The Town Board of the Town of Southold has received and reviewed the above-
referenced application seeking a change in zoning from R-80 to M-2. The application
was discussed at a Work Session of the Town Board on June 21, 2005, and the Board
has agreed that they will not take any action on the request. The intensity of uses `
permitted in the M-2 zone is inconsistent with the Town's comprehensive planning efforts
in that already overburdened portion of the Town. Accordingly, the Town Board is not
interested in considering a zone change on that parcel at this time.

In 1991,the ridership of the Cross Sound Ferry, according to Suffolk County, was
97,000 vehicles. In 1983, ferries left New London daily at 9:00 and 11:00 a.m.;they left
Orient at 5:00 and 7:00 p.m. CSF operated three vessels,the New London,which carried
55 vehicles and 295 passengers,the Plum Island,which carried 25 vehicles and 236
passengers, and the Caribbean,which carried 22 vehicles and 310 passengers. The Cape
Henlopen, carrying 90 cars and 900 passengers, was added in that year. In 1984 Cross
Sound Ferry received a$400,000 grant from from the New York State Department of
Transportaton to upgrade their facility. Supervisor Frank Murphy had been quoted in the
Suffolk Times(May 24)as stating at a Town Board hearing,"this is an improvement
project,not an expansion project", and at a ZBA hearing on April 5 on a petition for a use R E C E 11IE D
variance, James McMahon,Director of Community Development for the Town of
Southold,had represented on behalf of CSF that the idea was not to expand use or
ridership,that the Cape Henlopen would be taken out of service and replaced by one or AU G 16 2005
two small boats the size of the New London,and that the reservation system would be in
Orient(we know that none of this ever happened).
On this representation,the Southold Town ZBA and the County determined that the Southold Town Clevl
action did not warrant a Type I declaration under the State Environmental Quality
Review Act, as the Orient Association had insisted was necessary in order to determine
the impact of the proposed operation on the local environment and quality of life. Joseph
T. Sanseverino, Suffolk County Community Development Director, in a letter to the
Orient Association,predicted a ridership in 1991 of 166,439 vehicles. It had exceeded
that by 1985, and by 1990,the fleet,which still contained the Henlopen,was expanded to
include the John H., carrying 120 vehicles and 1000 passengers, and ferries were leaving
New London every hour between 7 a.m. and.9 p.m. Today, the fleet includes seven
vehicle ferries which leave every hour from both Orient and New London between the
hours of 7 a.m. and, in summer,9.45 p.m.; on May 12 Stan Mickus of CSF was quoted in
the Suffolk'Times as stating that in 2005 CSF had a ridership of 1.3 million. At no time
between 1985 and 1995 was CSF called back for a site-plan and SEQRA review,despite
the radical change from the original representation,and despite the Orient Association's
notification to the Town in 1991 that the site-plan was being violated.
In 1995 CSF applied for a 69-car parking lot west of the terminal;it was approved
without environmental review, CSF having stated that it was for employees and overflow.
A week or so later,they announced the introduction of the passenger-only high-speed
ferry,which they began operating without having filed a site plan to accommodate the
parking. Supervisor Tom Wickham sued CSF in the NYS Supreme Court for an
injunction against their operations until a new site plan was approved;Judge Patrick
Henry denied the injunction but stated that a new integrated site plan was required He
said"our denial,of a temporary restraining order and injunctive relief now should not be
construed as carte blanee for Defendant's unfettered expansion, if it conflicts with the
public good". He also said"that branch of the motion seeking injunctive relief is not
denied or dismissed. It is adjourned sine die and the Town can re-calendar it, should it be
so advised". He instructed.CSF and the Town to work together to resolve the issue. In
1996 CSF finally submitted a new site plan that included four parcels, one of them
residentially-zoned. After,a series of Planning Board and Town Board meetings,the PB
declared it a Type I action under SEQRA and listed, on the advice of consultants Charles

