words.
Mr. Edwards: i would just like to thank everybody for coming
and I would like to introduce the other members of my board. We
usually meet on Monday evenings, at the Town Hall in Southold.
I thought this was a significant crowd on Fishers Island mud I
would like people to ~De~k out when they ~et the chance. I
appreciate everyone taking the time off to come over here on a
Friday afternoon. On my far left, is Ritchie Lath~m, Bill
Mutlen, Chairman Ben Orlowski, Town Planner Va!erie Scopaz. One
member of our board is not with us today because he had a prior
commitment wi~h the Boy Scouts. He is very active with the Boy
Scouts. At this time ! think !~!l turn the meeting back to Benny
so we can open the hearing.
Mr. Or!owski: O.K., First order of business is the Plap~ing
Board would like to do a conditional Negative Declaration.
Valerie, would you like to read that?
Ms. Scopaz: O.K., as I'm sure you are aware that before the
board can act on the s~division map it has to do an
Environmental Review. Pursuant to Article VIII of the
Environmental Conservation laws the State Environmental Quality
Review Act and part VI of the New York State Conservation rules
and regulations part 617, section 617.10, Chapter 44 of the Code
Planning Board 2 '~m~e~ 14, 1988
of Southold. Notice is hereby given that Southo!d Town Plapming

as Walsh Park Benevolent Corporation is for an affordable
housing project of twelve lots on 24.33 acres,.approximately in
the cluster concept located at Crescent Avenue and Fox Avenue,
Fishers Island, Suffolk County Tax Map 1000-6-2-3.1. _n~ne project
is ~ot to have a sig~'~=~ effect on the environment for the
fei!owing reasons: the potential impact will ~ mitigated. The
identified impact in mitigation is as follows: First, the New
York State Department of Environmental Conservation commented
that (!) the project may have significant impact on a New York
State threatened species as a Osprey nest is located in the
vicinity's of the subdivision: The department requests t~mt any
construction related ~,~+~

be prohibitedbetween March !5th~ and August !~ and that a plan
depicting the location of the nest in relation to the building
envelope be submitted. The ~+~ ~ ~

nest site between March 15 and August I, this will be included
in covenants and restriction on the map before final approval is
granted. (2) Maps depicting the location of the osprey nest in
relation to the building envelope will also be submitted. (3) A
wetland re~aiated by the department pursuant to Environmental
Conservation law, Article XX1V, affixed on the.PrOperty west of
avenue being and south of Crescent Avenue. The department

the site plan~ ~so, that any disturbance within !00 feet'of
this line will require a permit from the department. The
mitigation that will address that concern are as follows:
The building envelope shall be shown as concomitant with the !00
foot buffer from the~wetlands line. {2) The landscape easement
shall prohibit any ~onstr .... on or land alterationac~v~ty*~,~
including clearance within !O0 feet of the wetlands. (3) That a
complete final assessment form be s~hmitted. This b~ been
comp!ied~with. A completed E~viroP~menta! Assessment form is in
thefile. (A) The department has no objection regarding the
housing project on the old dump site~ however they request the
following reservations: {a) no building shou!dbe built over the
landfill. Mitigation measures that address this are that all
the building set back lines shall be outside of the landfill
area and shall not. include the landscape easement area. The
!~udscape easement area will be over the landfill. (b) Bi-
annual sampling for methane be required to continue for two
years after people have homes built on tb~ =~ ~

information. (2) The Suffolk county Department of Health

inspection of the test holes on the site. Covenants for the
extension of public water, they believe that the presence that

