THIS INDENTURE made the }~y of September two thousand and four

party of the first part, and
DAVID W. BOSCOLA and DONNA M. BOSCOLA, his wife, residing at 5106 West
Mill Road, Mattituck, New York 11952
party of the second part,
WITNESSETH, that th party of the first part, in condiseration ofTen Dollars pBid by the
party of the second part, does hereby remise, release and quitclaim unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel ofland, together with the buildings and improvements
thereon erected, situate, lying and being at Mattituck in the Town of Southold, County of
Suffolk, State of New York, more particularly described on
ATTACHED SCHEDULE A
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances, and also all the estate and rights of the party of the
first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment
of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

,ALL that certain plot, piece or parcel of land
situate, lying and being at Mattituck, Town of Southold,
Suffolk County, New York being more particularly described as
follows:
BEGINNING at a point located at the southwest corner
of a parcel of land conveyed to William Boscola Jr. (the
"William Boscola Parcel") by deed from Mattituck Holding Co.,
Inc. dated February 17, 1971 and recorded in the Suffolk
County Clerk's Office on March 11, 1971 in Liber 6S9S at Page
92 (the "William Boscola Deed");
and from said point of beginning, thence, South 110
50' 00" West a distance of 20 feet;
Thence, South 7So 10' 00" East a distance of 200
feet;
Thence North 110 50' 00" East a distance of 20 feet
to the southeast corner of the William Boscola Parcel;
Thence, along the southerly boundary of the William
Boscola Parcel, North 780 10 I 00" West a distance of 200 feet
to the point or place of beginning.
Together with a right-of-way for all ordinary
purposes of ingress and egress over the property described in
the William Boscola Deed as constituting a right-of-way for
the benefit of the William Boscola Parcel.
