AUGUST 30, 1988
The Southold Town Planning Board held a regular meeting on
Monday, August 30, 1988 at 7:30 p.m. at the Southold Town Hall,
Main Road, Southold.
PRESENT WERE:

Mr. Orlowski: I would like to bring this meeting to order.-First
order of business is Kings Bay Partners- Public hearing on the
the question of final approval for this minor subdivision. This
parcel is on 23.44 acres located at Orient. SCTM 91000-27-3-4~
We have proof of publication in the Suffolk Times and also in
the Long Island Traveler/Watchman. At this time everything is in
order for a public hearing. I will ask if there are any
objections to this minor subdivision? Hearing none, are there
any endorsements of this minor subdivision?

partnership and we thank the Board for their time and
consideration.

County Planning Co~m~ssion review of July 8, 1988. Board to set
Monday, September 12, 1988, at 7:30 p.m. for a public hearing on
the question of final approval for this lot line chmnge on Mm~u
Road at Mattituck. SCTM ~1000-114-11- 7.1 & 9. On the Suffolk
County comments they are all basically standard comments which
we have overridden many times before. What is the pleasure?

March 1988. This parcel is on 44.376 acres located at Southold.
SCTM ~1000-51-3-3. Everything is in order for approval. There is
a question on the drainage. Our engineer's have assured us that
everything is fine. Th~s is preliminary approval. What is the
pleasure of the Board?

Mr. Orlowski: Elijah's Lane Estates, Section 3- Board to m~ke
a determination on the preliminary maps on this major
subdivision, survey dated April 11, 1988. This parcel is on 18.2
acres located at Mattituck. SCTM $t000-108-4-7.1. One of the
questions we had was money or land for park and playground. I
think the Board is more in favor of money instead of land since
we do not know what happens with the land later on some times.
Also a question of swaled roads for both sections instead of
putting the drainage on to the...
Mr. Ward: I think we should let the engine~er evaluate the
recharge basin to see if it could be possibly deepened to
accommidate the increased capacity; then we could possibly
leave the curbs and paving just as it is on the other two
sections. I think that should be searched out first before we go
to the swales.
Mr. Orlowski: We definitely want to take the drainage out o~ the
open space?
Mr. Ward: Yes.
Mr. Hand: My name is Donald Hand, Berton ~nd Hand. I am the
engineer for the project. I understand you just said you wante~
to take the drainage out of the open space.
Mr. Orlowski: Yes.
Mr. Hand: What would you like to do with it?
Mr. Orlowski: We would like to see if that drainage that you
have there now is sufficient to carry the whole subdivision.
Mr. Hand: Do you mean in Section II or Section I?
Mr. Orlowski: Section I.

Mr. Hand: We did a study with Mr. Brown, yo~r engineer. He
determine that it was quite adequate but he determined that he
would also like.., the pitch is back. The way this thing is
built, the road pitches back. In talking with Mr. Brown we
dete~,ine that we can put a ponding area here. Using a series of
leaching pools. We have no problem with deepening it or to make
a regular recharge basin. The problem is once we get any deeper
we are going to have to put a fence up. Then it is going to
destroy the rural idea back in there.
Mr. Orlowski: I think you are also going to destroy that open
space that is left there by digging it out.
Mr. Hand: This is an over flow area sir.
Mr. Orlowski: Right
Mr. Hand: The water will only be here after the water flows
through. I believe there is like fourteen pools.
Mr. Orlowski: What we are saying is that if it can't be handled
by running back then maybe we can do it with a swaled system. We
would like to look into a way to do it and eliminate the
overflow going into the open space.
Mr. Hand: we have no problem with that. There are fifteen pools,
that is what they wanted, to dissipate all of the water that
came off the road. And if there was an owerflow, put it back
there. I think we called for all of the homes to have drywelts
and gutters. Will Mr. Brown get in touch with my office.
Mr. Orlowski: Yes. We will go over this with our engineer and
see if we can eliminate going into that open space at all.
Mr. Hand: That will be fine with um.
Mr. Orlowski: Alright. On the preliminary maps, what is the
pleasure of the Board? We can make it subject to review of the
drainage.
Mr. Ward: I think if we just leave it that it is to be
eliminated from the open space.

