TERMS AND CONDITIONS
The Permittee Hav Harbor Golf Club, Inc., residing at Beach Avenue, Fishers Island, NY as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees ofthe Town of Southold.
2. That this Permit is valid for a period of24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of South old.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 27,2008 regarding the above matter:
WHEREAS, J.M.O. Environmental Consulting Services on behalf of HAY HARBOR
GOLF CLUB, INC. applied to the Southold Town Trustees for a permit under the
provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the
Town of Southold, application dated January 2,2008, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 27,2008, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of HAY HARBOR
GOLF CLUB, INC. to restore approximately 550' of eroded shoreline by installing a
"boulder slope" consisting of 2-4 ton boulders which shall be placed on filter fabric and a
rock chip base; any disturbed areas shall be replanted with Rosa Rugosa and Bayberry,
and as depicted on the site plan prepared by CME Associates Engineering, Land
Surveying & Architecture, PLLC, last dated February 5, 2008, and received on February
15, 2008.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Mr. King:
I am presently writing you as a follow up to our meeting at this
project site on 1/29/08. At that time, it was suggested that the proposed
rock sloping should go to elevation 14 instead ofthe entire slope as
originally proposed. This would allow for less disturbance, require fewer
boulders and it was felt it would provide adequate protection for the back of
the beach.
For the Board's review, I have enclosed (5) copies of the revised plans
which have been prepared by CME Associates, Engineering, Land
Surveying and Architecture, PLLC last dated 2/5/08.

J.M.O. Environmental Consulting on behalf of HAY HARBOR GOLF CLUB, INC.
requests a Wetland Permit and Coastal Erosion Permit to restore approx. 550' of eroded
shoreline by installing a "boulder slope" consisting of 2-4 ton boulders which shall be
placed on filter fabric and a rock chip base. Any disturbed areas shall be replanted with
Rosa Rugosa and Bayberry. Located: Beach Ave., Fishers Island. SCTM#9-12-8.1
The property is subject to active erosion aud a loss of upland property has occurred.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is CONSISTENT
with the following Policy Standards and therefore is CONSISTENT with the
LWRP.
Policv Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:

D. Use hard structural erosion protection measures for control of erosion
only where:
4. Construction of a hard structure is the onlv nractical design
consideration and is essential to protecting the principal use.
Due to the exposure of the shoreline. slope of the bank and
high ener!!v due to wave and wind actiop. the proposed rock
revetment is the onlv "natural" control structure available for
effective erosion control.
6. Practical vegetative methods have been included in the proiect
design and implementation.
The apnlicant meets this sub-policv throu!!h the plntin!! of
disturbed areas Rosa RUllosa and Mvrica lIensvvanica
landward of the rock structure.
B. Protect and restore ecological quality by adhering to the following
measures.
I. Maintain values associated with natural ecological communities.
Each natural ecological community has associated values which
contribute to the ecological quality of the Town of Southold. These
values should be assessed on a case-by-case basis.
3. Avoid fragmentation of ecological communities and maintain
corridors to facilitate the free exchange of biological resources
within and among communities.
a. Each individual resource area should be maintained as a
complete contiguous areas to protect the area's natural
resource values. Specifically, actions that would fragment
the ecological community into separate ecological islands
should be avoided.
b. Where fragmentation of ecological communities has
already occurred, the adverse effects of fragmentation can
be mitigated by maintaining or providing connecting
corridors to allow exchange of biological resources.
4. Maintain ecological integrity of particular locales by maintaining
structural and functional attributes, including normal variability, to
provide for self-sustaining systems.
5. Avoid permanent adverse change to ecological processes.

There are reports of cliff swallows (Petrochelidon vvrrhonota) occurrine: in the area
and nestine: within the bank. It is recommended that the desie:n of the structure
minimize phvsicalloss. dee:radation or functional loss of the habitat area.
It is recommended that the Board auulv seasonal construction restrictions relative
to the mie:ration pattern of the suecies.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all

Applicant: Hay Harbor Golf Club, Inc.
Location: Beach Avenue, Fishers Island, Town of Southold

The project consists of the applicant's proposal to restore approximately
550' of eroded shoreline by installing a "boulder slope" consisting of 2-4 ton
boulders which shall be placed on filter fabric and a rock chip base. Any
disturbed areas shall be replanted with Rosa rugosa and bayberry.
As part of my review of the Town's LWRP Consistency Form Section C,
I offer the following comments regarding the Local Waterfront
Revitalization Policies and this proposed project:
Policy 1. The project as proposed will not result in any negative impacts
whatsoever upon the development pattern desired by the Town of Southold
or shall it result in the loss of the community and landscape character of the
Town of Southold.
Policy 2. The project as proposed shall not result in the loss of any
archeological resources.
Policy 3. The project shall not impair the visual quality or the scenic
resources of Long Island Sound.
Policy 4. The proposed restoration of the existing shoreline has been based
on sound engineering practices and designed to minimum scale necessary to
manage flooding and erosion. The project shall not negatively impact
public lands or public trust lands.
Policy 5. The project does not involve any direct or indirect discharges that
would cause any negative impacts upon water quality standards. There shall
be no negative impacts upon water quality standards. There shall be no
increase or decrease in the pH, the dissolved oxygen or nutrients in the
waterway and there should be no increase in negative health impacts such as
pathogens, chemical contaminants or toxicity nor shall there be any negative
aesthetic factors involved with the project. The project does not involve
watershed development or the quantity or quality of potable water.

Policy 6. The project shall have no impact upon the ecological quality of
the Town of Southold. There shall be no direct or indirect disturbance to
any significant Coastal Fish or Wildlife Habitats.
Policy 7. I do not feel that this policy is applicable to this project since the
project does not involve any atmospheric deposition of pollutants.
Policy 8. I believe that the project is consistent with this policy. The project
shall not involve the disposal of solid wastes or debris. There are no
hazardous waste or toxic pollutants involved with the project.
Policy 9. I do not feel that this policy is applicable to this project. The
proposed project shall have no impact upon adequate physical public access
to coastal resources, shall not impact any public visual access to any lands
or waters, involve the public interest in and use of lands and waters held in
public trust or to public access of such areas. Nor will the project have
impacts upon the public's right of access along the shoreline.
Policy 10. I feel that the project is consistent with this policy. The project
shall have no negative impacts upon any existing water-dependent
commercial, industrial or recreational uses of the Peconic Bays. Nor is the
project located on Mill Creek of within the Village of Greenport and does
not involve water-dependent uses at those sites.
Policy II. I feel that the project is consistent with this policy. The project
does not involve aquaculture or the removal of shellfish from uncertified
waters of the Town of South old nor shall it have a negative impact upon the
long term maintenance and health of living resources.
Policy 12. I do not feel that this policy is applicable to the project because
no agricultural lands are involved.
Policy 13. I do not feel that this policy is applicable to the project since the
project does not involve energy or mineral resources.