Voorhis&Associates, 10 strong reasons for reasons for a potential negative impact.(2)
After going as far as a scoping session, CSF withdrew the site plan application. Then, in
1997,both the Town Board and the Planning Board abruptly reversed their positions, and
when a site plan was subsequently brought back without the residential parcel, the
Planning Board agreed with CSF that there was no longer a requirement for a
Type I action, although all of the 10 SEQRA requirements were still applicable,as SCSR
strongly asserted. The Town's consultants based their advice only on the incremental
increase of traffic and parking since 1996, ignoring the fact that the effect of the
'introduction of the passenger ferry and the parking associated with it had never been
analyzed., (Please see attached letter from SCSR to Planning Board Chairman Bennett
Orlowski, which clearly summarizes the history and issues.) The plan was approved,
despite the fact that the parking spaces were not delineated;the first time in Southold
Town Planning Board history that this was so.If they were, it would be clear that the
SEQRA threshold had been passed. Although SCSR petitioned against the decision,in
2003 the court found in favor of CSF, accepting that the Planning Board had held
sufficient meetings and ignoring what SCSR believed to be the unprofessional manner in
which the public hearings were conducted. However, Justice Dunn did not formally issue
a final judgment in favor of the Planning Board and CSF. Normally the prevailing parties
would then normally draft a judgment themselves and present it to the court for entry,but
neither the PB nor CSF has done so. Since only a final judgment is appealable, SCSR has
been unable to appeal. The result of this sorry history is that an operation carrying well
over a million passengers annually and running up to 46 crossings daily has never been
submitted to environmental review.. Another result is that the number of vehicular ferry
trips has doubled in the interim.
(2)Most obviously,the number of parked cars is well over the threshold established by
SEQRA for a Type I designation, and the location of the site in a Critical Environmental
Area and adjacent to National Natural Area(the State Park)is another threshold. The
consultants for the Town listed the 10 following reasons for a type I designation in 1996
(I have abbreviated):
1. The property is adjacent to the Peconic Bay estuary and lies within the Orient
Point Critical Environmental Area, and is in proximity to the Orient Beach State Park and
48+acres of County owned-land.
2. significant increase in intensity of land use as function of expanded parking.
3. may change need and use of public and pedestrian services and increase
demand for other community services.
4. significant increase in number of vehicle trips
5.may adversely change noise and air quality as function of increased traffic and
may substantially increase solid waste generation. ' 1
6. increase use of on-site facilities particularly sanitary flow and water use, and
may result in an adverse impact on the environment
7.may inpact visual and aesthetic resources,particularly as regards lighting
8. may cause growth; study of mitigation of potential environmental impacts and
alternatives would be facilitated by preparation of draft EIS

More than six years ago,Cross Sound Ferry Services,Inc,("Cross
Sound")abruptly introduced a high-speedpassenger--only ferry service at its terminal in
the Town of Southold Once the Town and the Planning Board demanded that Cross
Sound comply with applicable local and state law by filing a new site plan covering the
entirety of Cross Sound's operation at Orient Point,Crass Sound responded by engaging
in a continuous pattern of litigation and delay to avoid such compliance_ Despite its
maneuvering,however,Cross Sound has,lost every challenge it made to the Town's
authority to require submission of comprehensive revised site plan for the entire ferry
terminal operation,and to the Town's obligation to conduct a detailed environmental
review of that site pian. In tight of this history,it is therefore impossi It to understand
why the Planning Board is now circulating a Lead Agency Coordination Request that,on
its face,appears to be incomplete and at odds with both the law and with the positions
that have been repeatedly and forcefully taken by the Town and the Planning Board itself
A brief review of the procedural history of this matter may be useful.After
Cross,Sound introduced its new passenger--only fent'service,the.Planning Board
resolved in:July 1995 that operation of the new ferry service and,the result ht use.of the
snack liar parcel as a parking lot for customers of the nevi-servvi=required revised site
ptati approval_ Cross Sound did not challenge this resolution. Instead,Cross-Sound
began to submit piecemeal site plans in an attempt to decouple the passenger-only ferry
service from the all of the changes accompanying introduction of that service,among
them a manfold increase in the numbers of can driving to and parking around the ferry
terminal. The Planning Board,however,stood fvmnt inrequicinp,comprehensive
integrated site,planw,tlratwouldaddress both the introductiowo€the nevrferry.service-and
its effect on all of Cross Sound's Southold facilities.. Ager r'eprosanting to_thhe state
Supreme•Court that it would comply_wi&the Planning,:Board-'s_request„ori 1-u1y.29, 1996,
Cross Sound submitted for approval a comprehensive:sk•planfor•the entire ferry
terminal area.
The submission of Cross Sound's comprehensive site plan for approval
automatically triggered the Planning Board's obligation-to apply-the provisions o€the
State Environmental,Quality Review Act("SEQRA'j. -hraceordenee with the relevant
state regulations,the Board determined on July 30, 1996,that review of Cross Sound's
comprehensive site plan was a"Type 1"action,i.e.,one presumptively requiring an
I navironmental Impact Statement("EIS"). On September 16,1996,the Plaiinrng Board
issued a Positive Declaration,which made an EIS mandatory- tarn December 16, 19%,
the Planning Board adopted a Scope Outline for the required EIS.

