Verderber To the Board of Trustees: Please be advised that the Town is negotiating the purchase of a conservation easement on a 000.2 acre parcel of vacant land owned by Thomas A. Rozakis, Ann V. Rozakis and Kathleen A. Verderber that is located at 445 Dogwood Lane in Southold in the Kenney's Beach area. Attached is a copy of the tax map highlighting the subject property and giving the approximate site location, an aerial view, and a survey prepared by John C. EWers Land Surveyor. Although the survey shows a proposed residential dwelling, this property is indeed vacant land and the property owners have indicated that they have no intention of developing this parcel. The owners have offered an easement to the Town at a significant bargain sale price. The parcel contains wetlands and the Town is anxious to purchase a conservation easement for the purpose of open space preservation. The conservation easement will prevent residential development of this parcel, thereby reducing density in this environmentally sensitive area. It is respectfully requested that Heather Cusack in the Trustees Department be allowed to inspect the property for any visibly recognizable environmental conditions that may be of concern to the Town regarding its purchase. If acceptable, please have Ms. Cusack's written report forwarded directly to my office upon its completion. If you have any question, please contact me. Thank you. Box 450 Southold,NY 11971 Dear Mr. Rozakis: In response to your request for information as per your e-mail dated May 18, 2006 to Ms. Standish, I wish to offer you a response on behalf of the Trustees. The Trustees reviewed the property in question during our scheduled field inspections on May 10. We found the property to be heavily vegetated, to the point where if was very challenging to walk the site. There was standing water in the property, and signs that this was an area which included wetlands. It is my understanding that it has not been uncommon for the Board to review the transfer of permits, as conditions of properties can change over time. In addition, amendments to local laws which govern wetland areas have been amended over the last two years. Our reviews have at times required changes to the original conditions of the permits when transfers are requested to conform with updated laws or conditions of properties. These changes could include changes to proposed structures, additional site work or other requirements to mitigate if possible, environmental concerns. It is also possible that as a result of changes that the request for the transfer of the permit could be denied. It is also important to note that the composition of the Board has changed since the granting of the original permit, and the new members of theTrustees might have concerns, which they would like to see addressed. My understanding is that you are aware of the complexities of these issues as you had expressed concerns when the original permit was being considered for approval. The Board is asking for the following information from you as the applicant in their tabling of this request: 1. We are asking for the property to be staked with the location of the . 2 . house, sanitary system and if needed, the water well. 2. We are asking for the wetlands as they exist today to be marked. 3. We are asking for a recent building site plan to be submitted with the application. Upon receipt of this information, we will schedule another inspection to be held during one of our monthly site inspections. You are welcome to submit a request to be present for this inspection. To the Honorable Mr. Krupski and the Board of Trustees: I was told early on to make sure there were no "protected" wetlands on tlle property and tllat my first step should be to contact the Department of Environment Conservation to find out iftlleyconsidered my parcel partoftlleir Wetlands Map. I did so (via Jim Fitzgerald, my Expeditor), and I was very happy when, almost two years ago (June 27, 2002), I received a letter from tlle DEC stating that my lot was "more tllan 100 feet from regulated wetlands" and so therefore (according to tlle DEC), I would not need a permit to build my house. I went ahead with my survey on which was drawn a small house witll an adjoining swimming pool. (I was advised that if I tllought I might ever want anytlling in addition to tlle house, it needed to appear on the survey from the very beginning. 1 had seen a tiny house on Shelter Island years before witll a little pool, and my property was even larger, so I tllough I could and should include the pool. 1 also knew that it was something 1 could let go of if I needed to.) However, at a subsequent hearing before tlle Zoning Board of Appeals, my neighbors enlisted an attorney who, on tlleir behalf, reported tllat tllere were "Phragmites" (wetlands plants) growing along the border between my property and theirs and, assuming tllere were wetlands tllere, warned that 1 should not be permitted to go forward witll my plans. The ZBA asked me to have tlle area investigated and mapped to determine if tllere were wetlands, according to tlle definition of the Town Trustees. I hired Rob Herman, a wetlands expert, to do so, and at the same time the coalition of neighbors hired tlleir own expert, Chuck Bowman, to investigate the same issue. (I am . . o' 'Victoroff Land 2 not clear whether he actually traversed my property - 1 was not asked to grant him permission to do so, although 1 would have if asked.) According to both reports, there is a section of my property that would be considered "wetlands" according to the Southold Town Code definition, which defines wetlands as any area which includes Phragmites (at least). The reports came to basically the same conclusions, and you (The Trustees) will certainly get an opportunity to read both, but 1 wanted to point out something about which, both reports concur. The reports agree that the wetlands exist in the area of my property that is lower than the adjoining properties. Rob's report says: "[the