WITNESSETH. that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, docs hereby grant and release unto Ihe party
orthe second part, Ihe heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
simate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and
State of New York, known and designated as Lot No. 72 and Lot No. 73 on a certain map
entitled, Map of Sterling Manor, fill.:d in the Office of the Clerk of the Coumy of Suffolk as
Map No. 053.
BEING AND INTENDED TO BE the same premises conveyed to the parly of the first part
and Belle Jean Harroun, his wife. by deed from Richard T. Gilmartin as Commissioner of
Public Welfare dated January 13, 1948, and recorded in the Suffolk County Clerk's Office on
February 24, 1948, in Liber 2801 page 300, and premises conveyed to the party of the first
part by deed frQnJ.Lewis E. ~yn).l?nd S~., dated February 2. 1954. and recorded in the Suffolk
County Clerk's 'Office on Februaiy 17, 1954, in Liber 3653 page 20. .
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as onen as he may choose, to Change his remaindt.'rman as
follows:
TO or among anyone or more members of a class consisting of the party of the tirst part's
descendams, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during his lifetime by a properly written and acknowledged instrument, and
recorded prior to death, making specific reference to this power of appoinunent. The party of

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abulling the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premise.~ have been encumbered in any way whatevc..'f, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund tu be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the 10lal of the same for any other purpose.
The word "pany" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