primary concern to all involved, due to the potential migration
of methane gas a s~hs~nce on the site. The department suggests
that maps be s~bm~tted deleting the probable
the wetland area and that all building 1O~s be located outslde
the 01d l~ndfii1 area if possible. The mitigation ~ures that
address the concerns are (!) The !=_P. dfi!! will be delineated on
the.map, all the building envelopes will be located outside of
that-area. (2) The applicant witl provide public water to the
site and the same will be verified by providing contracts for
the eXtension of the main to the site. (3) Larry .Pe~y on behalf
of Southold Board of Trustees has advised ~hat the
representation of the wetlands as shown on the Casually, PaLmer
and King survey map that was revised on July 25th, 1988
accurately represents the line of pinkribhon tied in the field
earlier this year. He feels that the map can bedesignated, can
be designed based on current yield in such a way that the
wetlands will be protected while the lots and their building
areas will be sufficiently removed frem them. Mr. Peppy found
no endangered or threatened species or rare species of plants on
the site. However, the nesting osprey is a threatened animal
species. Mr. Penny also performed a test for methane gas on May
28th, 1988. When testing for lower explosion limit nothing
registered on the meter. When testing for par~.mi!lion
methane two readings were taken five minuues apart. The readings
were seventy- five parts per million and eighty parts per
million respectively. The P!aD~uin~ Board has re~aested all the
information mentioned by the different agencies and feels that
the plans in the cluster concept including all tP.e mitigauion
measures which I just mentioned will comply with all of the
above mentioned concerned~ ~e project will meet all the
requirements that the code of the Town of Southold subdivision
of land requirements.

~ Orlowski: We'll open the p~_blic hearing on the ~aestion of
preliminary approval for this major subdivision on 24.33 acres,
located at Fishers Island. This for a preliminary approval and
at this time everything is in order for a preliminary hearing
and I'll ask if there are any objections to this cluster
subdivision?
~r. Stanley: I reside at the corner of Avenue B =~d Crest Avenue
and I'm the president of the North Hill Association, a group of
app~oxLm, a~_~y twenty six ~=~4~= whose homes or properties join
or overlook the proposed Wa!sh Park development~ Since early
spring we have been in contin.~al comm~unication with the members
of our association ~ ~
r~ar~ng this proposed development and
members of our executive committee have also had frequent
discussions with Frank Baer, President and Mark Andrews, Vice
President of the Walsh Park Benevolent Corporation and I would
like to take this opportunity to publicly thank thom on behalf
of our association for their willingness to sit dew, with us an~
talk over our c~ncerns and their cooperation in making available
-to us the site plans as they evolved over these past few montb~.
Our discussions with Watsh Park involve two main concerns~ the
site plan for the developm~ent and the P;~--mber of units to be
~i!t On the property. As to the site plan, ~ am glad to be able
to state that the plsn which Watsh Park is presenting today has
~he approval cf those of our members who own property borderin~
or abutting the Wa!sh Park tract. We fee! the cu!rde-sac
arrangement provides both the quiet street for the residents and
a maximum area ~o be l~t as open space ~' ~ ; ~ ~ ~
~ ~- ~h-~h.&s~n the
pr~_m_e objectives of the cluster deve!opment~ As to the n~&~er of
houses we had hoped that this project might havebeen limited to
eight or ten unius rather than twelve units which is a catch 22
situation. On the one haD~d Fishers Island is attempting to slow
down the rate of new housing and on the other there is a need to
reverse the trend of h~ ~+ 4 ~
t~ d ..... n~sh~ng year around population by
providing affordable housing. If the Wa!sh Park project succeeds
in keeping people on the island or in attzactin~ new year~round
residents it will have been ,~* ~.~
w~h the loss of a portion of *~e
last large or one of the last large Undeveloped parcels on the
west~end. It is my personal feeling however, that Walsh Park and
perhaps ~D~O should now direct their ~= towards acq~diring
and renovating existing housing as it becomes available before
building newhOusing. Also, if some of the applicants will be
giving up rental units efforts should be made to acquire these
units for year re,mud tenants rather than having them taken over
by summer tenants. Our discussions with th~ Walsh Park
management also addressed the ~aestion on howbest to assure
that open space portions of the property will be .managed and
protected. I believe .we share a common desire that bbc portions
of the tract now used for street purposes or'house lots shall
remain basically in a .natural state as open space except perhaps
for some screening planted along Fox and Crescent Avenues and
the planting cf some natives shrubs ~nd trees in other areas to
enhance the nat~mra! character of the tract. We are also in
agreement that the open space areas are

