Dear Mr. Just:
The Southold Town Board of Trustees reviewed the site plan prepared by Richard H.
Strouse last dated March 4, 2008 and determined the proposed construction of a 15.58'
X 16' addition onto an existing garden shed, construction of approx. 30' of retaining
walls and a stone (pervious) parking area to be out of the Wetland jurisdiction under
Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code.
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required. Please be advised,
however, that no construction, sedimentation, or disturbance of any kind may take place
seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of
the coastal erosion hazard area as indicated above, or within 100' landward from the
top of the bluff, without further authorization from the Southold Town Board of Trustees
pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility
to ensure that all necessary precautions are taken to prevent any sedimentation or other
alteration or disturbance to the ground surface or vegetation within Tidal Wetlands
jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland
jurisdictional boundary and the coastal erosion hazard area and your project or erecting
a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mr. King and Members of the Board:
On November 5th, I received a copy of the attached notice that Franeker
Investments, Inc., and Judith Corrente are applying for a permit for a proposed addition
to an existing garden shed on their property on Fishers Island. The permit application
will be open for public comment on November 14th. The proposed addition includes a
15.58 foot by 16 foot addition to the shed, the construction of approximately 30 feet of
retaining wall, a pervious stone parking area, and roof gutters and a drywelL I own the
adjacent lot (#25-11) to the west of their property, and I am writing to request that no
permit be granted for any addition or expansion to the present structure, since it will
allow for more equipment to be brought into this residential area, creating more traffic
and noise.
Since this property was acquired several years ago, the owners have cut down an
area of brush and undergrowth which, for years, had served as a habitat for animals and a
buffer zone between our two properties. They then erected the present structure without
notifYing me. What is quaintly referred to as a "garden shed" has become, in fact, a
maintenance facility for the entire estate, with more than one person working there each
day. As you will see from the site plan, the proposed addition will almost double the size
of the present structure in close proximity to the property line.
This building serves a large estate with a large area oflawn and gardens, which
require much maintenance. The constant noise generated by this facility is disturbing.
Most weekday mornings at 8 a.m. the noise begins as the workmen start up the lawn
maintenance equipment, and neighbors hear noise from a lawn tractor, lawn mowers,
weeder/trimmers, leaf blowers, and an occasional chain saw, back hoe and other power
equipment.
When the machinery is not running, we also can hear noise from truck engines,
the conversations of the workmen and, occasionally, a radio. My requests to the

workmen to lessen the noise have been ignored. This has got to stop, and the activities of
the present shed should be moved further away from our property line.
My family and I come to Fishers to enjoy the peace and quiet it affords. In order
to help defray the high costs ofliving there, I have had to rent out the house for a few
weeks during the summer, and the tenants have complained to me about all of the noise
from this shed. It just seems to get worse each year, and we feel nothing is being done
about it.
Any further additions will only make matters worse, so I must object to this
project for several reasons:
It would be another step in changing the peaceful nature of this residential
neighborhood.
It would become a garage or storage area for all of the maintenance equipment on
the property, and would allow for more equipment to be parked in the area.
Work starts early in the morning, and neighbors are subjected to the noise. This is
especially annoying during the summer months when people have their windows open.
The activity disrupts the peace and tranquility of the area. During the last few
years, there has been constant construction and traffic from renovations being made to the
main house, grounds, and an adjacent residence which once was a windmill used to pump
water for the property.
Thank you for the opportunity to comment on this matter. Obviously, I dislike
having to write a letter like this, but feel there is no other recourse. Please do not grant a
permit for any further construction on the property, as it will only lead to more noise
from all of the equipment.

Dear Mr. King:
I am presently writing you as a follow up to the site inspection that you had
performed at this site on 1/29/08 as well as the discussion that I had with the
Board at the last Trustees meeting. As you may recall when on site with the
staff ofthe N. Y.S.D.E.C.'s Freshwater Wetlands Unit it was discussed that
the area of vegetation that I had flagged as freshwater wetlands was actually
not wetlands. Since that time the Board has also asked how much fill would
be needed for the construction of the proposed retaining wall. I have
discussed this matter with the project's surveyor and he feels that with the
regrading of the area there shall be approximately 26 cy of extra fill that
shall be removed from the site. For your and the Board's review I have
enclosed 3 copies of the revised plans which have been prepared by CME
Associates (last dated 3/04/08) which have been revised to depict that
drywells shall be installed to capture roof runoff and that a continuous line
of silt fencing and staked hay bales shall be installed and maintained
throughout construction. The area of wetlands that were originally depicted
on the plans has now been deleted.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
ofthe Town of South old Town Code and the Local Waterfront Revitalization Program
(L WRP) Policy Standards. Based upon the information provided on the L WRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the denoted following Policy Standards and therefore is INCONSISTENT with
the L WRP.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other
lands under their jurisdiction