Cross Sound's response was to file a series of lawsuits challenging
(1)the Planning Board's Positive Declaration;(2)the Planning Board's adoption of the
Scope Outline;and(3)the constitutionality of those provisions of the Town Code of
Southold that required Cross Sound to submit a site plan to begin with. Cross Sound's
challengeamere rejected by the state Supreme Court in every instance. s a res
those court proceedings this Planning Board has the authority(and we believe the
obligatiork-to require a comprehensive site plan from Cross Sound and,pursuant to
SEQRA,to require an Environmental Impact Statement of the extent set out in the 1996
Scope Outline. One would think that the Board,having won on all counts,would now
resume an environmental review of the same scope and character as the one interrupted
by Cross-Sound%failed legal actions.
Yet,incomprehensibly,despite a successful four-year battle to vindicate
the Town's legal authority and obligations,the Planning Board now appears to have
reversed course and acceded Cross Sound's defective view of the SEQRA review
process: that the only issue involved is parking lot alterations. This is contrary to the taw
and to the position the Town has consistently maintained before the courts.
The controlling state regulations make it clear in no uncertain terms that:
[a]ctlons commonly consist of a set of activities or steps. The entire set of
activities or steps must be considered the action,whether the agency decision-
making relates to the action as a whole or to only a part of it
Considering only a part or segment of any action is contrary to the intent of
SBQR. If a lead,agency believes that circumstances warrant a segmented review,
it must clearly state in its determination of significance,and any subsequent EIS,
the supporting reasons and must demonstrate that such,review is clearly no less
protective of the environment. Related actions should be identified and discussed
to the fullest extent possible. 6 NYCRR§§617:3(g),617.3(g)(1)(emphasis
added). ,
While the Planning Board properly followed this mandate in its abortive review of Cross
Sound's 1996 integrated site plan,its latest action disregards it. Moreover,in improperly
disregarding the presumption against segmentation,the Lead Agency Coordination
Request provides no hint why the Planning Board now apparently considers a partial and
disjointed review"clearly no less protective of the enviromnent",especially given that it
reached the opposite conclusion four years ago,and nothing has changed. Nor could such
a review be"no less protective",since the substantial increase in the intensity of use of
Cross Sound's facilities,along with the new environmental stresses created by this use,
stems from a obvious common source--introduction of the passenger-only ferry service
and the associated traffic,parking and usage demands it creates. The effects of this new
service must be considered in any proper environmental review,a stance the Town has
consistently and correctly maintained in its litigation with Cross Sound.
As counsel for the Town affirmed to the state Supreme Court while
successfully moving to dismiss two of Cross Sound's meritless lawsuits:

Cross Sound has apparently adopted the position that the applications pending
before the ZBA and the Planning Board only apply for proposed parking on the
Trust parcel. That these applications were simply filed as a normal business move
and that SEQRA review should focus solely on the parking lot. . . . This defies
reason,is contradictory to the record and is contrary to the definition of"action"
subject to SEQRA review. Reply Affirmation of Francis J.Yakaboski,11119,20.
While the Trust parcel is no longer formally included in Cross Sound's latest
submission—although we believe it remains,contrary to its residential zoning status,a
repository of dredge spoil for other of Cross Sound's parcels—Mr.Yakaboski's statement
is equally true regarding the current site plan,which has been classified on the Lead
Agency Coordination Request as"approval of design&layout at three properties zoned
Marine i[sic]and used in the ferry terminal operation(staging and parking)."2 In the
words of the Town's counsel to the state Supreme Court,lt]he comprehensive site plan,
High Speed Ferry and ZBA applications regarding parking are inescapably linked. They
are the`activities or set of activities'which comprise the-action' subject to SEQRA
review in this case"and"Cross Sound's position would result in a segmented review
which is contrary to the purpose and intent of SEQRA." Even the 1996 Preliminary Site
Plan Study submitted by Cross Sound confirms that increased parking demands were
linked to the introduction of the new ferry service. According to Cross Sound's
consultants,"the principal users of the proposed parking facility will be the users of the
High.Speed Feiry,when that service is in use." Given these facts,we cannot understand
how the Planning Board can now decide to ignore its prior and correct determination of
the law,particularly when the alternative being circulated by the Board,in the words of
the Town's counsel,"defies reason"and is,"contrary to the purpose and intent of
SEQRA".
Furthermore,the Narrative submitted by Cross Sound begins with the
sentence,"Cross Sound Ferry Services,Inc.requests site plan approval from the Southold
Town Planning Board for the existing and on-going operations currently occurring at the
project site'. It does so despite providing no details or site plan covering those '
operations--only an incomplete proposal for parking modifications. If Cross Sound is
truly requesting appravai for"existing and on-going operations",as it must under the law,
it has no justification for shielding such operations from comprehensive SEQRA review.
The materials submitted by Cross Sound are plainly insuilicient for such s comprehensive
review,however,and the Lead Agency Coordination Request does not characterize the
SEQRA action as covering"existing and on-going operations". Nonetheless,given Cross
Sound's prior tactics,it is fairly predictable that Cross Sound will later attempt to argue
that SEQRA review of its parking plans somehow constituted SEW review of its
existing and on-going operations.
' Given Cross Sound's prior shell-game tactics,it would not be surprising if the Trust
parcel becomes the subject of a later,piecemeal application by Cross Sound for even
more parking. The current application confirms that the Trust parcel is still"controlled"
by Cross Sound. Narrative,p. 12.

