BARGAIN AND SALE DEED WITH COVENANT
THIS INDENTURE made the 8'" day of April, 2005, between Robert Feger and Teresa Taylor, his wife,
residing at 5370 Nassau Point Road, Cutchogue, New York, party of the fIrst part, and Paul Foster and Stephanie"'.
Marinelli, his wife, residing at 203 Crestwood Drive, South Orange, New Jersey, party of the second pan.
WITNESSETH, that the party of'the flISt pan, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second pan forever,
ALL THAT CERTAIN PLOT, PIECE OR PARCEL OF LAND, WITH THE BUILDINGS AND
IMPROVEMENTS THEREON ERECTED, SITUATE, LYING AND BEING IN THE TOWN OF SOUTHOLD,
COUNTY OF SUFFOLK. STATE OF NEW YORK, AS MORE PARTICULARLY DESCRIBED ON
"SCHEDULE A" ANNEXED HERETO.
BEING AND INTENDED TO BE THE SAME PREMISES CONVEYED TO THE PARTY OF THE
FIRST BY DEED FROM LEON H. THOMAS DATED 5/4n9 AND RECORDED IN THE OFFICE OF THE
CLERK OF THE COUNTY OF SUFFOLK ON 5/9n9 IN UBER 8622 PAGE 463.
Together with all right, title and interest, if any, of the party of the flISt pan in and to any streets and roads
abutting the above-described premises to the center lines thereof; together with the appurtenances and all the
estate and rights of the party of the fIrst pan in and to said premises; to have and to hold the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second pan
forever.
And the party of the fIrst part covenants that the party of the flISt part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid:
And the party of the flISt part, in compliance with Section 13 of the Lien Law, covenants that the party of
the fIrst pan will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied frrst for the purpose of paying the cost of the improvement and will
apply the same fIrst to the payment of the cost of the improvement before using any pan of the total of the same
for any other purpose.
The word "party" shall be construed as il is read "panies" whenever the sense of this indenture so
requires.

ALL that certain plot, piece or parce I ofland, situate, lying and being at Nassau Point, Town
of Southold, County of Suffolk and State of New York, known and designated as and by part of Lot
144 on a certain map entitled, "Amended Map A of Section A, Nassau Point Club Properties, Inc.,
situate at Nassau Point, Suffolk County, New York, surveyed June 21, 1919 by Halsey & Van Tuyl,
C.E., Greenport, New York" and filed in thE: Office of the Clerk oftbe County of Suffolk on August
16, 1922 as Map No. 156 said plot being more particularly bounded and described as follows:
BEGINNING at the comer formed by the intersection of the westerly line of Nassau Point
Road with the northerly line of a 25 foot road known as Little Peconic Bay Road, and from said
point or place of beginning;
RUNNING THENCE South 78 degrees 36 minutes 20 seconds West along the northerly
line of Little Peconic Bay Road, a distance of276.50 feet to land now or formerly of Diekmann;
THENCE North 5 degrees 23 minutes 40 seconds West along said last mentioned land, a
distance of 124.58 feet to land now or formerly of Watson;
THENCE North 78 degrees 36 minutes 20 seconds East along said last mentioned land, a
distance of283.29 feet to the westerly line of Nassau Point Road;
THENCE southerly along the westerly line of Nassau Point Road, Soutb 02 degrees 19
