The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WHEREAS, ANTHONY M. PETRILLI applied to the Southold Town
Trustees for a peri, it under the provisions of the Wetland
Ordinance of the Town of Southold, application dated August 12,
1994.
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
NIGOGOS ARAIAN to attache a ~0' X 30' wooden deck and
construct a 60' bulkhead 6' high and a 4' X 8' set of stairs
from bulkhead to beach. Located 54365 County Road 48, Southold
NY 11971. SCTM # 52-1-7
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

It is my/our understanding that we are to maintain this
structure with materials designed to endure 30 years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands. We further understand that failure to
maintain the structure could result in a requirement to post a
bond and or have the repairs ordered as a lien against the
property upon a finding by the Trustees that said lack of
maintenance would risk life, property or important natural
resources features including protected, rare or threatened

RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Unlisted
DESCRIPTION OF ACTION: Applicant requests a Coastal Erosion Permit
to attach a 30' X 30' wooden deck and construct a 60' bulkhead, 6'
high.
LOCATION: SCTM #1000-52-1-7 54365 County Rd., LILCO Pole #58,
Southold.
REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the environment are likely to occur
should the project be implemented as planned.

Re: Lead Agenc3~ Coordination Request for Permit Application of Araian Nigogos, 54365
County Rd., 48, Town of Southold.
Dear Mr. Krupski:
With regards to the above mentioned Lead Agency Coordination Request, please note that
the New York State Coastal Management Program does not object to Southold Town
Trustees assuming Lead Agency. However, the Department of State has yet to receive a
Federal Consistency Assessment Form (FCAF) and supporting information for this proposed
project. Therefore, if a Federal permit or Federal funding is required for this project,
please instruct the applicant to submit all required information to Ms. Diana Boos at the
Department of State. Upon receipt, we will determined if the submitted information is
adequate to begin review of the proposed project for consistency with New York State's
Coastal Management Program.

Moved by Allan Connell, seconded by Patricia Isaksen, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH CONDITIONS the Wetland Application of McHUGH, PETER 13-2-8.19 to
construct stairs with decks, from top of bluff to beach, on piles as per
submitted plans.
The Council recommends approval provided all decks are a minimum of 4'
above the ground and all exposed areas be planted with American Beachgrass.

Moved by Allan Connell, seconded by Robert Kelth, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL OF THE BULKHEAD; APPROVAL OF THE DOCK of the Wetland
Application of HECKER, LEWIS 127-6-3 to remove and replace (in kind/in
place) 62 +/- I.f. of timber bulkhead and construct two (2) 10' returns at
ends. Remove and replace (in kind/in place) 15' x 18' timber dock. Dock to
remain a minimum of 4' above grade supporting Spartina alterniflora fringe in
front of bulkhead.
The CAC disapproves the bulkhead and recommend stabilizing vegetatively
following recommendations which can be obtained from Soil Conservation. The
Council suggests the applicant remove the bulkhead north of the dock and plant
spartlna. The bulkhead south of the dock should not be removed or repaired
but allowed to fall naturally.
Council recommends approval of the dock. Vote of Council: Ayes: All
Motion carried.

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of NIGOCOS~ ARAIAN 52-1-7 to
attach a 30~ x 30' wooden deck and construct a 60~ bulkhead.
The Council disapproves the deck because it is too large. The CAC
suggests the Trustees require applicant to removed the section which extends
past the Coastal Erosion Hazard llne. The applicant should have obtained a
permit prior to building,the deck.
The CAC disapproves the bulkhead because no need is shown.