not to be used for park or recreational p~poses but are to
remain essentially as wilderness land. I ~tnderstand Jo~n Clavin,
and you can correct me John, that in his presentation of the
project to the civic association 9n Satur~ay~ indicated that it
was planned to place conservation easements.on the rear portions
of the building lots and on the remaining portion of the total
tract as concerned neighbors we would like to offer our input in
drafting the necessary documents. In conclusion, ~ would like %o
thank Va!erie Scopaz and Me!issa Spire of th.e Southot~ Town
PleDging Staff for anSWering my many ~uestions over t~e past few
months. I also wish to express my thanks to the members of the
Planning Beard for taking the t~e to ccme over to visit the
~ site and for holding the hearing on Fishers Island. We are
naturally concerned that the project be carried out in
accordance with en~iro~mentai and zoning laws and that it be
done in an aesthetic manner. ~ feel that the development is off
to a good start with this site plan ~nd I ~ope the Planning
Board and Walsh Park management c~ proceed throu~ tP~e approva!
process as expeditiously as possible~ Thank you.
Mr. Orlowski: Are there any other objections to this
Subdivision?

John Clavin: Maving worked on this project for a year I can
assure the Planning Board that it is absolutely im_oerative that
we go ahead wi~h the project. It is the only p~oj.egt underway
now to maintain at least in this small way the population that
we have now and hopefully be able to build .i~ up. You've seen
all the documentation on the need for thisisland and ~qis is
the first step. We're tryin~ to get on ~he fast track to get it
~'~ possible and it is imperative that we go
finished as ~ ...... = as
ahead immediately with it. We th~nk the board for coming over
here, I think it is above and beyond and we certainly appreciate
it.
Mr. Orlowski: kuy other endorsements of this subdivision?
Frank Burgen: I~m the president of the Walsh Pazk Benevolent
Corporation'~ I certainly want to tha~ everyone for their
statements and for everyone's cooperation. I think we have made
a significant:effort over the Last eighteen months to have a
project that is responsive to the needs that I know we are all
aware of a~d that ~s: How do we make affordable owned housing
available to People'who want to live in this community and I
think we understand that this is a problem which is not unique
to Fishers Island but is being addresses in every resort on the
Eastern seaboard and Tn most places not successfully. I think
the reason that this will be successful, is that ~;e do have a
set of goals which cam. e out of the Trust for Public Land Report
and the growth plan which was endorsed by the vast majority of
people on Fishers Island- that said in effect that they wish to
see something done to at least stabilize if not enhance the size

of the year round popu!ation on this isl~o The statistics are
~p~ite compelling we have had over five hundred people living
here twenty years ago on a year round basis and we are u~der
three hundred today. It is easy to understand that there are
reasons beyond the fact that people can own or rent a home which
is not the only issue but it is an important issue. We believe
that the only way to address the multi-fold increase of the
price of housing on this island is to do something to subsidize
the year round population so they have an oppor~mity to live
and work on this island. We think it is important that this be a
year round island going forward as it has been in the past. We
have attempted to put together a project w~ch is not the only
solution, it is a project that will hopeful!y bethe first of
several things that will be done over time to address this need.
I am very sympathetic to the remarks they were made with respect
to the fact that 'we should have as a community an interest in
housing that already exists and try and capture that for year
round people. We should h~ve an interest in seeing that rental
property that does become available as a result of people moving
out of rental property and into these homes on the completion of
this project is either bought or made available to year round
residents and does not add to the summer stock, which is
something we are trying not to do as it was expressed. I fully
· endorse that expression. I can only say t~mt Walsh Park
Benevolent Corporation, which has a board of thirteen people
representing both Island and s-~,er People, feel very strongly
that this is not the last thing that this cooperation will be
involved in. We do have a ~ ~, ~
c~n .... u~ng need on-~h~s island. At ~
moment, I can assure you that we are fUlly engaged in trying to
raise a very unique project. I am not aware of any affordable
housing project which is being done in the manner we are ~Oing
here. This is one hundred percent affordable housing. This is
being subsidized by the contribution~ and efforts of the people
who live here in the s~m~,er and in the winter. It is not like
other affordable housing projects. As a result we have a private
· corporation. We are going to set our own rules, which are going
to be rules which are compatible with this co~,~unity and not
with some municipality or some government who does not know this
place and our needs and-requirements for this comm~n~ty. With
respect of the quality of what we are trying to do here, we do
not want the P!an~ing Board to do an~hing that is
extraordinary. We do not want to set precedences ~hat are going
to set the island up for difficulties. We have said from the day
one that we don't want special leave sLmply to do something that
benefits a~few~peeple. ,We thir~we do P~ve a project that is
c~mpatible with the laws and the property cf twenty four acres.
If we had wished to we could have maded an application for a
chan~e in zone.-That change of zone could have represented many
more houses and sites then we are talking about. I admit the
twelve sites is a lot, particularly given the desire to hold
down development here. As it relates to year round housing, it
is not a lot. And as it relates ~o twenty four acres, twelve
sites on two acres each, in effect~ it rea!!y...as you know from
the diagram of this property~if the law permitted we would have