Moreover,the materials prepared and submitted by Cross Sound in
connection with this review are being circulated even though they are obviously
incomplete and/or erroneous. For example,despite the fact that this submission is
ostensibly,if improperly,directed towards parking,Question B(lXf)of the Long
Enviroawatal Assessment Foam,which asks for the existing and proposed-number of
Packing spaces,is answered,"Refer to Narrative." The Narrative contains absolutely nv
such information. Furthermore,there is no answer to Question A(7)("Is the-project
substantially contiguous to a site listed on the Register of NaOonal Natural Landmarks?')_
In contrast to previous Cross Sound submissions,Question A(6)("Is the project
substantially contiguous to,or contain a building,site or district,listed,on,the,State or the
National Registers of Historic Places?")is answered"yes.".' Finally,the Narrative parrots.
Cross Sound's legally untenable position that parking on the Snack Bat Lot is a"pre-
existing,non-conforming use.
In connection with this last issue,it is still another matter of concern that
the Town is now apparently joining Cross Sound in its unwarranted position concerning
the toning status of the Snack Bar Lot. We have only recently seen a copy of a
memorandum dated August 14,2000,from Mr.Forrester to you,in which Mt.Forrester ,
claims to"have received evidence of,and have determined that parking on the parcel
known as the`snack bar parcel' is a pre-existing use". We uud6*and dds"evidence"
consists of aerial photographs from sometime in the 1950s showing a few,vehicles on the
snack bar lot,as well as an affidavit from a single individual stating that during-the 1950s
"[4rom time to time,we had occasion to park our vehicles and,the vehicles of our
employees east of the north/south extension of the present State Highv�ra�r at the site of the
present parking area now employed by patrons of the Cross Sowed fent'°.

addresses the actual use of the smack bar parcel on the date-Southold's zoning code went
into effect,or proves anything more than that a few ears wem once-occasionally located
on the snack bar parcel--hardly the substantial use required to establish'a non- '
conforming use. Given the legal fmrneworl;is it really the Tovwn'sposition that sporadic
parking vaguely alleged to have taken place sometime in the 1950s now gives Cross
Sound the right regularly to maintain a developed commercW parking lot for hundreds of
vehicles in violation of the Town's zoning ordinance?
Finally,it is our understanding that the PIanning Board intends to leave the
October 2,2000,Public Hearing open so that Cross Sound can fill in the many defects in
its current proposal. We believe that the PIanning Board should schedule a further public
hearing after Cross Sound has filed a complete and accurate application.
The land and waters,surrounding the Cross Sound terminal at Orient Point
are among the important natural and recreation resources of Southold,and their protection
is for too serious a matter to allow anything less than a full and fair review by the
Planning Board and the citizens of this Town. We urge the Planning Board to reject this
latest in,a long series of efforts to segment the review of Cross Sound's application for a

this information for the Planting Hoard's consideration in connection with its review of
the Site Plan Application of Cross Sound Ferry Services,Inc. ("CSF"),as requested in
your kftr of July 17,2001. This letter should be read to incorporate SCSR's previous
elements and submissions concerning CSFs most recent Site Plan Application,
bwhWing those made at the July 16,2001,hearing. In addition,we believe that much of
YAM SCSR has submitted to the Planning Board concerning CSF's previous Site Plan
Appliesdon is germane to this application,particularly as it relates to traffic,water quidity
ass the oavretmmeatal inspect of CSF's activities and its proposed projects. Because the

Dunn Engineering in their 1997 and 1999 studies underestimate the impacts the traffic generated by the ferry
has on the local volumes. Dunn claims that, compared to the total background traffic,the ferry traffic is
minimal. Dunn Engineering reports uses charts that show that ferry traffic can be as high as 50%of the
background and is regularly in excess of 20°x6 of the background volumes. Table 12 of Dunn's 1997 report
shows that the fent'component of the background traffic is 30%on weekdays, 20%Saturdays and 18%on
Sundays. These percentages are not minimal and in fact are a critical part of the SR 25 volume east of
Greenport. As such,attention must be given to any increases to either the background volume or ferry traffic
volumes when analyzing level of services impacts. In terms of pure traffic volumes and level of service,the
anticipated increase in traffic based on the data reviewed has little negative effect on State Route 25 east of
Greenport, as there is excess capacity on the roadway. This does not preclude future reductions in capacity
on SR 25. Any significant increase in demand for service will have a negative impact on local traffic.
In both the 1999 and 1997 reports, Dunn Engineering analyzed accident data for SR 25 east of Greenport.
During 1994 and 1995 the New York State Department of Transportation(NYSDOT)completed a widening
and repaving program designed to improve safety along roadways. This program included a shoulder.
improvement to allow for bicycle traffic,which has been steadily increasing. In 1996 the rate of accidents fell
dramatically, however as shown in Dunn's 1999 report in Table 3 since 1996 the accident rate has increased
each year. In 1997 and 1998 SR 25 east of Greenport had accidents rates higher than the State average for
two-lane rural highways.. This raise in accident rates coincided with the startup of the high-speed fent'
service. As stated previously, any increase in traffic east of Greenport must be analyzed carefully as in this
case where the rise in ferry demand following the addition of passenger only fent'service coincided with a
rise in accident rates.
The final part of our analysis involves the on-site parking. Dunn"s 1997 report does not look at on-site
parking, while the 1999 report has a section dedicated to 3Parking Considem ionsz. In addition the Full EAF
prepared by Inter-Science Research Associates states that for on-site parking 3see narrative2. After a review
of Project Narrative for the Full Environmental Assessment Form(Part 1)as part of the Revised Proposed
Site Plan Application for Cross Sound Feny Services Inc.,there is no mention of on-site parking in terms of
quantity or location. According to Dunn Engineering, 345 vehicles can be parked on the site. During the
course of our research we found a plan prepared by Inter-Science in the Project Narrative for the Full
Environmental Assessment Form(Part 1)as part of the Revised Proposed Site Plan Application for Cross
Sound Ferry Services, Inc. This plan was titled Maximum Unassisted Parking Plan. On this plan is a parking
layout showing 147 parking spaces on the west lot and 235 parking spaces on the snack bar lot for a total of
382 parking spaces.
On Friday,July 6,2001 a field investigation was performed at the fent'terminal. It was found that there were
307 vehicles parked on lands owned by Cross Island Ferry Services, Inc. In addition there were thirty-six
vehicles parked on-street along SR 25. These vehicles were most likely parked for the ferry, as there was
sufficient excess parking in the Plum Island tot, Orient State Park parking area and in the County Park. Both
the snack bar lot and west lot were basically filled to capacity. I'd like to submit photos we had taken showing
the parking problems as we described them.
Another field investigation was performed on Sunday, July 15, 2001. it was found that there were 363
vehicles parked on lands owned by Cross Island Ferry Services, Inc. In addition there were seventy-one
vehicles parked on-street along SR 25. These vehicles were,again, most likely parked for the ferry,as t
was sufficient excess parking in the Plum Island lot, Orient State Park parking area and in the County P

