Herbert Ogden, Jr. as managing partner, hereinafter referred to as (the "Declarant"). WITNESSETH i VVI~REAS, the Declarant is the owner of certain real property I located at Private road, No Fishers Island, in the Town of Southold, County of Suffolk, State of New York; Tax Map # District 1000 Section 10 Block OS Lot 13.3, which real property is more particularly described in Exhibit A annexed hereto (hereinafter referred to as the "Property"); and WHEREAS, the Property is situated in or adjacent to lands activities upon which are regulated by the Southold Town Trustees Board of Town Trustees pursuant to Chapter 275 of the Town Code of the Town of Southold, and as may be amended, and various activities conducted upon the property are subject to the jurisdiction, regulation and approval or disapproval of the Trustees prior to being wnducted: WHEREAS, The Declarant has applied to the Town of Southold Boatel of Trustees for a Wetland Permit for approval to demolish an existing dwelling and construct a new dwelling, new sanitary system, gazebo, deck and hot tub in lands known as S.C.T.M.# 1000-10-5-13.3 and as depicted on the plans prepared by CME Engineering, Surveying and Architecture last dated Feb 29, 2008; WHERAS, the Town of Southold Board of Town Trustees, as conditions for the issuance of such Wetland Permit, required certain covenants and restrictions be placed on the property as shown on the aforesaid plans. NOW, THEREFORE, This Declarant witnesseth: That Declarant, for the purpose of carrying out the intentions expressed above does hereby make known, admit, publish, covenant and agree that the said property herein described shall hereafter be subject to the RPR-~3-2008 14:01 FROM: JMO CONSULTING 6533348 T0: 7656641 P.3 following covenants which shall run with the land and shall be binding on all purchasers and holders of said premises, their heirs, successors, and assigns, to wit; 1. The grant of a Wetland Permit for the said demolition of an existing dwelling and the construction of a new single family dwelling, sanitary system, gazebo, deck and hot tub shall be conditioned upon the installation of gutters and drywells to contain roof runoff and a continuous line of silt fence backed by hay bates, maintained throughout the period of construction; as shown on the above referenced plan and identified as S.C.T.M.No. 1000-10.05-13.3. The grant of a Wetland Permit shall be conditioned upon the installation of a permanent Wetland Buffer Area as depicted and noted on the plan prepared by CME Engineering, Surveying and Architecture, PLLC last dated Feb 29, 2008 as filed with the offices of the Suffolk County Clerk with this Declaration and annexed hereto as Exhibit B. 2. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town of Southold Board of Town Trustees after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required 3. It is the responsibility of any party having any right, title or interest in the Property to consult Chapter 275 of the Town Code of the Town of Southold, as may be amended, and to obtain from the Town of Southold Board of Trustees review and such approvals as maybe required by Chapter 275 for activities regulated therein on the Property. 4. Declarant grants the continuing right in perpetuity to the Town of Southold or any of it's designated representatives to enforce the conditions and restrictions of the covenats. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Perritittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that maybe required supplemental to this permit, which maybe subject to revoke upon failure to obtain same. James F. Box 447 Quogue, NY 11959-0447 RE: NOL, LLC PRIVATE RD., FISHERS ISLAND SCTM#10-5-13.3 Dear Mr. Just: The Board of Town Trustees took the following action during its regular meeting held on Wed., August 23, 2006 regarding the above matter: WHEREAS, J.M.O. Environmental Consulting Services on behalf of NOL, LLC applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated July 5, 2006, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Watertront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed.application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront Revitalization Program to the greatest extent practical through the imposition of the following Best Management Practice requirements: the installation of gutters and drywells to contain roof run-off, the installation of a line of staked hay bales and silt fencing prior to construction activities, and the location of the sanitary system beyond 100' from the freshwater and tidal wetlands, and, z • WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on August 23, 2006, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of NOL, LLC to construct a single' family dwelling and for the existing gazebo, deck and hot tub, with the condition drywells and gutters are installed to contain the roof run-off, a line of staked hay bales and silt fencing is installed prior to construction activities, and provide a buffer from the edge of the existing lawn, maintaining the natural vegetation, and as depicted on the plan prepared by Richard H. Strouse last dated February 29, 2008. