Southampton, NY 11968 RE: AMY & LEONARD WESSELL 12600 NEW SUFFOLK AVE., CUTCHOGUE SCTM#116-6-13 Dear Mr. Herrmann: The South old Town Board of Trustees reviewed the survey prepared by Nathan Taft Corwin III last dated October 29, 2007 and determined the proposed swimming pool, attached deck, and additions to the existing one-family dwelling to be out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. This determination is not a determination from any other agency. CutcbOl!1le SCTM No.llM!!l:t16-6-13 Dear Mr. King: We represent Amy Wessell, who plans to construct a swimming pool, attached deck, and various additions to an existing one-family dwelling, all as depicted on the site plan prepared by Nathan T. Corwin, L.S., last dated 29 October 2007, a copy of which is enclosed herewith. As all such proposed work and related construction activities will occur more than 100 feet from the tidal wetlands boundary associated with Gardiners Bay, the proposed activities will occur beyond the jurisdiction of the Board of Trustees pursuant to ~275-3(CX5) of the Southold Town Code. Please note that as depicted on the site plan, a project-limiting fence and staked haybales will be emplaced along the lOO-foot setback to ensure that all construction activities do in fact remain outside of the Trustees jurisdiction. Therefore, would you kindly prepare a non-jurisdiction letter for the project that can be provided to the Building Department. Enclosed for your reference are photographs of the staked locations of the seaward comers of the structures and an agent authorization form signed by the Wessells, authorizing En-Consultants, Inc. to act on their behalf.