and would like to submit them for the record. Interesting to note that police officers were actually on
tickets to some of the illegal parkers along SR 25. The photos also show the cars being ticketed.

On July 15, 2001 it appears that the Boy Scouts were to be dropped off at the fent'for a weeks vacation to
New England. The Boy Scouts had to make arrangements for the use of the adjoining federal parking lot for
the parent's cars. I counted 50 cars at 12:30 PM already in the federal parking lot. They were all Boy Scouts
related,the federal facility was closed. This is clearly indicating to us that there is insufficient parking on-site
for the demand.
Our research of the data shows that the West Lot had been approved for sixty-nine(69)parking spaces in
1995, prior to the introduction of the high-speed ferry service. There does not appear to be any approvals for
parking on the Snack Bar Lot. It is the position of the applicant that the Snack Bar Lot has been used as
parking since the early 1950's. Regardless of whether the Snack Bar Lot pre-dated the zoning,there have
been several renovations of the fent'terminal and surrounding area where a site plan should have been
submitted and a parking plan approved. This does not appear to be the case. Based on the Town records
there is no approved parking on the Snack Bar Lot. In our opinion,there are only sixty-nine(69)approved
parking spaces on the Cross Sound Ferry property. According to the Dunn Engineering report of 1999 there
is capacity for 345 parking spaces. Based on Dunn's data alone,this is an increase in 276 parking spaces.
Inter-Science prepared a plan that shows the site has the capacity to accommodate 382 parking spaces, an
increase of 313 spaces from what has been previously approved.
According to Chapter 100(Zoning)of the Code of the Town of Southold there are standards for the
construction of parking facilities. These standards describe the size of the spaces, aisle widths and number
required per use. In addition,the amount and type of landscaping is included. This includes depth and
location of buffers and setbacks. Section 100-191(C)describes that 3aisles between rows of parking spaces
shall not be less than twenty-two(22)feet2. Also,3fhe minimum parking stall width shall be nine(9)feet,
and the minimum length shall be nineteen(19)feet.2 Section 100-212 describes the front yard buffer area
along roadways. Section 100-212(B)states that in Ml or MIl zones a landscape buffer fifteen(15)feet in
depth is required along all street frontages. The Snack Bar Lot has almost its entire westerly property line
adjacent to the SR 25 right-of-way,thus frontage on SR 25. Section 100-213 pertains to transition buffer
areas along roadways and adjacent lots of different zoning. Section 100-213(13)(2)states that the required
buffer between a lot zoned MI or MI and a butting residential zoned lot,such as the Trost Parcel, requires a
twenty(20)foot buffer. Based on these Town Zoning requirements, a plan showing the parking in the Snack
Bar Lot was prepared(attached). It shows that only seventy-two(72)spaces can be placed on the snack bar
lot to comply with the zoning requirements. This brings the total on the entire site to 141 parking spaces.
Dunn's 1999 report uses a quote from the Institute of Transportation Engineers(ITE)Traffic Engineering
Handbook:
3Commercial parking attendants can park cars in stalls less than eight(8)feet wide. With self parking, stall
widths that will accommodate most passenger cars and light trucks range between 8.3 and 8.8 feet,
depending on anticipated parking activity. Where parking turnover is expected to be low,as for all day
parking, narrower stall widths are usually acceptable.2
But,the next paragraph in the Traffic Engineering Handbook states:
3Substandard stall and aisle widths prove to be a false economy. Although this permits the marking of more
stalls per given length,vehicles tend to encroach upon adjacent stalls so that one or more spaces are
unavailable for use. The end result is no gain in actual space usage, but a parking condition surrounded by
confusion.2