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) As part of my review of the Town's LWRP Consistency Form Section C, I offer the following comments regarding the Local Waterfront Revitalization Policies and this proposed project: Policy 1. I believe that this project is consistent with this policy because the project will not result in a negative impact upon the desired development pattern of the Town of Southold nor shall it result in the loss of the community and landscape pattern of the Town of Southold. Policy 2. I believe that this project is consistent with this policy because the project shall not have any impacts upon the preservation and retention of historic resources, or any archeological resources nor the Coastal Culture of the Long Island Sound. The reason for this is that the project site has previously been "disturbed" and developed. The property itself was previously disturbed when the existing single family dwelling, sanitary system, driveway and dock were constructed . Policy 3. I do not tbelieve that this policy is applicable to the project since the project will not have an impact on any scenic resource of the Town of Southold. Policy 4. I feel that the project is consistent with this policy for a number of reasons. The proposed single family dwelling project has been based upon sound engineering practices and designed to the minimum scale necessary. Box 447 Quogue, New York 1 1 959-0447 The project shall have no adverse impacts upon adjacent properties or to natural coastal processes or natural resources. The project shall have no impact on any natural protective features nor shall it have any impacts upon public lands or lands in public trust. Lastly, the project does not involve the management of a navigational infrastructure nor are public funds involved with the project. Policy 5. I feel that the proposed project is consistent with this policy for a number of reasons. The project does not involve any direct or indirect discharges that would cause any negative impacts upon water quality standards. There shall be no increase or decrease in the pH, the dissolved oxygen or nutrients in the waterway and there should be no increase in noxious odors at the project site. There shall be no increase in negative health impacts such as pathogens, chemical contaminants or toxicity nor shall there be any negative aesthetic factors involved with the project. As part of the project a continuous line of staked hay bales and filter fabric shall be installed seaward of the limit of construction prior to the commencement of construction activities and maintained throughout the period of construction activities. To mitigate any impacts on wetlands the applicant shall create anon-disturbed buffer zone landward of the limits of wetlands on now what consists of lawn area. The buffer zone shall consist of native vegetation. The project does not involve watershed development or the quantity or quality of potable water. Policy 6. I feel that the project is consistent with this policy. The project as proposed shall have no impact upon the ecological quality in the Town of Southold. There shall be no negative impacts upon the adjacent West Harbor by the destruction of habitat or significant impairment to the tolerance range of any species of fish or wildlife. As stated in the previous section the applicant shall also create anon-disturbed buffer area of native vegetation. This will create an additional buffer to the adjacent wetlands that does not currently exist. The project should have no impact upon any vulnerable fish, wildlife, plant species or rare ecological communities. Policy 7. I do not feel that this policy is applicable to this project since the project does not involve any atmospheric deposition of pollutants. Policy 8. I believe that the project is consistent with this policy. The project shall involve the disposal of solid waste, debris from the demolished dwelling, which shall be removed from the project site as part of the project. There are no hazardous waste or toxic pollutants involved with the project. Policy 9. I do not feel that this policy is applicable to this project. The proposed project shall have no impact upon adequate physical public access to coastal resources, shall not impact any public visual access to any lands or waters, involve the public interest in and use of lands and waters held in public trust or to public access of such areas. Policy 10. I feel that the project is consistent with this policy. The project shall have no impacts upon any existing water-dependent uses of the site nor is the project located on Mattituck Creek/Inlet, Mill Creek or within the Village of Greenport and does not involve water-dependent uses at those sites. Policy 11. I feel that the project is consistent with this policy. The project does not involve aquaculture or the removal of shellfish from uncertified waters of the Town of Southold nor shall it have a negative impact upon the long-term maintenance and health of living resources. Policy 12. I do not feel that this policy is applicable to the project because no agricultural lands are involved. Policy 13. I do not feel that this policy is applicable to the project since the project does not involve energy or mineral resources. Town of Southold LWRP CONSISTENCY ASSESSMENT FORM A. INSTRUCTIONS 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a detemunation of consistency. *Ezcept minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program.
