Moore Secretary November 8, 1991 Southold Town Trustees Southold Town Hall Main Road Southold, NY 11971 Re: Argentieri permit / Jahn / Egan Dear Town Trustees: I am writing to advise you what action has been taken to date in an attempt to resolve the issues surrounding the use of the dock and the right-of-way and to provide a proposed course of action which may provide an acceptable solution to the problem. As you will recall, the Argentieris were issued a permit for the catwalk assembly in the right-of-way with a permit issued by your Board solely in their name. This past summer, other property owners obtained your consent to amend the permit to add additional owners. At that time, however, it was not known how many other property owners may have rights to the right-of-way as well. Our title work indicates that at least nine property owners have rights to the right- of-way. These rights are set forth in the last deed of record to each of these nine owners. There may be, in addition, other property owners who have obtained rights to the right- of-way by continued use over time even though their deeds do not reflect an express right to this right-of-way. I suggested by letter to Lynne Gordon, the attorney representing the Argentieri family, that we contact each of the property owners who appear to have a right to this right- of-way. I suggested then that we obtain their consent to the continued presence of the catwalk and dock, an indication of their interest in using and maintaining same, and their willingness to join an incorporated homeowners association to accomplish this. I believe that if this is accomplished, the problem facing the various property owners and the Trustees can be resolved satisfactorily. I will be away on vacation the week of November 11th and will be unable to attend your meeting. However, Thomas Moore, who is of counsel to our firm, can be available if necessary for that meeting. I feel that if your father were alive today, ,he would have agreed to a mutually satisfactory resolution of the situation. He did so with Andy Pitre, permitting him docking privileges in return for routine repair and maintenance of the dock. e Actually, in this case, one of the prospective buyers even offered to build the ramp and float needed to make the dock suitable for boat usage. However, you didn ' t want to "get involved" and would not even discuss the, proposal with him. As you know, we did not hesitate a moment to comply with your request for whatever back-up you needed before the Board of Trustees when you had the dock problem with the Laskins . As requested, we have never discussed the dock situation with your mother (after the initial conversation with both of you ) and Evelyn and I will continue to do anything we can any time she may need assistance . Relative to the right-of-way, we would appreciate your honoring your promise to remove the old float that was left on the beach _ when the rest of the old dock was taken away. It certainly detracts from the appearance of the beach section of the right-of-way and makes a poor impression on a prospective purchaser . Box 248 East Moriches, NY 11940 Dear Cookie: As you probably know, I have spoken with your mother and Carole with regard" to some kind of agreement on the use of your' dock by a future 'owner of our property here at No. 595, which has a deeded right-of-way to the water. Carole promised to get back to me with an answer but, so far, I have heard nothing. Now, your mother tells me that you and Al are in charge of any arrangements regarding the dock. The situation is this : Most of the prospective buyers are interested in access to the water, which they would have over the right-of-way (as written in the deed) . The problem is that the dock obstructs that access and I have been asked to find out what kind of a deal can be made with regard to its use. One couple would like to have a boat there and have asked• if they could buy or rent the use of the dock. I indicated that I didn't know if that would be agreeable to you or if they could build the ramp and float and then share in any ongoing expenses . In any event, the realtor would like the opportunity to sit down and discuss the possibilities with you as soon as possible so that he can then advise his clients. In particular, , the one couple just mentioned who are holding off any decision about the property until they get an answer to the dock question. I would greatly appreciate it if you and Al would ,consider your options and advise me when you would be prepared to talk with the realtor to discuss a mutually satisfactory agreement. Therefore, the Town Board declares that the regulation of the wetlands of the Town of Southold is essential to the health, safety and welfare of the people of the Town of Southold. § 97-12. Exceptions. A. The provisions of this chapter shall not affect or prohibit nor require a permit for the following: (1) The ordinary and usual mosquito control operations conducted by any public authority. (2) The ordinary and usual operations incidental to the cultivation and/or harvesting of fish and shellfish.' Clerk ' ELING PERMAUMBER INFOI____TION • There are two basic reasons for numbering docks , bulkheads, moorings, stakes, etc. in the inland waters of Southold Town. 1. Should some emergency or need to locate a certain structure or mooring, the permit number clearly visible will enable the Bay Constable or others to locate the area. 2. Each visible permit number displayed shows that you have followed the procedure necessary for that particular structure or mooring. Those who do not have a number will warrant investigation. PERMIT NUMBER INSTRUCTIONS (How to do) Numbers should be at least 3" high and printed in contrasting black and white. DOCKS AND BULKHEADS The simplest way is to use a piece of board painted black with the required 3" white letters painted on it. This then could be nailed to the seaward side of the structure so it can be seen from the land or the water. MOORINGS Suitable size letters should be painted on the area above water for easy identification. STAKES - PULLEY LINES Numbers can be painted right on the stake or on -a board which then can be attached to the stake. Your cooperation is greatly appreciated.