Inter-Science research prepared a plan titled Maximum Unassisted Parking Plan. In the potes on the plan
they describe the aisle widths used as twelve(12)feet minimum and fifteen(15)feet average. Neither Dunn
nor Inter Science explains the relationship between stall width and aisle width. The basic premise is the
narrower the stall the wider the aisle. Table 21-2 in ITE's Traffic Engineering Handbook clearly details this
relationship for different stall widths, stall angles and aisle widths. In this case, all plans show ninety(90)
degree parking. Table 21-2 states that for a stall width of 8.5 feet an aisle twenty-eight feet(28)is
recommended(it's the same aisle width for one-way or two-way traffic patterns). The aisle widths described
by Inter-Science are for one-way traffic(not mentioned)and angled parking. The use of one-way aisles and
angled parking significantly reduce the number of parking spaces that can be placed on the site. It should be
noted that the plans do not indicate one-way parking'but they clearly indicate dead-end rows.
According to 6 NYCRR Part 617(State Environmental Quality Review(SEQRA)Section 617.4b: 3 The
following actions are Type 1 if they are to be directly undertaken,funded or approved by an agency:
(10)any Unlisted action,that exceeds 25%of any threshold in this section,occurring wholly or partially within
or substantially contiguous to any publicly owned or operated parkland, recreation area or designated open
space, including any site on the Register of National Natural Landmarks pursuant to 36 CFR part 62, 1994$.2
The Type I threshold exceeded in this case is parking since the construction of 1,000 parking spaces is
automatically considered Type I. In this case there is a request to increase the approved parking on-site from
sixty-nine(69)to either 345(Dunn)or 382(Inter-Science)spaces. In both cases,the increase is more than
25%(250 spaces)of the parking threshold,276(Dunn)and 313(Inter Science).
In conclusion,it is clear that this application will have a major traffic safety impact on the area. The
requested increase in approved parking spaces in and of itself is a Type I action by definition. The accident
rate along SR 25 east of Greenport has increased since the introduction of the high-speed ferry service. The
vehicles currently parking along SR 25 are forcing bicyclists to use the main travel ways versus the shoulder
lanes creating a potential for more collisions. The fact the current volumes of traffic on SR 25 do not cause
any serious degradations of level-of-service,the percentage of traffic created by the fent'has been
significantly understated by the applicant. The proposed Snack Bar Lot parking does not meet the standards
of the Town or any industry standard publication.
�n rea/ity, the traffic safety issues take precedence over all the issues described above. Simply said,from a
traffic safety prospective,the cramming of the cars on undersized spaces, undersized aisle widths, no painted
parking stall spaces, etc.,create an unsafe condition and many possible legal issues that may develop with
respect to accidents. The Town may be held liable for allowing the parking of vehicles in substandard spaces
and could very easily be brought in as responsible for the parking approvals. All of these items show an
impact on the area that requires a more in depth review and appropriate site plans showing the proposed
parking schemes.

As we have recently discussed, the Town of Southold has been notified by the Governor
of the State of New York that effective immediately, in order to meet the recently
established "high alert" national security status for transportation, the National Guard has
been deployed to join with the Town of Southold Police Department in conducting
searches of all commercial vehicles and random passenger vehicles at the Cross Sound
Ferry terminal at Orient Point. We are informed that this is a temporary national security
measure, but have not been informed as to the duration of this engagement.
In order to comply with these heightened security directives in the safest manner
possible, and due to the space constraints within the Cross Sound parking area, it is
necessary to conduct the searches of the larger commercial vehicles outside of the
Cross Sound Ferry parking and loading area, on the shoulder of State Route 25. As a
result, the Town of Southold Police Department will cone off the sides of Route 25 for an
appropriate distance in order to perform these mandated searches. The Town Board of
the Town of Southold has thus asked for the cooperation of Cross Sound Ferry to permit
the overflow ferry parking currently utilizing State Route 25 to be directed, on a
temporary and emergency basis only, to the vacant field owned by Cross Sound Ferry to
the east of the ferry terminal. You and your employees have ensured us that a safe and
orderly system for routing such traffic can be achieved immediately.

As we have discussed, the Town's permission to park vehicles on this vacant lot is
limited to this temporary emergency activity related to national security directives. This
limited permission should not be construed as any grant of zoning, site plan or other
regulatory approval of any kind, nor shall it be taken as any waiver of the Town's power
to regulate, approve, deny or condition the use of these properties. Any and all required
approvals shall continue to be required as provided by law. The Town will notify you
immediately once it receives notice either that the heightened security status has been
lifted or if it determines for any other reason that parking in the adjacent lot must be
discontinued.

