Dear Mr. Herrmann:
The Southold Town Board of Trustees reviewed the survey prepared by Joseph A.
Ingegno last dated April 22, 2007 and received on April 25, 2007, and determined the
proposed construction of ~m inground swimming pool, pool fence, pool drywell, and
grading activities to be out of the Wetland jurisdiction under Chapter 275 of the Town
Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.

Dear Mr. King:
We represent Carolyn and Joseph Ferrara, who plan to construct an inground swimming pool; erect a pool
fence; install a pool drywell; and undertake grading activities on the captioned property, all as depicted on
the site plan prepared by Joseph A. Ingegno, L.S., last dated April 22, 2007, a copy of which is enclosed
herewith. As all such proposed work will occur more than 100 feet from the tidal wetlands boundary and
tidal waters associated with Gardiners Bay, the proposed activities will occur beyond the jurisdiction of
the Board of Trustees pursuant to *275-3(C)(5) of the Southold Town Code. Please note that as depicted
on the site plan, a project-limiting fence and staked haybales will be emplaced along the lOO-foot setback
to ensure compliance with Chapter 275. Therefore, would you kindly prepare a non-jurisdiction letter for
the project that can be provided to the Building Department. .
Also enclosed for your reference are photographs of the staked pool location and an agent authorization
form signed by Joseph Ferrara, authorizing En-Consultants, Inc. to act as agent in this matter. Should you
have any questions regarding this request, please do not hesitate to contact me at your earliest
convenience.
