Fomr 6002 • Bargain antl Sab Deetl. with Covenant agahrat Grantor's Acls -Uniform Acknowledgment ~.~~ Form 3280 CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT•THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the ZS day of October, 2006 BETWEEN FRANK CORDASCO AND MONIOUE CORDASCO, husband and wife. residing at 40 West 77'" Street, Apt. 56, New York, New York 10024, party of the first part, and PAUL RAGUSA AND CHERYL GOLD-RAGUSA, husband and wife, residing at 322 West 72ntl Street, Apt. 14A, New York, New York 10023, party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)-Dollars, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, situate, lying and being at Horton's Point, near the Village of Southold, in the Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a concrete monument set at the southerly comer of land of Henry McCabe and on the northwesterly line of a 50 foot strip of land hereinafter described as right of way; RUNNING THENCE along the northwesterly line of 50 foot strip of land South 31 degrees 30 minutes West 125.77 feet to a concrete monument and land formerly of Walter E. Hyatt, now of Burns; RUNNING THENCE along said land on a line parallel to the southwesterly line of said land of Henry McCabe and 125 feet therefrom, measured at right angles thereto, and passing through a concrete monument at the top of the bluff, North 64 degrees 50 minutes West. 461.70 feet to the mean high water mark of Long Island Sound; RUNNING THENCE along said mean high water mark, North 30 degrees 00 minutes East 125.45 feet to said land of Henry McCabe; RUNNING THENCE along said land and passing through a concrete monument at the top of the bluff, South 84 degrees 50 minutes, East 465 feet, to the point or place of BEGINNING. , TOGETHER WITH the benefits of a certain easement of right of way set forth in insVument dated 4/23/58 between Wafter E. Hyatt and John A.C. Warner and Marian A. Warner, his w'rfe, recorded 5/13/58 in Liber 4459 page 504, which right of way is set forth in the survey of Otto W. Van Tuyl & Son dated 517/58; TOGETHER WITH a right of way over said 50 foot strip of land along the first course above described and thence in a general southwesterly direction about 730 feet to a certain 20 foot strip of land; RUNNING THENCE over said 20 foot strip of land, in a general southeasterly direction, about 500 feet to the southwesterly boundary of land of said Hyatt; RUNNING THENCE over the existing roadway in a general southerly direction to Sound View Avenue, and as further described below; ALL that certain plot, piece or parcel of land, situate, lying and being at Horton's Point, near the Village of Southold. in the Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a concrete monument set on the northwesterly line of a fifty (50) foot wide right of way 'Hyatt Road' at the northeasterly comer of land now or formerly of Arthur Leudesford, Frances Leudesford and Carrol Grimes; RUNNING THENCE North 84 degrees 50 minutes 00 seconds West along said last mentioned Isnd, 380.25 feet to the apparent high water mark of Long Island Sound; THENCE along said high water mark of Long Island Sound on a tie line bearing North 29 degrees 49 minutes 42 seconds East, a tie distance of 100.33 feet to land now or formerly of Arta A. and Julie A. Carnevale; THENCE South ti4 degrees 50 minutes 00 seconds East along said last mentioned land, 398.52 feet to the northwesterly line of Hyatt Road; J r.. ~ THENCE South 31 degrees 30 minutes 00 West along said northwesterly line of `Hyatt Road". 125.77 feet to the point or place of BEGINNING. TOGETHER with all right, title and interest, tf any. of the party of the first part in and to any streets and roadg abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word 'party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