had
twelve one half acre sites. Unfort?~ately, we have to have
twelve one acre sites. Our suggestion as the best way to deal
with the fact that we do have to, u~der the law, go to one acre
sites is to deed restrict half of each acre. Obviously~ if we
could have had a site plan that was different than this one, it
w~ld have been only that it would be half acre sites. We hope
and believe that what we have suggested here has the same effect

the base requirements for the applicants that will be going into
this project. We will attempt going forward to keep this
property. Even as these people leave Fishers Island, we hope
that through the maintenance of a list of peoD!e~:who are also
qualified by the WalSh Park Board, we will have follow up
f~mi!ies that will go into this house, i would hope that we
wo~uid have twenty five, fifty or one hundred years or more ahead
of us where these houses will remain in the year round housing
stock and not be flipped into the s ~e. r stock to further
exacerbate the problem that we are all aware of. That is too few
winter families and too m~ny summer families. AGain, I tb~nk the
Board, as John did, on behalf of the Wa!sh Park Board. We look

Mr. Edwards: My nmme'is.Ray Edwards. I think I ~m probably the
oldest residing citizen of the island~ I am talking about long
term resident. 'Yes, Bob and Emily. From the middle twenties to
the fortiesand~'back again, I never really left the Island. I
want tothaD_k the Planning Board for coming over for this
i~Port~nt hearing ~nd also want to sympathize with the North
Hill group. I know how they feel about their little section of
property out there. I r~mem~er ru~ning around there playing
cowboys ~4 Indians back in the early thirties. I reatty'want to
thank the Wa!sh Park Benevolent group for the hard work that
they hav~ done in securing the property and getting this thing
rolling against all of the stumbling blocks *~hat they have had.
I think it is the best thing that has happen to Fishers Island
in a long time. I have seen the decline of the residence going

the septic point and beach rock, we all sensitive to that.

We
will do anything we can to see that we minimize that problem. I
can't tell you today~ Maybe Tom or John can. We don't have plans
to do that. The need for it is obvio~ and it b~ to come from
some where. Do you have anything to add on tb~t Tom?
Mr. Doherty: Not anything long range. We have had a lot of
people ask about the septic systems. If we are going to 'have a
con~unity system or how we are going to arrange it~ We did plan
on having twelve separate septic systems, so that they all will
be on certain different parcels of l~nd. As far as the sand we
would not need itl It is loaded with sand, so we wouldn't have a
problem there. The gravel and beach stone, we are going to have
to eventually get it. Where we get it~ we will have to decide.
We have not gotten that far a long. Certainly we do not have any
surpluses in our budget that are going to enable ~&s to really
spend great sums of money for getting things of that nature. I
would imagine it would be expensive. I don't know. We will
certainly note your concern a~ud ! thiD~ it is a very good
concern. We will see what we can do to minimize it.
Mrs. Raferty: Thank you. ~at is becoming more and more of a
problem here on the island.
Mr. Doherty: I agree with you.
Mr. Or!owski: Just to add. This is a preliminary hearing. By the
time of the final hearing you will have to go~%o~theBoard of
Health and get all your approvals as'far as sewer and water. So
before the final hearing those comments shall be addressed. Any
other questions or co~ents?
Man from audience : I wonder if you can tell us What the process
is from here on out after this hearing. Where do you go from
here?
Mr. Orlowski: Well, we will not close this hearing today,
because of the conditional negative declaration and the
questions asked~ We will allow the applicant to finish the
impact stat~ent, answering these questions. At some point~ on
the island probably, at one of our meetings close this meeting.
From there the applicants will proceed with the Board of Health
and final maps and get ready for a final hearing. How ever long
the applicant takes is up to him. So, that is where it will go
from here.
Man from audience: Does the DEC review your SEQRA determination
of today?
Mr. Orlowski: We have a conditio~ai negative dec!aration~ ~_~b_.at

