Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., January 23, 2008 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of WILLIAM F. BILLMAN, AS TRUSTEE
OF THE WILLIAM F. BILLMAN REVOCABLE TRUST applied to the Southold Town
Trustees for permits under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance, application dated December 17, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council, the Local Waterfront Revitalization Program Coordinator, and the
Environmental Technician for their findings and recommendations, and,
WHEREAS, the Southold Town Conservation Advisory Council resolved to Not Support
the application, listing the reasons of "negative impact on the wetlands to the
southeast', the proposal of a project "in a natural drainage area", and lack of
"consistency with LWRP", and,
WHEREAS, the Environmental Technician has raised issues regarding the stormwater
infrastructure contained on the site, as well as a swale, and the extent of the wetlands
on the site and the incorrectness of the wetlands delineation on the materials submitted
by the applicant, and,

WHEREAS, the New York State Department of Transportation has indicated to the
Town that "drainage issues, freshwater wetland issues, stormwater runoff, future
highway permitting issues" regarding the site remain unresolved, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on January 23, 2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structures, as applied for, do not comply with the standards set forth in
Chapter 275 of the Southold Town Code, and,
WHEREAS, the Board has determined that the structures, as applied for, will have a
detrimental effect upon the health, safety and general welfare of the people of the town,
and,
NOW THEREFORE BE IT,
RESOLVED, for the foregoing reasons, and based upon the application's failure to meet
the standards contained in Chapter 275 of the Town Code, that the Board of Trustees
deems the proposed project to be Inconsistent with the Local Waterfront Revitalization
Program pursuant to Chapter 268-5 of the Southold Town Code, based on the scope
and location of the proposed structures, and the overall impact of the proposed project
on the freshwater wetlands, and,
BE IT FUTHER,
RESOLVED, that the Board of Trustees DISAPPROVES WITHOUT PREJUDICE the
application of WILLIAM F. BILLMAN, AS TRUSTEE OF THE WILLIAM F. BILLMAN
REVOCABLE TRUST to construct a single-family dwelling with sanitary system and
retaining wall, and as depicted on the survey prepared by Nathan Taft Corwin III last
dated September 17, 2007.
This is not a determination from any other agency.

Reference is made to our recent telephone conversation regarding the proposed application
submitted to the Town of Southold for the property identified as SCTM# 1000-31-11-06 located
on the southside of NYS Route 25 in the hamlet of East Marion.
As discussed, the New York State Department of Transportation (NYSDOT) has been
corresponding over the past year with Ms. Patricia C. Moore, the attorney for the owner of this
property, regarding drainage issues, freshwater wetland issues, stormwater runoff, future
highway permitting and the proposed development of the site.
Discussions are continuing regarding the above-noted issues with no permanent solution
arrived at to date.

In regard to the above-referenced property, the Board of Trustees reviewed the
survey prepared by Nathan Taft Corwin III last dated April 3, 2008 and conducted
a thorough site inspection, and determined the proposed construction of a single-
family dwelling, driveway, sanitary system and retaining walls to be out of the
wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter
111 of the Town Code.
Although no permit is required from our office, given the unique layout of this
property, our Board is concerned about the negative impacts this construction
project will have on the wetlands located 100' from the clearing, grading and
ground disturbance associated with the project.
Our Board respectfully requests that any additional work or modification to the
project as described be referred to our office for further review.

Dear Ms. Moore:
The Southold Town Board of Trustees reviewed the survey prepared by Nathan Taft
Corwin III last dated April 3, 2008 and determined the proposed construction of a single-
family dwelling, driveway, sanitary system and retaining walls to be out of the Wetland
jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town
Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary best management practices are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such best management practices may include maintaining adequate
work area between the tidal wetland jurisdictional boundary and the coastal erosion
hazard area and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.
If you have any further questions, please do not hesitate to call.

Based on the information you have submitted, the New York State Department of Environmental
Conservation has determined that:
Your proposed project to construct a new single family dwelling with driveway, septic system,
retaining walls and regrading at the location listed above, ( and shown on the survey by Nathan
Taft Corwin III, dated 4/3/2008) is more than 100 feet from regulated freshwater wetlands.
Therefore, no permit is required under the Freshwater Wetlands Act (Article 24 of the Environmental
Conservation Law).
Be advised, that all construction, clearing, and/or ground disturbance must remain more than 100
feet from the freshwater wetland boundary. The Department recommends that the property
owner put erosion control structures (silt fence or staked straw bales)in place along Limit of
Clearing, Grading and Ground Disturbance line prior to any ground disturbance and that this
erosion barrier be maintained until the project is complete and all disturbed soils have been
revegetated.

As a follow up to Thomas Brown's letter regarding the property at 101220, 1
have the following concerns:
Wetlands preservationds
Woodlands preservation
Drainage
Size of house that would be built
Noise
Water pollution (10120, our home is not on county water)
Driveway access (currently, the access to 10120 is a danger and with another
blind driveway being placed next to the church, it appears that the dangers
would be even higher. There was an application filed for blind driveway status
that was denied by the town.)
Is it legal to approve a building permit without having the actual building plans
available for review by all parties? Typically, a plan is submitted with specific
size of house, septic and well placement(which was provided, but how do you
know how many are needed without having the house plans and number of
bathrooms). If this is approved, I would ask that we be able to have a
construction company review the plans/specifications to ensure that it does
not deter from the value of our home. I would also ask that it be limited to two
stories.
As indicated above, the area is now a woodland's and wetlands property and
it would be beneficial for the town to limit the number of trees and the amount
of landfill placed on such property.

I am Thomas V. Brown along with Mary Elizabeth
Berry the adjacent property owners on the west side
of aforementioned property. We reside in Florida for
the winter months and are not able to attend the
hearing (or we certainly would) so we are sending this
letter.
We received a packet along with a survey from Mr.
Billmans attorney (Patricia Moore) which we
understand is proper protocol. We have the following
concerns which we wish the board to be aware of:

As per your request of January 16, 2008 1 have reviewed the above referenced
application and site.
The site contains stormwater infrastructure, with a street drain on N.Y.S. Route
25 attached to a concrete pipe, rocks, and a swale running north to south on the
property from the road towards Marion Lake. See attached photos.
The survey submitted to the Trustee Office on December 17, 2007 was surveyed
by Nathan Taft Corwin III and last dated September 17, 2007. This survey does
not show a correct wetland line in the swale area as described above. During a
field visit of January 11, 2008 1 found indications of wetlands in this area.
Indicators include the many mature Red maple (Acer rubrum) trees throughout
the swale, and wetland soil types.
In order to fully evaluate the swale part of the property for a more accurate
wetland line a complete evaluation will be needed in the spring. A complete
species list and soil indicators can be completed at that time.

LWRP CONSISTENCY ASSESSMENT FORM
INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended
to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions
including Building Permits and other ministerial permits not located within
the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form
should review the exempt minor action list, policies and explanations of
each policy contained in the Town of Southold Local Waterfront
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which
includes all of Southold Town).

and conditions contained in the consistency review law. Thus, the action
