THIS INDENTURE, made the 14"' day of October, Two Thousand Four
BETWEEN
ROBERT A. GOELLER and JANE P. GOELLER, his wife, residing at 349 Ridgccrcst Drive,'
Santa Barbara, California 93108
party of the first part, and
ROBERT A. GOELLER, Ill, residing at 168 Highland Avcnuc, Rowayton, Connecticut 06853
and ..
PATRICIA KIRKPATRICK, residing at 73 Strikland Road, Cos Cob, Connecticut 06807,
party of the second part,
WITNL•SSETH, that the party of the first pan, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second pan, the heirs or successors and assigns of the parry of the second part forever, a
2% interest in and to
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Nassau Point in the Town of Southold, County of Suffolk
and State of New York, known and designated on a certain map entitled, "Subdivision Map
Pcconic Bay Properties, Inc., situate on Nassau Point, Peconic" and filed in the Office of the
Clerk of the County of Suffolk on April 15, 1931 as Map No. 786, as pan of Lot 9 (being all
of said Lot 9 except that portion thereof included in the convcyattce made by Howard C. Bigg
and Matilda Bigg, his wife, to Jane P. Gceller dated June 14, 1967 recorded in the Suffolk
Counry Clerk's OClice on June 22, 1967 in Liber 6172 of conveyances at page 182), and the
easterly 30 feet of Lot 27.
Said part of said Lot 9 herein conveyed, being bounded and described as follows:
BEGINNING at a point on the southerly line of Haywatcrs Road distant 520 feet westerly
measured along the southerly line of Haywaters Road, Crom the corner formed by the
intersection of the southerly line of Haywaters Road with the westerly line of Landing Road;
RUNNING THENCE South 28 degrees 40 minutes 50 seconds West along the division line
between Lots 8 and 9 on said map 230 feet to the ordinary high water mark of Cutchogue
Harbor at the southeasterly corner of the premises herein de~ribed;

THENCE westerly along the said high water mark to the division line between Lots 9 and ]0
. on said map at a point distam North 55 degrees 39 minutes West 78 feet from said
southeasterly corner of the premises herein described;
THENCE along the easterly line of land now or formerly of Jane P. Gceller, the following five
courses:
1) Noah 31 degrees 55 minutes 20 seconds East, 117.10 feet;
2) South 58 degrees 04 minutes 40 seconds East, 7.28 feet;
3) North 35 degrees 49 minutes 30 seconds East, 40.00 feet;
4) North 58 degrees 04 minutes 40 seconds West, 10.00 feet; and
5) North 31 degrees 55 minutes 20 saronds East, 73.00 feet to the southerly line of
Haywaters Road; and
THENCE South 54 degrees 50 minutes 10 seconds East along the southerly line of Haywaters
Road 65 feet to the poim or place of BEGINNING.
TOGETHER with 2% of the right, title and interest of the party of the first part of, in and m
the lands under water known as Cutchogue Harbor in front of and adjacent to the above
described premises. ,

The easterly 30.00 feet of said Lot 27 on said map being bounded and described as follows:
BEGINNING at a point on the northerly lira; of Haywaters Road a[ the division line between
Lots 27 and 28 on said map;
RUNNING THENCE North 54 degrees 50 ntintttes 10 seconds West along the northerly lice
of Haywarers Road 30 feet;
THENCE North 35 degrees 09 minutes 50 seconds East, 125.00 feet, more to less, to the
ordinary high water mark of Haywarers Cove;
THENCE easterly along said high water mark 30 fee[, more or less, to the division line
between Lots 27 and 28 on said map; and
THENCE South 35 degrees 09 minutes SO seconds West along said division line 133 feet,
more or less, [o the point or place of BEGINNING, the easterly and westerly lines being
parallel and thirty (30) feet span.
TOGETHER with 2 % of the righ[, title and interest of the parry of the first part of, in and to
the lands under water known as Haywarers Cove in front of and adjacent to the above
described premises.
BEING AND INTENDED TO BE the same premises conveyed m the party of the first party
by deed dated May 3, 1968 and recorded on May 3, 1968 in the Office of the Suffolk County
Clerk in Liber 6344, Page 587.

TQ6ETHI=R wick all right, licit and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETIiER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Lew, covenants that
the party of the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any pan of the total of the same for any other purpose.
The word "parry" shall be construed as if it read "parries" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first pan has duly executed this decd the day and
year first about written.
