TERMS AND CONDITIONS
The Permittee, Kings & Alphas, LLC c/o Richard Israel. residing at 185 Old Country Rd.,
Suite 5, Riverhead, NY as part of the consideration for the issuance of the Permit does understand and
prescribe to the following:
1. That the said Board of Trustees and the Town of South old are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Costello:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., February 27,2008 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of KINGS & ALPHAS, LLC
C/O RICHARD ISRAEL applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated December 26,2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 5 & 6 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the
following Best Management Practice requirement: the new vinyl bulkhead to be
constructed in-place of the existing bulkhead, and,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 27,2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of KINGS & ALPHAS,
LLC C/O RICHARD ISRAEL to remove existing wood walkways to allow construction of
new bulkheads. Remove 95'+/- of existing seaward second bulkhead; using vinyl
sheathing construct 95'+/- of new bulkhead in-place of existing seaward bulkhead
removed and 41 '+/- of new bulkhead immediately in front of remaining single southeast
seaward bulkhead section; provide 10' non-turf buffer zone behind bulkheads; construct
new 10' wide and 3' wide wooden walkway, and as depicted on the plans prepared by
Costello Marine Contracting Corp. last dated January 15, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., February
13, 2008, the following recommendation was made:
Moved by Glen McNab, seconded by Jack McGreevy, it was

The CAC Supports the application with the Condition non-treated lumber is used on the
decking, a 10' non-turf buffer, inclusive of the walkway, is installed landward of the

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
TOM' of SO",hold Tow, Cod, ~d U" 1.0,"' W"",,"m, RWil,',",,,"O Pcogmm (L WRP) Po""
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the POlicy Standards and therefore is
INCONSISTENT with the L WRP:
Policy 6
Protect and restore the quality and function of the Town of South old
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.

The proposed action does not comply with 9 275-11. Construction and operation standards.
Section (BI) item (a).
"(I) Bulkheads, retaining walls, revetments and gabions.
(a) Only in-place replacement of existing functional bulkheads (as defined in 9 275-
2) is permitted. In-kind replacement relates to the position and dimensions and does not
necessarily require or allow for the use of the same materials. At its discretion, the Board
may allow for a one-time projection of the replacement structure seaward of the original,
only if such placement will not project the proposed structure seaward of adjacent,
ueighboring structures and ifthe proposed installation is in close proximity to the
original structure. Any subsequent repair or replacement following the first replacement
requires the structure to be built on or landward ofthe original structure."
The proposed action will proiect further seaward of the existinl!: wood bulkheads to
the west and east of the property.
In the event that that the action is approved. it is recommended that the following BMP's be
required to further the below policies:
Policy 5. Protect and improve water quality and supply in the Town of South old.
I. Minimize the use of chromated copper arsenate (CCA) treated wood in the construction of the
structure pursuant to 9 275-11. B,1 (f) Construction and operation standards below.
(j) In order to prevent the release of metals and other contaminants into the wetlands
and waters of Southold, the use of lumber treated with chromated copper arsenate (also
known as "CCA "), creosote, penta products or homemade wood preservatives is
prohibited for use in sheathing and decking. Preservatives of any type, including but not
limited to those listed above cannot be applied to any bulkheads, retaining walls or
revetments after installation. Encapsulated pilings or native nonchemically treated
(untreated) lumber only should be used in sensitive areas.
2. Require the installation of a silt boom (where feasible) pursuant to 9 275-11. (2) Construction
and operation standards below.
2) Erosion control. Installation of an erosion control structure is necessary during
any building, grading, landscaping or site work activity within Trustee jurisdiction. This
structure may include, but is not limited to, installation of a silt fence, hay bales, wood
chip berm and silt booms. The placement of the erosion control structure(s) shall be
determined by the Trustees or their designee. All intertidal construction and excavation
requires the installation of a silt boom that will retain all suspended sediments within the
immediate project area.
In addition to also further Policies 5, Protect and improve water quality in the Town of Southold
and 6.3 Protect and restore tidal and freshwater wetlands, item D (below). It is recommended
that the buffer be increased to a minimum of20 feet. The buffer should be pervious.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in
order to ensure protection of the wetland's character, quality, values, and functions.

Please require that the applicant amend the application to meet the above policies to the
greatest extent possible.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Policy 1 Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
The existing bulkhead on this property is beginning to fail. We are proposing to build a new
bulkhead immediately in front of the existing bulkhead to ensure that the creosote used on the
existing sheathing does not leach into the water.

This property has no significant historic resources.

The bulkhead at this location exists. The present condition of this bulkhead is becoming unstable

property owner to maintain his property. There is an existing bulkhead and the surrounding area is
bulkheaded so the visual quality and scenic resources will remain the same.
