Orient

April 6, 1975
Mr. Robert Gillespie, Chairman
Zoning Board of Appeals of the Town of Southold
Town Office, Main Road, Southold, New York
Dear Mr. Gillespie:
I understand that Chester Mayer of Orient has applied
for a variance to permit him to convert "an existing accessory
building to a dwel~ing unit with insufficient setback and
insufficient area." I will not be able to attend the hearing
Monday night but I do want to register my strong opposition to
granting this variance.
My wife and I are part owners of the strip of beach to the
eastwards of the Mayer property (adjoining that piece of beach
owned by Joseph Kardwell; what your legal notice describes as
"land now or formerly of Knox.") The beach in question is about
one hundred yards from Mr. Mayer's "pool house," which is the
auxilliary building mentioned above. When Mr. Mayer put up
the "pool house" he saw fit to put it right on the property
line in the north east corner of his land. It thus looms over
the beach below; what had been a com~letely open and natural
setting now has a quite astonishing mass of concrete, windows
and porches hanging over it. (Mr. Mayer builds for the ages;
his little shack to put on his bathing suit in has two dressing
rooms, two bathrooms, a full cellar with windows overlooking the
Sound, a large living room and fireplace and is only slightly
less solid than the Tower of London.) Had Mr. Mayer had the
decency to observe the required set-back when he built his pool
house, it would not have been nearly so intrusive or obvious. I
believe that, far from granting a variance to legalize what has
already been done improperly, your board or other agendy should
force Mr. Mayer to move his house so that he conforms to the law
like anyone else. (Incidentially, a portion of the pool house--
a fence--is actually over the line on the "land now or formerly
of Knox."). Adding a stove to the "pool house" to make it a
permanent dwelling simply means there will be somebody overlooking
our beach all the time instead of some of the time. Finally, I
believe the "pool house" sewer drains directly out into the Sound.
I don't care for that, and a certaihly do not want to see the
load increased through turning the pool house into a nt__
dwelling.

STATE OF NEW YORT<:) SS .
COUNTY OF SUFFOLK) . .
CHESTER M. MAYER, being duly sworn, deposes and says:
1. That he is the owner of a parcel of land on the
north side of "North Lane" in the Hamlet of Orient, Town of
Southold, Suffoll< County, New York, generally bounded and
described as follows:
On the North by Long Island Sound
On the East by land now or formerly owned by Knox
On the South by North Road
On the West by lands now or formerly of Stern
containing approximately square feet.
2. This affidavit is submitted in support of ap~licant's
present application to the Zoning Board of Appeals of the Town
,:
~ of Southold for permission to use a pool house now situate upon
o
.
~ my property as an accessory use to my existing home as a separate
w
>
. residence for limited purposes.
.
~ 3. Annexed hereto is a site plan of the house which
.
w
: applicant owns north of North Lane in Orient. The plan also
w
"
~ shows a "Pool House" located immediately to the east, and a new
e swimming pool which has been installed upon applicant's property.
o
o
" 4. The pool house consists of a sitting room with fire-
place, 2 bedrooms, 2 bath rooms and kitchen, without stove; on
a lower level there is a room housing swimming pool machinery
and furnace. There is also a complete bathroom, 2 dressing
rooms and a recreation or game room.
5. All the foregoing constitute a conforming accessory
building for which a Certificate of Occupancy (No.Zs7ss) issued
on or about January 24, 1974. A copy of that Certificate of Use
is attached.
6. Applicant wishes to make one minor change in the
existing use, specifically to insta 11 an 18" x 24" 4-burner
electric stove. The purpose of the installation of this stove
..
.~
"
"'.,,.,,
',-,/
is to allow the pool house to be occupied from time to time,
but not as a permanent residence, by the property owner's family.
Applicant represents to the Board that the property will not be
leased to strangers, friends, guests, or anyone else on any
basis. It will simply be used by the property owner's family
and, of course, occasional guests of the family. There is no
commercial motive but rather merely an effort to provide the
family and occasional guests with the kind of privacy that the
pool house permits.
7. Structurally, no change is requested in the exist-
ing pool house. As it now exists, a refrigerator and sink have
been installed with the permission of the Building Department.
The installation of the stove will simply be for the convenience
>
z of those family members and occasional guests who may wish to
ci
~ have their meals at the pool house rather than at the main house.