questions are answered then we will close this hearing. ~qd then
proceed from there to final.

Ms. Scopaz: Mr. Chairman if I-might clari~y that. All ~he Board
needs is for the mitigation meas,~es to ~ shown on the map.
When they approve it, it lines up with the conditional negative
dec. Since the applicant b~ not had a chance to respond to it,
what he is saying iS'that, he is giving them a chance to put ail
the information on the map so when they approve it it lines up
with the negative dec. All the mitigation measures will be
marked on the map, so once the map is filed that iP~ormation
will be there.
Man from Audience: Is that the preliminary map or the final map
that you refer to?
Ms~ Scopaz: _~b..e preliminary map. The final map will then be
proformer. In other wards the map will essentially be complete
and the final map will just be... we are re~aired to have
hearings on it. The second hearing will be.. the only
differencg, basically~ the one map says preliminary and the
other one says final.
Man from audience: Just one more question. I. sn't the final plat
a much more detailed one with showing the street and how the
curbs ~nd the location of septic systems and the rest of it?
~,~. Orlowski: Yes. This one is only pre!imina~y. A basic out
line of the project.
M~r. Doherty: Let me 3ust say on the subject of tb~ map that this
map has been adjusted once every two weeks on account of our
discussions and Jim Righters inputs and SWA's own ~etings and
b~nef~ those peop!e who don't know a little bit of
for the ~ ~* of
the back round. Chandler, Palmer, King will be the engineers for
this project. In order to get a little more attention and bring
some other parties to par on this site plan, Watsh Park hired
SWA Associates, which is a world wide consulting firm engaged in
this type of work. They are the s~me firm t~t is doing the
visibility on the bicycle path on the island. We asked them to
come to Fishers Island and to walk this property. We gave them a
set of crLteria~ All of the things that we felt that were

Mrs. Raferty: Is this the tLme to ask how much l~nd you plan to
have between each one of the homes? Are the houses going to be
long on the Quarter acre?
Las. Scopaz: The lots are one acre lots. The Pla~ming Board can
not cluster down to less then one acre lots. What this
particular plan shows is a l~ndscape easement or a conservation
easement. All the land that the landfill is on, if i can just
show you on a map. The landfill is in this general area here.
The wetlands are over here. This line here shows the one h,~ndred
foot buffer area. The building actually extends up to the wet
lands area but what the Board is saying is that *~his one hundred
foot line here. All the land between that line and the wetlands
will be covered by the prese~zation easement, which will
prohibit any development or clearing in *~hat area. Walsh Park
needs to go tothe DEC and get a permit, because -what they are
essentially saying is that they are willing to protect that
area. All the development will be out side that area. Even
though the lots are one acre lots, the building areas are
smaller, closer to an half an acre. S~me thing applies to all
these lots here. In effect that conservation easement will be a
permanent green b~ffer. It will prohibit clearing on this site
here. In fact, the cleared area will only be about half an acre
in area even though the lots are actually one acre in size.

Ms. Scopaz: Landscaping.
Mrs. Raferty: ~ we ~now how much land is ~tween each piece of

will have that.
Ers. Raferty: Side yard...
Ms. Scopaz: On a cluster subdivision the Planning Board'has the
right to reduce the yard area. Fcr instance, ordinarily on a two
acre piece of property the house has to be set back at least
sixty feet. Ina cluster they can be set back forty two feetl I
should mention that it.appears that ~st of the houses are set
back well beyond the minimum. It is not like everything is going
.to be right up to the road.
