~sla~d Schoolhouse on Friday, April ~, 1952, to Consider the Petition
and mto hear all persons interested in establishing a Refuse and
Garbage District at Fishers Xsland. Present were Supervisor Klipp;
Justices Terry~ Tuthill, Clark and Edwards; Superintendent of High-
ways Price; Town Attorney Terry and Town Clerk Booth.

by iLaW. supervisor Klipp opened the hearing at 9:30 o'clock A.M.

RESOLUTION OF SOUTHOLD TOWN BOARD APPROVING THE ESTABLISM~'
OF A REFUSE AND GARBAGE DISTRICT AT FISHERS ISLAND IN THE TOWN
OF SOU_~X4OLD~ SUFFOLK COUNTY~ NEW YORK.
WHEREAS~ a petition for the creation of a refuse and garbage
diS. t~i¢~ ~e be known as the Fishers IslandRefuse and Garbage
District in the Town of Southold, Suffolk County. New York. the
said ~etition being dated August'21, 1~51, was ~ly presen6ed to
this Town Board~ and
WHEREAS~.an order was duly adopted by' the Town Board on March ll~
19~2~ reciting the filing of said petitio~ the improvements
proposed, thelboundaries 6f the proposed ~trict, and the estimated
expenses thereof and~specify~ng ~pril ~, 1952 ~ 9:30 o'clock A.M.
as tke time and the Fishers ~slan~ Schoolhouse in said Town as the
place where the said Board would meet to consider the petition
and.to hear all persons interested in the subject thereof~ con-
cerning the aame~ and
WHEREAS, such order was duly posted~ published and served as re-
quired by law~ and
WHEREAS, a hearing in the matter was duly held by the Board on this
f April~ 19~2: commencing at 9:30 o'clock A.M.~ at the
Fi~ sland Schoolhouse in said Town, and considerable discussion
upo~ the matter having been had~ and all persons desiring to be
heard~
Now~ upon the evidence given such hearing, and upon motion of~
Justice E. ~erry Edwards and seconded by Justice ~enry A. Clark,
it is

quirements of Section 191 of the Town ~aw as to sufficiency of

The boundaries herein described are intended to coincide with the
present boundaries of Fishers Island, in the Town of S0uthold~
Suffolk County~ NeW York; and it is fUrther
RESOLVED: that the proPosed improvement., including the Cost of con-
struction work~ acquisition of the necessary land, l~'gal fe~s and all
other expenses, sh~ll be financed by the issuance of bO~d~':~r other
evidence of indebtedness pursuant te the provisions of the Local
Finance Law of said TownwhiCh shall be a charge upon said District
in a sum mot to exceed :$%~,O00~
And it is further
RESOLVED: that the Town Clerkof this .Town shalI within ten days after
the adoption of this resolution file certified copies thereof in dup-
licate in the office of the State Department of Audit and Cgntrol at
Albany, New York~ together with am application by this Boar~ in dup-
licat~ for permi~sio~ t° icreate such district as provided for by Town
Law~ Section 19~; and that s~Ch.application shall be execute~ by and
in behalf of the Town Board by the supervisor of the Town.
