THENCE South 78 degrees 36 minutes 20 seconds West along the northerly side of Little
Peconie Bay Road, 358.02 feet to the corner and the point of place of BEGINNING.
Subject 10 the rights of the now owners of Lot 34 on . Amended Map A of Nassau Point,
owned by Nassau Point Club Propenies, Inc., situate in the Town of Southold, Long Island,
NY". surveyed June 28. 1922, by OtlO W. Van Tuyl, C.E. Surveyor, Greenport, NY, and
filed in the Office of the County Clerk of Suffolk County, NY, August 16, 1922, File Number
156, their heirs, successors, assigns and agents to enter upon the subject property for the sole
purpose of maintaining and painting thai portion of the Two-Story frame building with garage
below that encroaches upon the subject property.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated 12/30/96 and recorded 1/15/97 in the OffICe of the Suffolk County Clerk in Liber
11811, Page 270; by deed dated 1129/97 and ret.'Orded 3/21/97 in the Office of the Suffolk
County Clerk in Liber 11821, Page 705; by deed dated 1129/98 and recorded 3/9/98 in the
Office of the Suffolk County Clerk in Liber 11882, Page 175; and by deed dated 2/26/99 and
recorded 9116/99 in the Office of the Suffolk County Clerk in Liber 11989, Page 489.
TOGETHER with all right, title and interesl, if any, of the party of the first part in and to any
streets and roads abulling the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first: part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or suceessors and assigns of the pany of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment I)f the cost of the
improvement before using any pan of the total of the same for any other purpose.
The word "party. shall be construed as if it read "panies" whenever the sense ()fthis indenture so
requires.