198~. Board to start the coordination process to determine lead
agency and environmental significance. This parcel is on 4.178
acres located at Mattituck. SCTM $1000-122-7-3. I will entertain
a motion to start the coordination process and determine lead
agency.

Mr. Ward: Also there is a significant drainage easement and
conservation easement making up for the preservation of land.
Ms. Scopaz: Right and that easement will prevent any use of that
portion of the property.
Mr. Ward: That they are concerned about.
Mr. Orlowski: O.K. Do you want to put ~hat in a form of a motion?
Mr. Ward: So move it if the girls can figure it out.
Mr. Orlowski: Maybe you better spell it out.
Mr. Ward: Move for an override of the County memo dated August
4, 1988 accepting items 2,3,4 & 6 and that a conservation
easement and drainage easement will be provided in the attached
sketch that we give them. In other words we will draw it as to
where we prefer to see it.
Mr, Orlowski: We will work on that easement at our next work
session. I don't think the applicant had a problem with that.

Mr. San Andres: I am not sure that I am following this. Are you
saying that you are accepting one, five and seven. Then two,
there happen~ to be a Lilco easement, Mill Road and Mill Lane. I
think would prevent this. I don't know what size radi,~.~.
Ms. Scopaz: That is at the intersection of Mill Road, when you
are going north on Mill Road and you are turning left at that
little triangle.
Mr. San Andres: That is right.
Ms. Scopaz: They jnmt want a little taking to even out the
turning radius. That is all they are ~king for.
Mr. San Andres: O.K. Three, that would be in covenants and
Restriction.
Mr. Orlowski: It would be. The County recommends that we are
going to keep this. The other thing is to work out an easement
over the property. The Board will take a look at that in the
field and also at our work session and get back to you as to
where we would like to see it.

that we all agreed that there is a problem with the layout. To
grant an extension would just be wasting both our time and

Mr. Orlowski: Fishers Island Country Club- Board to make a
determination on this site plan, survey dated and amended July
30, 1988. This parcel is located on Fishers Island.
SCTM $1000-4-4-9.
Mr. Ward: I move for approval. I just would make it subject to
the grading and drainage being contained on site. There is no
definitive, there is so much property that there is no real
definitive answer as to how they are h~ndling it.
Mr. Edwards: I am sure there will be no problem with it.
Mr. Ward: They are going to do a good job but it is not shown on
the plan.
Mr. Edwards: We did not ask for that on the first revision, I
think it would be unjust to ask them to redo another site plan.
I will make sure that they do.

Mr. Orlowski: Arthur Jun~e- Boazd to reco~end the issuauce of
a Certificate of Occupancy by the Building Department subject to
a one year review by the Planning Board. SCTM $1000-96-1-19~ It
needs some additional curbing by the south side entrance,
parking area and all sides of the parking tot and the back
should be seeded as per our inspection report today. Otherwise,
everything appears to be in order. You were out there Mr.
Edwards?
Mr. Edwards: Yes.
Mr. Orlowski: What is the pleasure of the Board?

Mr. Orlowski: O.K. We just have one more item on the agenda,
Filing of maps. There seems to be a discrepancy on policy or a
misunderstanding in our policy. Section 335 of the Real Property
Law requires that all subdivision maps be filed. The Planning
Board as of tonight, August 30, 1988, will re~ire that 2 mylars
and 4 paper prints with Health Department approval, be submitted
for the Chairman to endorse at the time of final approval. After
the maps are signed, 2 mylars will be returned to the applicmmt
to be filed with the County Clerk's office in Riverheadwithin
thirty (30) days of the Chairman's signature. One of the filed
mylars must be returned to the Planning Board office along with
seven (7) paper prints of this mylar.

the Board it was Benny's birthday yesterday, I wish h~m a happy
birthday. I bought him a little gift from Fishers Island that he
can stick on his belt bag so he know were he is going.
Mr. Orlowski: Thank you. I would like to mention that Joan is
leaving us. Tomorrow is her last day. We are going to miss her.
She has done a find job. She is going to real job. Watch out for
all our children ~nd grandchildren that she will be teaching.