PROJECT DESCRIPTION
for the proposed Change of Zone by
Cross Sound Ferry Services, Inc.
Dated: May 4, 2005
The petition asks the Town Board to change the zoning district classification of two
parcels -- SCTM 100-15-9-3.5 & 3.6 -- from residential R-80 district to marine M-H
zoning district.
The proposed use of the two parcels is, as shown on the Concept Plan, as a parking
lot only. No ferry terminal structures (such as buildings, docks, ramps, etc.) are proposed
or planned for the two parcels. No shoreline structures are proposed or planned, an no
vessel access of any kind is proposed or planned (in fact, an artificial dune will be created
to separate the parking area from the beach). To quiet any speculation that the two
properties will be used for some purpose other than the proposed parking lot as shown on
the Concept Plan, the Town Board can condition the change-of-zone on there being no
ferry terminal structures.
As previously explained, the sole purpose of the proposed change-of-zone is to
allow the existing property controlled by Cross Sound Ferry Services, Inc. to be used for
its most suitable purpose, which is as an extension of the existing parking area on what is
called the "Snack Bar" parcel. Under the current zoning classification of R-80, the two
parcels are zoned for one single-family residential dwelling per parcel. From a planning
perspective, those zoned uses are inappropriate for these parcels, since the uses to the west
are zoned marine M-II, and the property to the east is owned by the County. An M-H
classification for the parcels is more appropriate from a planning perspective, and will
continue the existing character of the community by preserving the general division
between the marine uses, which are generally located south of Route 25 along the water,
and the existing residential uses north of Route 25.
In addition to sound planning reasons, the change-of-zone is further justified
because it is the most appropriate and safe means for providing much-need parking for
existing vehicles that currently park along the shoulder of the Route 25 terminus. There
can be little dispute that the public will be benefited by providing an alternative and safe
parking area for those vehicles. Since the two properties at issue are located behind the
Snack Bar parcel, the additional parking area would be virtually unnoticeable from Route
25. Thus, instead of a line of vehicles parked along the shoulder of Route 25, those
vehicles could be parked in a safe area out of sight of most of the public.

As requested, the Planning Board has reviewed the legislation in reference to the
above-captioned Local Law proposals, which are subject to a pubic hearing on
May 10, 2005. The Planning Board offers the following comments and
recommendations at this time:
1. A height of 22' is excessive for accessory structures and should remain at
18'.
2. It is not clear whether or not the height limitation of 22' for accessory
structures is applicable to agricultural structures.
3. The new restrictions for accessory structures are applicable to properties
in the R-40 Zoning District as described in the Purpose section of the
legislation. However, the text of Section 100-33 fails to include the R-40
Zoning District and should be amended accordingly.
4. The Planning Board supports the concept of preventing excessive
massing of residential structures. Therefore, with respect to the height
limitations for residential structures, the Planning Board has no objections
to the Local Law as proposed. However, additional new legislation is

PROJECT DESCRIPTION
for the proposed Change of Zone by
Cross Sound Ferry Services, Inc.
Dated: May 4, 2005
The petition asks the Town Board to change the zoning district classification of two
parcels -- SCTM 100-15-9-3.5 & 3.6 -- from residential R-80 district to marine M-Il
zoning district.
The proposed use of the two parcels is, as shown on the Concept Plan, as a parking
lot only. No ferry terminal structures (such as buildings, docks, ramps, etc.) are proposed
or planned for the two parcels. No shoreline structures are proposed or planned, an no
vessel access of any kind is proposed or planned (in fact, an artificial dune will be created
to separate the parking area from the beach). To quiet any speculation that the two
properties will be used for some purpose other than the proposed parking lot as shown on
the Concept Plan, the Town Board can condition the change-of-zone on there being no
ferry terminal structures.
As previously explained, the sole purpose of the proposed change-of-zone is to
allow the existing property controlled by Cross Sound Ferry Services, Inc. to be used for
its most suitable purpose, which is as an extension of the existing parking area on what is
called the "Snack Bar" parcel. Under the current zoning classification ofR-80, the two
parcels are zoned for one single-family residential dwelling per parcel. From a planning
perspective, those zoned uses are inappropriate for these parcels, since the uses to the west
are zoned marine M-Il, and the property to the east is owned by the County. An M-Il
classification for the parcels is more appropriate from a planning perspective, and will
continue the existing character of the community by preserving the general division
between the marine uses, which are generally located south of Route 25 along the water,
and the existing residential uses north of Route 25.
In addition to sound planning reasons, the change-of-zone is further justified
because it is the most appropriate and safe means for providing much-need parking for
existing vehicles that currently park along the shoulder of the Route 25 terminus. There
can be little dispute that the public will be benefited by providing an alternative and safe
parking area for those vehicles. Since the two properties at issue are located behind the
Snack Bar parcel, the additional parking area would be virtually mmoticeable from Route
25. Thus, instead of a line of vehicles parked along the shoulder of Route 25, those
vehicles could be parked in a safe area out of sight of most of the public.

Dear Town Board Members:
I have a copy of your April 26, 2005 Resolution concerning Cross Sound Ferry
and your Board's request to the New York State Department of Transportation. You
adopted that resolution without notice to Cross Sound Ferry ("CSF") or an opportunity to
be heard.
Your concerns about parking along State Route 25 can be alleviated, immediately,
and without interference with interstate commerce by allowing CFS's passengers, many
of whom are residents of the Town of South old, and the public, to park their vehicles on
CSF's now vacant property. That permission can be granted by the Town Board or the
Board of Appeals.
CSF has a petition pending before the Town Board for a change of zone to allow
property that it owns to be rezoned Marine II. If that application for a change of zone is
granted, it can be conditioned upon the rezoned property only being used for vehicle
parking purposes. The applicant agrees to that condition.
The same parking site is about to be the subject of an application to the Town
ZBA for a special permit pursuant to Southold Code Section 100-263, and/or a variance.