wetland's] current primary function appears to be that of a catch basin for runoff from the surrounding properties," and also, "The shape of the wetland... indicates that its boundaries have already been artificially altered and defined by the surrounding developed lands." Chuck's report says: "Elevations within the area descendfrom the adjoining parcels towards the north and west," and also makes reference to ..... the north side of the low area..... It seems as if these wetlands are not original or natural but have emerged as a result of development that adjoins my property. However, as a result of the wetlands reports, 1 have revised my plans for the property as follows: "'1 have moved the house footprint as far away from the back of the property line (where the phragmites are) as possible, while still leaving a reasonable treeline between the house and the street. "'The septic system has been moved from the southwest side of the house footprint to the diagonally opposite northeast side. "'There will be a concrete retaining wall around the septic system, on the opposite side of the property from the wetlands. "'1 have replaced the rear deck with a rear patio that 1 understand will require minimal land disturbance. "'1 have eliminated the side deck. "'1 have eliminated the pool. "'1 have eliminated the driveway. These changes have all been reflected on the most recent survey, the third one I've had drawn since 1 bought the property. 1 read the Southold Town Code Section 97-12 and under the heading: Findings (A): the Code states a desire by the town to preserve wetlands since they: ..... constitute important physical, social, aesthetic, recreational and economic assets to existing and future residents of the Town...... . . , 'Victoroff Land 3 I believe the small pocket of wetlands on my property do not fall strictly under the protective criteria listed above, in terms of the physical, social, aesthetic (except to my contiguous neighbors), recreational or economic assets they provide to the Town. In addition, if the intent is to protect assets for the "future residents of Southold", it is ironic that as a potential future resident myself, I might not be able to enjoy those assets since I might have to sacrifice my own property! I am a nature lover and a vigilant proponent of protecting the environment, not only for the health of the planet but also for the pleasure of its occupants. The passion with which the Trustees protect the lands of Southold is much of the reason I love the North Fork. I understand why my neighbors do not want to have someone building a house near theirs. I too want privacy and quiet which is why this area with its small houses and natural appearance so appeals to me. I have no desire to change the character of the neighborhood and wish to have a small, simple house and to landscape the land to provide the utmost privacy, for me and my neighbors. I do understand why the rules protecting wetlands were drawn up and I respect them, but I also hope that the Trustees will evaluate this request and can offer some sort of compromise, as I have compromised, so that I can fmally realize my dream of living on the North Fork. Land Use conducted an analysis of the vegetation cover types on October 8, 2003. The results of this analysis are presented below. Vel!etation Analvsis The attached aerial photograph dated 3/14/00 by Aerographics Inc. (1 "= 1 00'), indicates the predominant vegetative species found within and adjacent to the parcel. The cover types are identified below: # 1 A narrow band of a mature wetland tree species extends from the large area of freshwater wetlands located east of the Rozakis parcel westward along the north edge of the Rozakis c1eared!lawn area. This band is dominated by Black Tupelo (Nyssa sylvatica)(FACW+) and Red Maple (Acer rubrum)(FAC/FACW). #2 The band of mature deciduous wetland tree species continues westward and encompasses a significant portion of the Victoroff parcel. The cover type composition changes to incorporate mature Acer rubrum (F AC/F ACW) and Weeping Willow (Salix babylonica) (F AC/F ACW). This area of the parcel exhibits ground/soil characteristics that indicate seasonal standing water is present on a regular basis. Elevations within the area descend from the adjoining parcels towards the north and west. #3 Area number three is an emergent wetland dominated by Phragmites australis (FACW/OBL). This section of the Victoroffparcel exhibits bog soils with groundwater encountered several inches below the surface. The north side of the low area also incorporates numerous Salix saplings indicating that the wet conditions are conducive to species regeneration. Conclusion The species composition within and adjacent to the subject parcel indicates freshwater wetlands are present as defined in Chapter 97 of the Town Code. In this regard, it should be noted that the entire project vicinity exhibits high ground water elevations and therefi present where the topography provides for water levels to be encount to the surface. This is particularly evident at the northwest corner of emergent vegetation is encountered. To re-iterate: 1. Photographs of standing water("pond"), phragmites, and 16" snapping turtle, taken on day of hearing, June 19, 2003. 2. Adjacent neighbor of 32 years, John Kirinic, explained to me that this condition has existed as long as he has been there. His son and the children of the other adjacent neighbor, Kelempelides, used to row a boat in their backyard in particularly wet seasons. After I spoke to you, I went over to the library and read the Town Code's defmition of wetlands. I took out a tree identification book and went back to the property. 3. There are two large willows about 25 feet NE of the SW comer of the lot. 4. There are two red maples directly in the standing water, about 10 feet NE of the same comer. 5. There are one or two more red maples along that "back" line of 109.66.' 6. There is a swamp white oak about 10 feet south of my line, midway along the 77.54' line.