1. Comply with Trustee regulations and recommendations as set
forth in Trustee permit conditions.
The distance from the proposed addition to the freshwater wetland line
is 44 feet; the distance from the proposed drivewav to the freshwater
wetland is 20 feet; a minimum setback distance of 50 feet from the
wetland boundarv is required pursuant to Chapter 275-3.Findinl!s;
purpose; iurisdiction; setbacks and 275-5. B (2) e. Please require that the
applicant amend the application to meet the above policy to the l!reatest
extent practical.
If the action is approved and to further Policy 5: Protect and Improve Water quality
in the Town of South old:
1. Require a 30 foot nonturf. native vel!etation buffer landward of
the freshwater wetland.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except mi1/Or exempt actions including Building Permits
and other ministeriol permits 1/Ot located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coasta1 area (which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determiuation that it is consistent to the maximum extent practicable with the L WRP policy
standards and conditions. If an action cannot be certified as consistent with the L WRP policy
standards and conditions, it shall not be undertaken.

Applicant proposes to construct a 15.58' x 16' addition onto an existing
garden shed, 44' from the Freshwater Wetlands Line. To construct::t 30' of
retaining walls and a stone (pervious) parking area. A continuous line of
staked hay bales with silt fencing shall be installed to establish the limits of
grading, clearing and ground disturbance. Roof gutters leading to drywells
shall be installed to collect rainwater. All work according to plans prepared
by CME Associates Engineering, Land Surveying and Architecture, PLLC
last dated 8/29/07 .
As part of my review of the Town's LWRP Consistency Form Section C, I
offer the following comments regarding the Local Waterfront Revitalization
Policies and this proposed project:
Policy 1. The project activities shall be "concentrated" on a site where
similar activities (existing garden shed) currently exist. The project does
not involve agricultural land nor will open space be utilized or impacted. I
believe that this project is consistent with this policy because the project
will not result in a negative impact upon the desired development pattern of
the Town of South old nor shall it result in the loss of the community and
landscape pattern of the Town of South old.
Policy 2. I believe that this project is consistent with this policy because
the project shall not have any impacts upon the preservation and retention
of historic resources, or any archeological resources nor the Coastal Culture
ofthe Peconic Bays. The reason for this is that the project site has
previously been "disturbed" and developed. The property itse1fwas
previously disturbed when the existing dwelling and garden shed was
constructed.

Policy 3. I believe that this project is consistent with this policy since the
project will not have an impact on any scenic resource of the Town of
Southold.
Policy 4. I feel that the project is consistent with this policy for a number of
reasons. The proposed addition to the shed and proposed retaining walls
and stone drive has been designed based upon sound engineering practices
and designed to the minimum scale necessary. The project shall have no
adverse impacts upon adjacent properties or to natural coastal processes or
natural resources. The project shall have no impact on any natural
protective features nor shall it have any impacts upon public lands or lands
in public trust. Lastly, the project does not involve the management of a
navigational infrastructure nor are public funds involved with the project.
Policy 5. I feel that the proposed project is consistent with this policy for a
number of reasons. The project does not involve any direct or indirect
discharges that would cause any negative impacts upon water quality
standards. There shall be no increase or decrease in the pH, the dissolved
oxygen or nutrients in the waterway and there should be no increase in
noxious odors at the project site. There shall be no increase in negative
health impacts such as pathogens, chemical contaminants or toxicity nor
shall there be any negative aesthetic factors involved with the project. The
project does not involve watershed development or the quantity or quality of
potable water.
Policy 6. I feel that the project is consistent with this policy. The project as
proposed shall have no impact upon the ecological quality in the Town of
Southold. There shall be no negative impacts upon the adjacent area of
freshwater wetlands by the destruction of habitat or significant impairment
to the tolerance range of any species of fish or wildlife. The project should
have no impact upon any vulnerable fish, wildlife, plant species or rare
ecological communities.
Policy 7. I do not feel that this policy is applicable to this project since the
project does not involve any atmospheric deposition of pollutants.
Policy 8. I believe that the project is consistent with this policy. The project
shall involve the disposal of solid waste or debris which shall be disposed of

properly. There are no hazardous waste or toxic pollutants involved with
the project.
Policy 9. I do not feel that this policy is applicable to this project. The
proposed project shall have no impact upon adequate physical public access
to coastal resources, shall not impact any public visual access to any lands
or waters, involve the public interest in and use oflands and waters held in
public trust or to public access of such areas. Nor will the project have
impacts upon the public's right of access along the shoreline
Policy 10. I feel that the project is consistent with this policy. The project
shall have no impacts upon any existing water-dependent commercial,
industrial or recreational uses of the Peconic Bays. Nor is the project located
on Mill Creek or within the Village of Greenport and does not involve
water-dependent uses at those sites.
Policy 11. I feel that the project is consistent with this policy. The project
does not involve aquaculture or the removal of shellfish from uncertified
waters of the Town of South old nor shall it have a negative impact upon the
long-term maintenance and health ofliving resources.
Policy 12. I do not feel that this policy is applicable to the project because
no agricultural lands are involved.
Policy 13. I do not feel that this policy is applicable to the project since the
project does not involve energy or mineral resources.
