southold Town
Planning Board accepted the endorsement; and
WHEREAS, on September 19, 2006, the Suffolk County Department of Planning responded
after a review and determined this matter is for "local determination as there appears to be no

significant county-wide or inter-community impact(s)" and the Planning Board accepts this
pursuant to 239L & M General Municipal Law; and
WHEREAS, on September 22, 2006, the Cutchogue Fire District reviewed and approved the
proposed construction indicating that the "district does not feel that a fire well or hydrant is
needed due to the
properties location in a near proximity to an existing water supply" and the Planning Board
accepts the approval; and
WHEREAS, on October 5, 2006, the New York State Department of Transportation reviewed the
referral the NYSDOT assigned the case number 06-340 noting that there is no work proposed
within the State highway right-of-way and no highway work permit is required at this time; and
WHEREAS, on October 5, 2006, the Southold Town Zoning Board of Appeals granted a
Variance as applied for and described under Appeal Number 5945; and
WHEREAS, on October 17, 2006 the South old Town Planning Board, acting under the State
Environmental Quality Review Act, pursuant to 6 NYCRR Part 617, makes a determination that
the proposed action is a Type II and not subject to review; and
WHEREAS, on October 23,2006, the Southold Town Building Inspector reviewed and certified
the site plan for "Library is a permitted use by special exception in this R-40 district" and the
Planning Board accepts the certification for approval; and
WHEREAS, on November 2, 2006, the Architectural Review Committee reviewed the proposed
changes as required by Landmark Preservation and issued "conditional approval pending receipt
of changes in drawings modifying entry dormer" and the Southold Town Planning Board
accepted the endorsement; and
WHEREAS, on November 8, 2006, the Southold Town Engineerreviewed the site plan materials
and issued a report letter with comments and the Planning Board accepts the report; and
WHEREAS, on November 13, 2006, the Southold Town Landmark Preservation has not issued
the certificate of appropriateness from the Hearing Held on October 30, 2006 and the Planning
Board will accept changes and or revisions as required by Land Mark Preservation; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public
Hearing, has received affidavits that the applicant has complied with the notification provisions;
and
WHEREAS, the following items shall be required:
1, All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the light
in such a manner as to contain the light and glare within property boundaries. The
lighting must meet town code requirements.
2. All signs shall meet South old Town Zoning Codes and shall be subject to the
approval of the South old Town Building Inspector.

3. As per the landscape survivability guarantee, the applicant agrees to replace any
of the landscape which dies within three years of planting; be it therefore
RESOLVED, that pursuant to Southold Town Code 280-131 Part I, the applicant agrees to
incorporate all the requirements, comments, and recommendations of each reviewing agency as
referenced above and as indicated on the site plan and corresponding attachments; and be it
fu rther
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under
the policies of the Town of Southold Local Waterfront Revitalization Program and has
determined that the action is consistent provided that best management practices are
implemented; and be it further
RESOLVED, that the Southold Town Planning Board grant approval on the site plan prepared
and certified by Raymond W. Nemschick, Architect dated October 31,2006 known as A-2.01and
the building elevation plans labeled A-4.01, A-4.02, A-4.03 and A-4.04 dated October 31,2006
and authorize the Chairperson to endorse the final site plan with the following conditions:
1. If necessary, the applicant/agent/owner shall obtain certification from a design
professional for the existing septic system or approval from Suffolk County
Department of Health Services for the approved construction. This approval must
be to the satisfaction of the Southold Town Building Department. If the septic
approval changes from the approved site plan, the Planning Board reserves the
right to the review of a new site plan' application.
2. The owner, agent and/or applicant shall receive approval from the Southold Town
Landmark Preservation in the form of a certificate of appropriateness approving the
construction and submit such certificate to the Southold Town Planning
Department for review. If such approval varies from this approved site plan,
requires changes to the approved site plan, the Planning Board reserves the right
to the request a revised site plan.
3. The owner, agent and/or applicant shall receive approval from the Superintendent
of Highways on all work on the Town Right-of-Way on Cases Lane at the time of
construction. The owner, agent and/or applicant must notify the Superintendent's
office prior to the commencement of any work in the area.
4. The site plan approval requires that all work proposed on the site plan shall be
completed within three (3) years from the date of this resolution.
5. Prior to the request for the Certificate of Occupancy, the owner or authorized agent
must request the said Building Inspector and the Planning Board to perform an on-
site inspection to find the site improvements are in conformity with the approved
site plan.

6. If the as-built site improvements vary from the approved site plan, the Planning
Board reserves the right to request a certified as-built site plan detailing all the
changes.
7. Any changes from the approved site plan shall require Planning Board approval,
and any such changes without Planning Board approval will be subject to referral
to the Town Attorney's Office for possible legal action.
8. The Planning Board will issue a final site plan approval in the form of a letter
following a site inspection and at the time the site improvements are found to be in
conformance with the approved site plan.
As per the Town Code, one copy each will be distributed to the Building Department, Zoning
Board of Appeals and Town Engineer/Highway Department.
