Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during their regular meeting held on May 31, 1989 regarding the
above matter:
WHEREAS, En Consultants on behalf of George Andregg, Jr. applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
September 21, 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 27, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that En Consultants ON BEHALF OF George Andregg, Jr. BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct 65' timber bulkhead, backfill to be placed after
construction of bulkhead, 10 cubic yards clean sand to be trucked in
from an upland source.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.

following conditions apply to'all permits:
If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
A copy of this permit with supplementary conditions and approved
plans shall be available at the project site whenever authorized
work is in progress.
The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall-complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
Ail necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
Any failure to comply precisely with all of the terms and conditions
of this permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department Of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencement of work authorized herein.
~he granting of this permit ~oes not relieve the permittee of the
repponsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.

All dredging shall be conducted so as to leave a uniform
bottom elevation free of mounds or holes.
All spoil material shall be disposed of either in the
Atlantic Ocean or at an approved U.S. Government Dumping
Ground, as directed by the Dietrict Engineer, U.S. Depart-
meat of the Army, Corps of Engineers. Any spoil m~.Cerial
not intended for such water disposal shall be removed from
the site and disposed of at an approved upland site.
Ail fill and spoil material shall be suitably contained at
the work site so as to prevent its eroding, leaching or other-
wise entering into adjacent wetlands and waterways.
All peripheral rip-rap barmy, cofferd~mm, rock revetments,
gabions, bulkheads, etc. shall he completed pre.or to placement
of any fill material behind such sttmctures.
Ail repairs to existing structures shall be confined to re-
placement of existing structural elements with no change ia
design, d~m~sion, or materials, unless specifically
authorized herein.

We have revised the project to allow for the construc-
tion of a new bulkhead within 18" of the existing.
Approximately 10 cubic yards of clean sand and loam
will be brought in from an upland source for backfill.
I trust this will enable you to issue your approval.
By copy of this letter and revised work plan, I am
requesting other involved regulatory agencies to modi-
fy the applications pending before them as well.

Dear Ms. Peterson:
The section of bulkhead wi]ich we intend to remove
and replace is already a second wall.
It is approximately 2' lower than the first bulk-
head which is still plainly visible. As we pro-
pose it the easterly (seaward) lower bulkhead
will be totally removed as well as the backfill
between it and the first bulkhead. If this removal
is to be termed "dredging" we are comfortable with
that term and note that it entails only approxir
mately 10 cubic yards. Any unsuitable material
such as concrete will not be reused for backfill
but rather removed from the site.
~J~he new bulkhead will be constructed in the same
location but will be approximately 2' higher to
match the elevation of the existing bulkhead which
will remain. We believe that this solution will
pose no environmental hazard and will eliminate
the further ~ncursion into Little Peconic Bay
by yet a third line of bulkheading.

The following recommendations were made by the CAC at its regular
meeting held Tuesday, November 15, 1988:
RESOLVED to recommend to the $outhold Town Trustees approval of
Wetland Application No. 667 of Robert G. Kassner on behalf of Nunnakoma
Waters Association Inc. to dredge channel, approximately 3600 c.y. of
material to be hydraulically removed and pumped to adjacent beach as
nourishment.
Corey Creek, Southold. Southerly end of Wampum Way.
RESOLVED to recommend to the $outhold Town Trustees approval with
stipulations Wetland Application No. 668 of Mattituck Inlet Marina for
proposed dock and dredging. The CAC approves with the stipulation
that the proper gradient is maintained to prevent the distruction of
the bank and grasses. Also, due to the large number of boats and
the popular use of the marina the CAC feels the Southold Town Trustees
should require a pumpout facility at the marina.
Mill Road, Mattituck.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 669 of Marie Nerosyan to remove and replace
(in same location and configuration) 23 I.f. of existing timber bulkhead
and attach to existing bulkheads to north and south. An 8' return
to be constructed on north side. Replace and existing stairway and
8' x 11' fixed dock with a 4' x 20' walk. Maximum 10 c.y. of spoil to
be removed from in fornt of bulkhead to 3' below MLW and used as backfill.
Mesrobian Drive, Laurel.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 671 of Daniel C. Mooney to install and maintain
three fence posts and 16' split rail fence. The CAC wishes to state,
for the record, that it feels that this type of application is not necessary
and the applicant should be refunded the application fee.

RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 670 of George Anderegg, Jr. to remove and
replace (in same location and configuration) 57 I.f. of existing timber
bulkhead and two 4' returns. Backfill with concrete to be brought in.
Note: Bulkhead to be removed is second existing bulkhead, first bulk-
head will remain.
9045 Nassau Point Road, Cutchogue
RESOLVED to recommend to the Southold Town Trustees disapproval
with recommendations of Wetland Application No. 678 of Geoffrey L. Penny
to add retaining wall around man-made boat basin and maintenance dredge.
The CAC recommend disapproval of the retaining wall because no need
is shown and the CAC has a policy not to recommend retaining walls
on protected areas in creeks.
The CAC recommends, however, the followingS,. .:
1. Two angled returns which are a continuation of the exi~sting' "
bulkhead. Returns should be angled to minimize wetland intrusion,
and fill behind the returns.
2. Dredge area not be 4' to MLW. Recommend a gentle slope be
established to shoreline.
3. Recommend the applicant keep a 20' to 30' natural buffer zone.
Mason Drive, Cutchogue.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 656 of Martin W. Kruse to construct 45' of 4'
catwalk, 80' of 6' dock, 8' x 40' float dock with a 20' ramp and related
mooring pilings. The CAC recommends approval, however, would like
to note that the length of the dock exceeds the Trustees' guideline of
75'.

Dear Ms. Peterson:
The section of bulkhead which we intend to remove
and replace is already a second wall.
It is approximately 2' lower than the first bulk-
head which is still plainly visible. As we pro-
pose it the easterly (seaward) lower bulkhead
will be totally removed as well as the backfill
between it and the first bulkhead. If this removal
is to be termed "dredging" we are comfortable with
that term and note that it entails only approxir
mately 10 cubic yards. Any unsuitable material
such as concrete will not be reused for backfill
but rather removed from the site.
~-~he new bulkhead will be constructed in the same
location but will be approximately 2' higher to
match the elevation of the existing bulkhead which
will remain. We believe that this solution will
pose no environmental hazard and will eliminate
the further ~ncursion into Little Peconic Bay
by yet a third line of bulkheading.
I am enclosing a revised cross-section which
trust more clearly depicts what is proposed.
