State of New York 1952: and the Southold Town Ordinance en-
titled "REGULATING AND THE PLACING OF OBSTRUCTIONS

Emergency Storm Damage Permit to reconstruct 6 footings,
replace fireplace, repair skirting and stairs, as per DEC
Beach to be planted with non-turf, non-fertilized species.

NICHOLAS D. YUELYS being duly sworn deposes and says:
That he is the owner of the Yuelys house which is located on
the west side of Atwans. That he makes this affidavit support of the
application of Atwan to repair the existing jetty that is located on
her property and to verify that it was built before the Town required
permits and that the present application is an inkind/inplace
repair/replacement of a functional jetty.
The background of this jetty follows: In 1975 erosion had
destroyed more than 40 feet of beachfront property in front of the
homes beginning with the Atwan property and the 3 homes to the west up
to the Dietrich property which was protected by a small groin or
jetty. The reason being that the protected property on the east had a
natural jetty which d~scribed an arc eastward and the apex was
directly on the property of Yuelys. At that time the HWM was less than
10 feet from the Yuelys house. Attached hereto as Exhibit A is the
news item from the Suffolk Times dated February 13, 1975 wherein the
Town Board was made aware that the application for the construction of
the jetty since plans were submitted to the Town Board. Exhibit B
shows the permit issued 5/1/75 for its construction. Exhibit C shows
part of the checks in payment to the builder, Irving Latham, by
deponent. Exhibit D show the completed jetty after the storm of 1978.

At a meeting of the Southold Town Conservation Advisory Council held Monday,
February 26, 1996 the following recommendation was made:

The Council TABLED the Amendment to Permit request of CATHERINE
ATWAN aA-l-20 to stabilize and repair existing jetty by use and add
approximately 10 rocks as in the DEC permit and to set back existing stones
that were moved.
The Council tabled the request until more information is supplied. The
CAC does not know what the original permit allowed. A full permit may be
required depending on what the past permit actually permitted.

The permittee is responsible for obtaining any other permits, approvals, lands

9 That if future operations by' the State of New York require an al-
teration in the position of the structure or work herein authorized, or
if, in the opinion of the Department of Environmental Conservation 13
it shall cause unreasonable obstruction to the free nawgation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by he Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavauon, or other
modification of the watercourse hereby authorized shall not be corn- 15
pleted, the owners, shaH, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former ~ondition the navigable

any portion of the uncompleted structure or fill and restore the site

During construction, concrete or leachate shall not escape

trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas. :
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
The storage of construction equipment and materials shall be
confined to within the project work site and or upland areas
greater than 50 linear feet from the tidal wetland boundary.
All fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).

The follo~ng conditions appl~ to all Tidal Wetlands; Fresh~ate~
wetlands; Coastal Erosion Management; and Wild, Bcenic, and
Recreational Rivers Permits~
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.

If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.

At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.

The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

Sanford of the NYSDEC and she said they are processing your

NICHOLAS D. YUELYS being duly sworn deposes and says tha~ he
is the joint applicant with CATHERINE L. ATWAN described in the above
application and makes this affidavit in support of the request for an
amendment to the permit issued on Septemenr 28, 1995. CATHERINE L.
ATWAN is the owner of the property on the East of deponent and
together with CANDAN and LASKOS, who own the properties on the West of
deponent, made the ori.ginal application for for which an amendment is
requested.
The special conditions issued with the permit state that no
new rocks may be added (No. 1) and special condition No. 2 states that
rocks from the surrounding area may not be utilized which we believe
to be a typographical error. Deponent upon receiving same contacted
the Department and was informed you did not request to add rocks and
therefore deponent wishes to amend the permit because of this
oversight.
Ail the following pictures referred to herein were taken on
October 19, 1995 by deponent. Ail the pictures were taken at extreme
Low Tide.
Picture No. 1 was taken to show the existing rocks below the
high water mark. The rocks are numbered 1, 2, 3, and 4 (No, 4 is
really two rocks). Th y~are irregular in shape and their dimensions
in inches are:

Rock No. 2:42x37x36
Rock No. 3:54x44x26
Rock No. 4:17x34x22
and 46x41x26
Picture No. 2 shows the open stretch of beach which needs
rocks between the high water mark and rock No. 5 a distance of
approximately 12 feet.

Picture No. 3 shows the open stretch of beach from rock no.
5 back a distance of about 20 feet which needs rocks. The rocks in the
background were accumulated by the next door neighbor when he built
his stone bulkhead and we believe they were ours but are now gone.
Those rocks are all on the property of the next door neighbor.
Picture No. 4 and picture no. 5 are for information as to
what we have said above. Pictures No. 6 and 7 are the approximate size
of the rocks we request for replacement in the jetty.
Picture 8 shows the necessity for the rocks to save our
homes. The jetty had saved us up to now but we still suffered
extensive damage. It cost depoent over $30,000.00 to repair in 1991
and if we did not have the jetty the house would have been washed away
Though it is only a drop in the bucket fighting erosion, and
deponent being a retired professional engineer is well aware of what
might be considered a waste of money, deponent is also the grandfather
of 8 grandchildren and the oldest is 7 who enjoy the home and thus
deponent wishes to fight to save the house as long as possible. This
project may only be a stopgap in the relentless struggle against the
water but it gives everyone a chance to enjoy the beach as it was and
noone in the process is hurt by this small groin.
WHEREFORE IS REQUESTED that an amendment as to special
condition no. 1 be issued to be able to add approximately 10 rocks
similar in size as to the existing rocks to replace the lost and
former rocks in order to repair the jetty and to correct the
typographical error in special condition no. 2
