THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAl. POWER OJ'
APPOINTMENT, exercisable as often as thL'Y may choose. 10 change their remainderman as
follows:

TO or among anyone or more members of a class consisting of the party of the first pan's
descendants, in any degree, whether presently living or born hereafter, in such proportions aiKI
amounts, without regard to equality. outright or in trust. as the party of the first pan may
direct aOd appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to death, making specific reference to this power of appointment. The
pany of the first part may not appoint themselves, their estates, their creditors or the creditors
of their estate, under any circumstances.
THIS DEED IS AN EXERCISE OF THE SPECIAL POWER OF APPOINTMENT
contained In a certain prior deed in respeel to the above-deseribed premises dated July 17,
1997, recorded in the Suffolk County Clerk's Omce on Augullt IS. 1997, in Liber 11846,
Page 795; and it 1.\ further stated that the party of the fint part continues to reserve tbe
legal life estate as set fortb in the aforementioned deed. as well as ber reservation of her
special power of appointment set forth therein,
TOGETHER with all right. title and interest, if any. of the pany of the first pan in and to any
streets and roads abutting the above described premiscs to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the pany of the first pan in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the pany of the St.'COnd
pan, the heirs or successors and assigns of the party of the second pan forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
an}1hing whereby the said premises have been encumbered in any way whatever, except as
aforcsaid.
AND the pany of the first part, in compliance with Section 13 of the Lien Law. covenants that
the party of the first pan will receive the considcl"'dtion lor this conveyance and will hold the right
to rccciw such consideration as a trust fund to be applied first for the purpose of paying the COSI
of the improvement and will apply the same Iirst to the pa}'TI1ent of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "pany" shall be construed as ifit read "panies" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first pan has duly executed this deed the day and year