CSF owns or controls approximately 5 acres of property east of its Snack Bar
parking lot parcel that, as described above, is available for overflow parking purposes. If
in fact there is an emergency condition (as is suggested in the Board's resolution), the
Town should allow citizens to park their cars at the Orient site as an incident to traveling
to Connecticut upon motor vessels owned and operated by CSF in its providing interstate
water carrier service.
The vacant property east of the Snack Bar parking lot can be available for
vehicular parking on 48 hours notice.
CSF has asked me to advise you that it and its consultants will expedite any and
all administrative applications that can provide off-street parking on its land.
We ask you to rescind your April 26, 2005 resolution and work with CSF to
provide additional parking as proposed.

FULL ENVIRONMENTAL ASSESSMENT FORM
Purpose: The full EAF is designed to help applicants and agencies determine. in an orderly manner. whether a project or action may
be significant. The question of whether an action may be significant is not always easy to answer. Frequently, there are aspects of
a project that are subjective or unmeasurable. It is also understood that those who determine significance may have little or no formal
knowledge of the environment or may not be technically expert in environmental analysis. In addition. many who have knowledge
in one particular area may not be aware of the broader concerns affecting the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process
has been orderly, comprehensive in nature, yet flexible enough to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project data. it assists
a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance
as to whether an impact is likely to be considered small to moderate or whether it is a potentially-large impact. The
form also identifies whether an impact can be mitigated or reduced.

Note: The following text is intended to be used in association with the submitted application
forms and drawings. Therefore, this Project Statement is not an inclusive description of the
proposed action, but is instead a supplementary overview.

Proiect Site Identification. Data and Historv.
"
The project site is represented by two vacant adjoining parcels of land located adjacent to the
current Cross Sound Ferry Facility in Orient Point, Town of Southold. In specific, the parcels are
identified as SCTM 1000 - 15 - 9 - 3,5 & 3.6.
The parcels are accessed via State Route 25 and are currently zoned R-80 (Residential Low
Density A) by the Town of Southold. The parcels are approximately the same size, have a
combined area of 5.24 acres and possess over 450 Lf. of frontage along Gardiners Bay. The
project site is the only residentially zoned property, held in private ownership, located on the
south side of State Route 25 from the tip of Orient Point for a distance of approximately one mile
to the west.
The parcels have a history of site disturbance including agriculture and dredge spoil storage. Both
sites contain a continuous connecting dirt road which extends from the easternmost property line to
the westernmost property line. Both parcels are made up of primarily grassland which is subject
to routine mowing, A smaller amount ofbrushland vegetation exists on the periphery of the site,
suggestive of a successional field, Prior environmental studies have concluded that the project site
does not likely contain rare or unique species of flora and/or fauna.
In order to allow safe ingress and egress of the ferry vessels, the applicant must routinely dredge
the slips/loading ramp areas. Currently, the dredge spoil from these maintenance events is stored
in the southwestern comer of the project site, primarily on SCTM #1000 - 15 - 9 - 3.5. It has been
customary for NYS to access this stockpile and use the material for erosion control at Orient Point
State Park.
The western (SCTM 1000-15-9-3,5) and eastern (SCTM 1000-15-9-3.6) parcels which constitute
the project site are owned by (1) Adam C. Wronowski and Jessica Wronowski and (2) A & J Long
Island Reality, LLC., respectively. However, each parcel is under the control of Cross Sound
Ferry Services, Inc, since the referenced owners concurrently own/represent Cross Sound Ferry
Services, Inc.

Descriution ofthe Prouosed Action.
The proposal involves changing the existing zoning of the project site from R-80 (Residential Low
Density A) to Mil (Marine II). By changing the zoning of the site as proposed, the project site
would join a large block of land currently zoned Mil (occupied by Orient by the Sea Marina, Plum
Island Ferry and Cross Sound Ferry - current block, approximately 21 acres; proposed block,
approximately 26.25 acres). Route 25 would continue to serve as the main zoning district
boundary between the residentially zoned property to the north and the marine uses to the south.
Currently, there is not sufficient area at the Cross Sound Facility to accommodate the current
demand for parking. Upon obtaining approval for the change of zone and pursuant to the review of
an overall site plan by the Town Planning Board, the proposed zoning change would allow for the
creation of additional parking to accommodate ferry passengers who now routinely park along
State Route 25.
As explained in the previous section of this project statement, the applicant currently conducts
routine dredging of the slip/loading ramp area to allow for safe passage of the ferry vessels. The
dredge spoil is currently stockpiled on the project site and has been used in the past by NYS for
erosion control projects at Orient Point State Park. The applicant is proposing to shape and
replace the dredge spoil in a dune like formation along on the upland portion of the beach (no
closer than 50' from mean high water), just south of the proposed walkway. The artificial dune
will allow for protection of the parking area while also allowing continued unobstructed passage
along the beach. Ongoing dredging events will allow for maintenance of the dune, however, if the
dune does not require maintenance, the dredge material will be available to NYS for continued
erosion control projects at Orient Point State Park.
